MATHUR &amp; LOKESHWAR SINGH PANTA\n\nJUDGMENT:\n<\/pre>\n<p id=\"p_1\">JUDGMENT<\/p>\n<p>O R D E R <\/p>\n<p>CIVIL APPEAL NO. 1431 OF 2001<\/p>\n<p>\t\tWe have heard learned counsel for the parties.\n<\/p>\n<p id=\"p_1\">\t\tThis appeal is directed against the judgment and order<br \/>\npassed by the learned Single Judge whereby the learned Single Judge<br \/>\nhas set aside the judgment and decree passed by the 3rd Additional<br \/>\nCivil Judge in O.S. No. 8492 of 1980.  The Trial Court by its order<br \/>\ndated 30th June, 1992 dismissed the suit for specific performance.\n<\/p>\n<p id=\"p_2\">\t\tAggrieved against this order the plaintiff filed an appeal<br \/>\nbefore the High Court and the appeal was decreed by the High Court<br \/>\nsetting aside the judgment of the Trial Court.  Aggrieved against<br \/>\nthis order, the present appeal was filed by the legal representatives<br \/>\nof the deceased of the defendant.\n<\/p>\n<p id=\"p_3\">\t\tThe brief facts which are necessary for the disposal of<br \/>\nthis appeal are that the plaintiff entered into an agreement of sale<br \/>\non 8.8.1979 with the defendant.  In pursuance of the agreement, a<br \/>\nplot measuring 40&#8242; x 180&#8242; was agreed to be sold from the larger<br \/>\nextent of plot measuring 100&#8242; x 180&#8242; and further 20&#8242; x 180&#8242; road was<br \/>\nalso assured to be provided.  The consideration was Rs. 22\/- per sq.<br \/>\nft. and an advance of Rs. 10,000\/- was paid and that within three<br \/>\nmonths, the contract was to be completed.\n<\/p>\n<p id=\"p_4\">\t\tThe defendant vendor was obliged to obtain necessary<br \/>\nsanction from the competent authority for executing the sale deed and<br \/>\nalso to undertake that the total extent of land held by the vendor is<br \/>\nin excess of the limit permitted under the <a href=\"\/doc\/1005850\/\" id=\"a_1\">Urban Land Ceiling Act<\/a> and<br \/>\nif at all surrender of the land to be made to the authority excluding<br \/>\nthe agreed vacant land, the other land would be surrendered to the<br \/>\ncompetent authority.\n<\/p>\n<p id=\"p_5\">\t\tThe plot in question is admittedly an ancestral property of<br \/>\nthe vendor.  It is alleged that he was always ready and willing to<br \/>\nperform his part of the contract, however, the defendant vendor was<br \/>\nnot prepared to execute the sale deed and when he was making attempts<br \/>\nto alienate the property, a suit was filed for injunction and<br \/>\nsubsequently, the present suit was filed for specific performance.<br \/>\nThe suit was contested by defendant by filing a statement and it was<br \/>\ncontended that defendant suffered a paralytic stroke, as such, he<br \/>\ncould not execute the agreement and besides, other members were not<br \/>\nwilling to sell the ancestral property.  Therefore, he cancelled the<br \/>\nagreement.  It is alleged that under the agreement, the time was<br \/>\nessence of the contract and as per the terms, the earnest money of<br \/>\nRs. 10,000\/- was forfeited.  The defendant died during the pendency<br \/>\nof the proceedings.  Therefore, the Trial Court framed six issues and<br \/>\ndismissed the suit.\n<\/p>\n<p id=\"p_6\">\t\tAggrieved against that, the first appeal was filed before<br \/>\nthe High Court and the High Court framed four issues for<br \/>\ndetermination.  After considering the matter, the High Court allowed<br \/>\nthe appeal and decreed the suit and answered Point Nos. 1, 3 and 4 in<br \/>\nthe negative and Point No. 2 in the affirmative.\n<\/p>\n<p id=\"p_7\">\t\tAggrieved against the order passed by the High Court, the<br \/>\npresent appeal was filed.\n<\/p>\n<p id=\"p_8\">\t\tWe have heard learned counsel for the parties and perused<br \/>\nthe record.  We gave an opportunity to both the parties that if they<br \/>\ncan work out some solution by mutual agreement but both the learned<br \/>\ncounsels has submitted that parties are unable to arrive at any<br \/>\nmutual agreed compromise.\n<\/p>\n<p id=\"p_9\">\t\tIt is an admitted position that the property in question is<br \/>\nan ancestral property and, the appellant though has expired, the<br \/>\nappeal has been prosecuted by his legal representatives.\n<\/p>\n<p id=\"p_10\">\t\tLearned Single Judge in his judgment has clearly mentioned<br \/>\nthat &#8220;However, the extent of the property now to be sold in the event<br \/>\nof a decree, would be limited to the extent of the property that<br \/>\ncould be allowed to the defendant&#8217;s share, in the event of the<br \/>\nplaintiff filing a follow up suit for partition.  However, for the<br \/>\npresent, it is suffice to hold that the plaintiff would be entitled<br \/>\nto a decree for specific performance to an extent of 40&#8242; x 180&#8242; as<br \/>\nagreed in Ex. P.1.&#8221;\n<\/p>\n<p id=\"p_11\">\t\tTherefore, in view of this finding, it is clear that the<br \/>\nplaintiff can only seek a decree of enforcement of the agreement to<br \/>\nthe extent of the original defendant&#8217;s share.  Therefore, we need not<br \/>\ngo into all those factual controversies that there was a family<br \/>\nnecessity or not since it is a finding of fact which has been<br \/>\nrecorded by the High Court.  There is no reason to take a different<br \/>\nview of the matter.  We only modify the order of the High Court to<br \/>\nthe extent that the finding given by it as quoted above that the<br \/>\nplaintiff will be entitled to enforcement of agreement of sale to the<br \/>\nextent of the original defendant.  If it comes to 1\/11th or 1\/12th<br \/>\nshare, that is a question of fact decided by the proper forum.<br \/>\nHowever, the decree of enforcement of Ex. P.1 is granted to the<br \/>\nplaintiff to the extent of the share of original defendant No. 1 in<br \/>\nsuit, i.e., father of appellants.\n<\/p>\n<p id=\"p_12\">\t\tThe appeal is accordingly, disposed of.\n<\/p>\n<p id=\"p_13\">\t\tNo order as to costs.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India N.A.
