NO. 100 OF 2000\n               = = = = = = = = = = = = = = =\n            Dated this the 4th day of June, 2010.\n\n                     J U D G M E N T\n<\/pre>\n<p id=\"p_1\">    This  appeal      is     preferred        against the<\/p>\n<p>judgment and decree of the First Additional<\/p>\n<p>Subordinate  Judge,        Thiruvananthapuram          in<\/p>\n<p>O.S.1148\/95.  The suit is one for realisation of<\/p>\n<p>the amount.  The court below granted a decree in<\/p>\n<p>favour of the plaintiff and it is against that<\/p>\n<p>decision the defendant has come up in appeal.<\/p>\n<p id=\"p_1\">    2.  Heard the learned counsel for both the<\/p>\n<p>sides.    The  brief      facts      necessary    for the<\/p>\n<p>disposal of the appeal are as stated as follows.<\/p>\n<p>It  is  the  case    of    the     plaintiff     that the<\/p>\n<p>defendant had borrowed a sum of Rs.47,000\/- and<\/p>\n<p>had issued a cheque later for Rs.47,000\/- which<\/p>\n<p>when presented for encashment returned with the<\/p>\n<p>endorsement    of      insufficiency           of   funds.<\/p>\n<p>Therefore he had sent a notice for which a reply<\/p>\n<p>A.S. 100 OF 2000<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                            -2-<\/span><\/p>\n<p>raising       false   contentions  had  been   sent.<\/p>\n<p>Therefore       the  suit  for  realisation of   the<\/p>\n<p>amount.\n<\/p>\n<p id=\"p_2\">       3.   The defendant on the other hand would<\/p>\n<p>contend he has no monetary transaction with the<\/p>\n<p>plaintiff and his son who married from another<\/p>\n<p>community was given protection by the plaintiff<\/p>\n<p>and the said son had taken some of the valuables<\/p>\n<p>and also a cheque and it had been utilized for<\/p>\n<p>the purpose of harming the defendant.         Or in<\/p>\n<p>other words the plaintiff is not entitled to any<\/p>\n<p>relief.\n<\/p>\n<p id=\"p_3\">        4. The defendant has not admitted the loan<\/p>\n<p>transaction.       The defendant had only admitted a<\/p>\n<p>signature       in  the  blank   cheque.   He   also<\/p>\n<p>complaints of theft of the cheque by his son.<\/p>\n<p>So if execution of the cheque is properly proved<\/p>\n<p>then most probably one may be able to draw the<\/p>\n<p>A.S. 100 OF 2000<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                           -3-<\/span><\/p>\n<p>presumption u\/Ss.138 and 139 of the N.I.Act that<\/p>\n<p>the cheque is issued towards the discharge of<\/p>\n<p>the liability.     There was an attempt made by the<\/p>\n<p>plaintiff to prosecute the defendant u\/s 138 but<\/p>\n<p>the said complaint has ended in acquittal u\/s<\/p>\n<p>256(1) <a href=\"\/doc\/445276\/\" id=\"a_1\">Cr.P.C<\/a>.     and further action has not been<\/p>\n<p>done on the same.      So in order to entitle the<\/p>\n<p>person to get a decree the transactions have to<\/p>\n<p>be proved and the two methodologies adopted are<\/p>\n<p>one is regarding the borrowl of the amount and<\/p>\n<p>the other is issuance of the cheque towards the<\/p>\n<p>discharge of the liability after six months.    So<\/p>\n<p>far     as    the advancement  of  the  amount  is<\/p>\n<p>concerned it is stated by the plaintiff that<\/p>\n<p>plaintiff and defendant are neighbours and along<\/p>\n<p>with PW2 the defendant came and wanted some<\/p>\n<p>amount during the festival season of Onam 1994.<\/p>\n<p>The amount was given after two days.      According<\/p>\n<p>A.S. 100 OF 2000<br \/>\n<span class=\"hidden_text\" id=\"span_2\">                           -4-<\/span><\/p>\n<p>to him he had also withdrawn money from his<\/p>\n<p>account as well as he had borrowed or taken<\/p>\n<p>money from his sister by way of a cheque and had<\/p>\n<p>encashed it and given it to the defendant. So it<\/p>\n<p>is alleged that there are convincing documents.<\/p>\n<p>It     should   have  been  produced  to  show   the<\/p>\n<p>truthfulness of the case of the plaintiff.       But<\/p>\n<p>strangely the plaintiff did not move his little<\/p>\n<p>finger to prove those aspects, most probably<\/p>\n<p>under the impression that the cheque would be<\/p>\n<p>sufficient to discharge his burden.<\/p>\n<p id=\"p_4\">       5.   The next is regarding the cheque.  I had<\/p>\n<p>perused the cheque and it is seen that the body<\/p>\n<p>is in one ink and the signature is with another<\/p>\n<p>ink.        The  defendant has  only   admitted  the<\/p>\n<p>signature in the blank cheque and that too not<\/p>\n<p>issued in favour of the plaintiff but had in his<\/p>\n<p>house which had been stolen away by the son.      So<\/p>\n<p>A.S. 100 OF 2000<br \/>\n<span class=\"hidden_text\" id=\"span_3\">                             -5-<\/span><\/p>\n<p>there     is    a   necessity   for  a  proper  proof<\/p>\n<p>regarding the execution of the cheque as well.<\/p>\n<p>The presumptions would arise only when documents<\/p>\n<p>are     proved.       I  think   the  materials  made<\/p>\n<p>available       are  not  sufficient  to  come  to a<\/p>\n<p>conclusion       positively  and   therefore  in  the<\/p>\n<p>interest of justice I am inclined to grant an<\/p>\n<p>opportunity        to   the   plaintiff   to   adduce<\/p>\n<p>additional evidence and if necessary produce<\/p>\n<p>additional        documents   in   support   of   his<\/p>\n<p>contention.       Needless to say, defendant can also<\/p>\n<p>have     rebuttable    evidence    and  documents  to<\/p>\n<p>substantiate       his  contentions.   Therefore  the<\/p>\n<p>judgment and decree of the trial court are set<\/p>\n<p>aside and the matter is remitted back to the<\/p>\n<p>trial court with a direction to       permit both the<\/p>\n<p>plaintiff and defendant to produce documentary<\/p>\n<p>as well as oral evidence in support of their<\/p>\n<p>A.S. 100 OF 2000<br \/>\n<span class=\"hidden_text\" id=\"span_4\">                            -6-<\/span><\/p>\n<p>respective contentions and then dispose of the<\/p>\n<p>matter in accordance with law.           The security<\/p>\n<p>furnished by the defendant shall remain in tact<\/p>\n<p>till a final decision is taken in the matter.<\/p>\n<p>Parties are directed to appear before the Court<\/p>\n<p>below on 20.7.2010.
