Justice S.SIRI JAGAN\n\n Dated :30\/10\/2007\n\n O R D E R\n                           S.SIRI JAGAN,J\n               ======================\n                       W.P.(C).No.358 of 2007\n              =============-===========\n              Dated this the 30th day of October, 2007\n\n\n                             JUDGMENT\n<\/pre>\n<p id=\"p_1\">      The petitioner retired as Selection Grade Lecturer in<\/p>\n<p>Politics from a College under the N.S.S Corporate Management<\/p>\n<p>on 31.03.1997. The Petitioner&#8217;s actual date of superannuation<\/p>\n<p>was 30.11.1996. But he continued in service up to 31.03.1997<\/p>\n<p>by virtue of Rule 60(c) of the Kerala Service Rules. Earlier an<\/p>\n<p>issue arose as to whether the benefits of pay revision declared<\/p>\n<p>with effect from 1.03.1997 could be extended to those teachers<\/p>\n<p>who continued in service beyond 01.03.1997 by in tone of Rule<\/p>\n<p>60(c) although their actual date of superannuation fell before<\/p>\n<p>1.03.1997. This Court and Supreme Court upheld the right of<\/p>\n<p>such teachers for pay revision benefits, increments etc. The<\/p>\n<p>petitioner is seeking that benefit in this writ petition based on<\/p>\n<p>the decision of this Court as well as that of the Supreme Court<\/p>\n<p>upholding such rights. In the above circumstances the petitioner<\/p>\n<p>seeks the following reliefs:\n<\/p>\n<p id=\"p_1\">     i) &#8220;to issue a writ of certiorari or any other writ or order calling<\/p>\n<p>        for details relating to Ext.P11 and examine the legality,<\/p>\n<p>W.P.(C).No.358\/2007<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                    2<\/span><\/p>\n<p>        propriety and constitutionality and quash the same.<\/p>\n<p id=\"p_2\">     ii)to issue a writ of mandamus or any other writ or order<\/p>\n<p>        directing the 2nd respondent to pass orders granting enhanced<\/p>\n<p>        rate of commuted value of pension and DCRG at the revised<\/p>\n<p>        rate of pension with interest from the date that it had become<\/p>\n<p>        due;\n<\/p>\n<p id=\"p_3\">     iii)to declare that the petitioner is entitled to enhanced rate of<\/p>\n<p>        commuted value of pension and DCRG at the revised rate of<\/p>\n<p>        pension with interest after the date of his retirement on<\/p>\n<p>        31.3.1997.\n<\/p>\n<p id=\"p_4\">     iv)to direct the 2nd and 3rd respondents to release the pensionary<\/p>\n<p>        benefits with penal interest from the date of retirement to till<\/p>\n<p>        the date of its payment:&#8221;\n<\/p>\n<p id=\"p_5\">      The learned Government Pleader submits that by S.R.O<\/p>\n<p>No.591\/2006, Rule 60(c) was amended with retrospective effect<\/p>\n<p>from 15.05.1986, laying down that persons continuing in service<\/p>\n<p>by virtue of Rule 60(c)             beyond their actual date of<\/p>\n<p>superannuation would not be entitled to benefit of pay revision if<\/p>\n<p>they attained age of superannuation before the date of effect of<\/p>\n<p>pay revision. The Government Pleader submits that in view of<\/p>\n<p>amendment with retrospective effect the petitioner is not<\/p>\n<p>entitled to the reliefs prayed for.
