Purohit,for the petitioner.\nMr.S.M.Parihar, for the respondents.\n                            ....\n\n      By way of this writ petition, the defendant-petitioner\n\nseeks to question the order dated 05.09.2005 as passed by\n\nthe Board of Revenue for Rajasthan, Ajmer while dismissing\n\nthe revision petition   filed by him against the order dated\n\n02.05.1997 as passed by the Revenue Appellate Authority,\n\nJodhpur whereby an order for temporary injunction as made\n\nby the Assistant Collector (HQ), Jodhpur on 25.02.1997 was\n\naffirmed.\n\n       The plaintiffs-respondents have filed a revenue suit\n\nessentially with the submissions that they were having 26\n\nbighas and 8 biswas agriculture land comprised in Khasra\n\nNo.528 that has an adjoining piece of land      comprised in\n\nKhasra No.540. The plaintiffs have averred that 31 bighas of\n\nland in Khasra No.540 had already been recorded in their\n\nfather's name but another piece of 6 bighas and 5 biswas of\n\nland in the same Khasra No.540, though been in possession\n\nof their father and regularised in his favour, remained to be\n\nrecorded so. The plaintiffs would, however, assert that they\n                                 2\n\nare in cultivatory possession of 37 bighas and 5 biswas of land\n\ncomprised Khasra No.540. The plaintiffs have stated that the\n\ndefendant-petitioner got allotted certain piece of land, said to\n\nbe in Khasra No.540, and on that basis was trying to interfere\n\nwith the land in their possession. \u0915 \u0916.\u0928. 540 \u0915 \u092d\u092e \u0915#\u0932 \u0930\u0915\u092c 37 \u092c \u0918 5 \u092c\u092c\u0938\u0935\n                                  3\n\n      \u0915 \u0915\u092c\u091c \u0915 \u0936\u0924 \u0915 \u092d\u092e           7 \u0926\u0916\u0932 \u0928 \u0924 \u0938\u0935\u092f \u0915\u09307 \u0924\u0930 \u0928\n      \u0905\u0928\u092f \u0915\u0915\u0938 \u0938 \u0915\u0930 \u0935 \u0964\"\n\n\n      The appeal taken by the petitioner against the order\n\naforesaid was dismissed by the Revenue Appellate Authority\n\non 02.05.1997 and the revision petition taken to Board has\n\nbeen dismissed      by the impugned order dated 05.09.2005.\n\nThe learned member of the Board came to the conclusion that\n\nthe petitioner had failed to show if the land that was allotted to\n\nhim after carving out Khasra No.540\/16 was the very same\n\ndisputed piece of land and rather, he had failed to show if the\n\nland recorded as Khasra No.540\/16 was at all alloted to him.\n\n      In this petition, on 23.09.2008, the learned counsel for\n\nthe parties submitted that according to some unconfirmed\n\ninformation, probably the dispute has been settled between\n\nthe parties and the learned counsel were granted time to\n\ncomplete their instructions; and the matter was further\n\nadjourned on 22.10.2008 and 21.11.2008 for the same\n\npurpose. Learned counsel for the parties, however, express\n\ntheir inability to specifically state if the parties have arrived at\n\ncompromise and have, thus, been heard on merits.\n\n      It has been attempted to be argued on behalf of the\n\npetitioner while challenging the orders aforesaid         that the\n\nplaintiffs have no right in relation to the land in question; they\n\nhave failed to produce any regularisation order in their favour;\n                                  4\n\nand the petitioner having lawfully been granted the land in\n\nquestion, deserves not to be deprived of the use of the same\n\nduring the pendency of the suit.\n\n         During the course of submissions, learned counsel for\n\nthe parties were posed the question about the present status\n\nof the suit if at all pending and in that regard too, learned\n\ncounsel expressed their inability to make any submission for\n\nwant of necessary information.        Be that as it may, having\n\nexamined the orders passed by the learned Revenue Courts,\n\nthis Court is satisfied that the application for grant of temporary\n\ninjunction has been dealt with and decided on relevant\n\nconsiderations;     and after finding the      plaintiffs being in\n\npossession of the land in question, the defendant-petitioner\n\nhas been restrained from interfering therewith.\n\n         In this matter relating to    interim relief during the\n\npendency of the suit, when the three Revenue Courts have\n\nfound it justified to grant the prayer for temporary injunction\n\nagainst the petitioner on relevant considerations, the present\n\none does not appear to be a fit case for any interference in the\n\nextraordinary writ jurisdiction, more particularly when there is\n\nno error apparent on the face of record.\n\n         The writ petition fails and is, therefore, dismissed.
