Since no reply was<br \/>\nreceived within the mandated time of 30 days, he had filed a complaint under Section 18 to<br \/>\nthe Commission. The Commission issued a notice to the PIO on 14\/11\/2008 asking him to<br \/>\nsupply the information and sought an explanation for not furnishing the information within<br \/>\nthe mandated time.\n<\/p>\n<p id=\"p_2\">  The Commission has neither received a copy of the information sent to the complainant,<br \/>\nnor has it received any explanation from the PIO for not supplying the information to the<br \/>\ncomplainant. Therefore, the only presumption that can be derived is that the PIO has<br \/>\ndeliberately and without any reasonable cause refused to give information as per the<br \/>\nprovisions of the <a href=\"\/doc\/671631\/\" id=\"a_1\">RTI Act<\/a>. His failure to respond to the Commission&#8217;s notice shows that he<br \/>\nhas no reasons for the refusal of information.\n<\/p>\n<p id=\"p_3\">Decision:\n<\/p>\n<p id=\"p_4\">The Complaint is allowed.\n<\/p>\n<p id=\"p_5\">The PIO will send the complete information to the complainant before January 22, 2009. The<br \/>\nPIO&#8217;s action clearly amounts to denial of information without any reasons. The PIO is<br \/>\ntherefore, asked to submit a written explanation showing cause as to why penalty should not<br \/>\nbe imposed and disciplinary action be recommended against him under <a href=\"\/doc\/1369783\/\" id=\"a_1\">Section 20<\/a> (1) &amp; (2)<br \/>\nof the <a href=\"\/doc\/671631\/\" id=\"a_2\">RTI Act<\/a> before January 27, 2009.
