However, Mr.Pujari, learned AGP appearing for the<br \/>\n\trespondent State Authorities stated that the matter may be remanded<br \/>\n\tto the Deputy Collector as if the appeal is allowed, and Deputy<br \/>\n\tCollector shall decide the matter afresh. He submitted that the<br \/>\n\tpetitioner concerned may appear before the Deputy Collector within<br \/>\n\ttwo weeks from today.\n<\/p>\n<p id=\"p_4\">In<br \/>\n\tview of the above declaration made on behalf of the State<br \/>\n\tGovernment, the impugned order passed by the Deputy Collector for<br \/>\n\tassessment of the stamp duty as well as the order of Appellate<br \/>\n\tAuthority for rejection of the appeal on the ground of limitation<br \/>\n\tare quashed and set aside with the direction that the matter shall<br \/>\n\tstand restored to the Deputy Collector.\n<\/p>\n<p id=\"p_5\">The<br \/>\n\tpetitioner concerned shall appear before the Deputy Collector within<br \/>\n\ttwo weeks from today. The Deputy Collector shall decide the matter<br \/>\n\tin accordance with law after giving opportunity of hearing to the<br \/>\n\tpetitioner and shall pass the order.\n<\/p>\n<p id=\"p_6\">It<br \/>\n\tis hardly required to be stated that until a fresh order is passed<br \/>\n\tby the Deputy Collector, there shall be no further recovery. The<br \/>\n\tamount deposited, if any, by the petitioner concerned pending the<br \/>\n\tappeal, shall remain as the deposit and shall be subject to the<br \/>\n\tfinal order which may be passed by the Deputy Collector inasmuch as<br \/>\n\tif there is no assessment of the additional stamp duty, the amount<br \/>\n\tshall be refunded to the petitioners concerned and if there is<br \/>\n\tassessment, the amount may be adjusted in accordance with law,<br \/>\n\twithout prejudice to the rights and contentions of the concerned<br \/>\n\tpetitioner to prefer an appeal, as may be permissible in law.\n<\/p>\n<p id=\"p_7\">The<br \/>\n\tpetition is allowed to the aforesaid extent. Rule made absolute<br \/>\n\taccordingly.
