Respondent No.2 father had filed<br \/>\nCriminal Miscellaneous Application No.585 of 2008 before the Family<br \/>\nCourt, Rajkot seeking maintenance from his sons contending that in<br \/>\nold age he has no independent source of income and he is unable to<br \/>\nmaintain himself.\n<\/p>\n<p id=\"p_1\">2.\tLearned<br \/>\nJudge of Family Court, Rajkot by impugned order dated 9.9.2010<br \/>\nallowed the application partly and directed both the sons to pay<br \/>\nRs.600\/- each per month to the father. He thus received a total of<br \/>\nRs.1200\/- by way of maintenance from two sons.\n<\/p>\n<p id=\"p_2\">3.\tIn<br \/>\nthe present case, the petitioners have opposed the order of<br \/>\nmaintenance on various grounds, namely, that the father had deserted<br \/>\nthe family many years back and has started leaving with another lady<br \/>\nwithout any valid marriage. From such cohabitation he also has one<br \/>\nson and one daughter against whom no claim is made. It is also the<br \/>\ncase of the petitioners that the petitioners are willing to look<br \/>\nafter the father if he resides with them. The case of the petitioners<br \/>\nfurther is that they do not have sufficient means to pay maintenance<br \/>\nto the father.\n<\/p>\n<p id=\"p_3\">4.\tCounsel<br \/>\nfor the petitioners drew my attention to the evidence on record to<br \/>\npoint out that the cohabitation of the father with another lady and<br \/>\nthis lady giving birth to two children out of such cohabitation are<br \/>\nadmitted by him. Counsel for the petitioners submitted that the<br \/>\nfather had not supported the family yet sold away certain immovable<br \/>\nproperties from which he has received considerable amount. He also<br \/>\ninstituted several proceedings seeking eviction of the petitioners<br \/>\nfrom the residential premises occupied by them.\n<\/p>\n<p id=\"p_4\">5.<br \/>\nCounsel for the respondent No.2 was absent on numerous occasions, I,<br \/>\ntherefore, had no benefit of his arguments.\n<\/p>\n<p id=\"p_5\">6.\tSo<br \/>\nfar as the contention that the father has sold certain  immovable<br \/>\nproperties and raised considerable amount which could be source for<br \/>\nhis sustenance is concerned, admittedly there is no evidence on<br \/>\nrecord in this regard. Such oral averments, raised for the first time<br \/>\nin the High Court, cannot be accepted.\n<\/p>\n<p id=\"p_6\">7.\tIn<br \/>\nso far liability of the petitioners to maintain their father, who has<br \/>\nno independent source of income, flows clearly from sub-Section(1) of<br \/>\n<a href=\"\/doc\/1056396\/\" id=\"a_1\">Section 125<\/a> of the Criminal Procedure Code. It reads as follows:-\n<\/p>\n<p id=\"p_7\">&#8220;Section125.\n<\/p>\n<p id=\"p_8\">Order for maintenance of wives, children and parents(1)<br \/>\nIf any person having sufficient means neglects or refuses to<br \/>\nmaintain-\n<\/p>\n<p id=\"p_9\">(a)\this wife,<br \/>\nunable to maintain herself, or<\/p>\n<p id=\"p_10\">(b)\this<br \/>\nlegitimate or illegitimate minor child, whether married or not,<br \/>\nunable to maintain itself, or <\/p>\n<p id=\"p_11\">(c)\this<br \/>\nlegitimate or illegitimate child ( not being married daughter) who<br \/>\nhas attained majority, where such child is, by reason of any physical<br \/>\nor mental, abnormality or injury unable to maintain itself, or <\/p>\n<p id=\"p_12\">(d)\this father<br \/>\nor mother, unable to maintain himself or herself,<\/p>\n<p>a Magistrate of<br \/>\nthe first class may, upon proof of such neglect or refusal, order<br \/>\nsuch person to make a monthly allowance for the maintenance of his<br \/>\nwife or such child, father or mother, at such monthly rate, as such<br \/>\nmagistrate thinks fit, and to pay the same to such person as the<br \/>\nMagistrate may from time to time direct:\n<\/p>\n<p id=\"p_13\">\txxx\txxx\txxx\t<\/p>\n<p id=\"p_14\">8.\tIn<br \/>\nabsence of anything on record to suggest that the father had any<br \/>\nsource of income whatsoever, the Family Court rightly believed that<br \/>\nhe was unable to maintain himself, particularly, looking to his age<br \/>\nof about 72 years.\n<\/p>\n<p id=\"p_15\">9.\tIt<br \/>\nhas also come on record that the father is not only aged but he is<br \/>\nalso infirm and suffers from sickness time and again.\n<\/p>\n<p id=\"p_16\">10.\tRegarding<br \/>\nability of the petitioners to pay maintenance, learned Judge though<br \/>\ndiscarded the averment of the father that the sons are earning<br \/>\nRs.12,000\/- to 20,000\/- per month, on the basis of evidence on<br \/>\nrecord, learned Judge believed that the petitioner No.1 would be<br \/>\nearning approximately Rs.3000\/- per month and petitioner No.2<br \/>\nRs.3,500\/- per month. Considering their family liabilities, he asked<br \/>\nthem to pay Rs. 600\/- each to the father. With this assessment or the<br \/>\nultimate direction, I find no infirmity whatsoever.\n<\/p>\n<p id=\"p_17\">11.<br \/>\n\tIt is true that the father had admitted that he had entered into an<br \/>\nagreement of friendship with one lady in the year 1990 and from such<br \/>\ncohabitation two children were also born. However, the petitioners<br \/>\nare  currently stated to be aged 52 years and 48 years respectively.<br \/>\nIn the year 1990, therefore, they were fully grown up in the age<br \/>\ngroup of 28 and 22 respectively. It, therefore, cannot be stated that<br \/>\nthe father abandoned them in their infancy. Further the fact that the<br \/>\nfather has not claimed any maintenance from other  son, can hardly be<br \/>\na ground to absolve these petitioners from their responsibility to<br \/>\nlook after their father in his old age.\n<\/p>\n<p id=\"p_18\">12.\tUnder<br \/>\nthe circumstances, the petition is dismissed. It is, however,<br \/>\nclarified that if the petitioners have any evidence to show that the<br \/>\nfather, by virtue of sale of properties, has received considerable<br \/>\namount, which could be his source of income, it would be open for<br \/>\nthem to file application under <a href=\"\/doc\/778934\/\" id=\"a_1\">Section 127<\/a> of the Criminal Procedure<br \/>\nCode before the Family Court.\n<\/p>\n<p id=\"p_19\">13.\tWith<br \/>\nabove observations, petition is dismissed. Interim relief stands<br \/>\nvacated.
