The alleged offence is under <a href=\"\/doc\/399026\/\" id=\"a_1\">Section 399<\/a> of Indian Penal<\/p>\n<p>Code. According to prosecution, five persons were found near a<\/p>\n<p>temple in suspicious circumstance and on questioning them, three<\/p>\n<p>of them ran away. Accused 1 to 3 were arrested from the spot.<\/p>\n<p>From their possession, chilly powder, gloves and knife were seized.<\/p>\n<p>Persons who ran away are accused 2, 3 and 5. Petitioner is the 5th<\/p>\n<p>accused. The incident happened on 18.5.2008.\n<\/p>\n<p id=\"p_2\">      3. Learned counsel for petitioner submitted that the local<\/p>\n<p>Circle Inspector of Police has been harassing the petitioner at the<\/p>\n<p>instance of a prominent financing group of the locality known as<\/p>\n<p>&#8220;Kallada Group&#8221;. Petitioner is residing in his house with his wife,<\/p>\n<p>children and his aged mother. His mother is a retired Headmistress.<\/p>\n<p>Petitioner&#8217;s father was a reputed businessman and he is no more.<\/p>\n<p>Petitioner&#8217;s wife is a teacher in a nearby school. Petitioner was<\/p>\n<p>working abroad for nine years and he started real-estate business,<\/p>\n<p>after coming back to India. He is also engaged in private money<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">   BA.4369\/08                        2<\/span><\/p>\n<p>lending business. He lends money at lesser rate of interest than<\/p>\n<p>what was received by the other financing group in the locality. On<\/p>\n<p>several     occasions the henchmen of the financing company<\/p>\n<p>demanded the petitioner to stop the business and threatened the<\/p>\n<p>petitioner with dire consequences. But the petitioner continued to<\/p>\n<p>do the business and it provoked the &#8220;Kallada Group&#8221; and they<\/p>\n<p>influenced the Circle Inspector, who insisted to wind up his<\/p>\n<p>business and he was threatened that he would be taught a lesson.<\/p>\n<p id=\"p_3\">      4. It is further submitted that the petitioner was also falsely<\/p>\n<p>implicated in a series of cases under <a href=\"\/doc\/1784492\/\" id=\"a_1\">Section 402<\/a> IPC, <a href=\"\/doc\/724142\/\" id=\"a_2\">Section 324<\/a><\/p>\n<p>IPC etc. In an offence committed in the temple premises,<\/p>\n<p>petitioner&#8217;s name was also included deliberately but it was<\/p>\n<p>subsequently compounded before the Lok Adalath. The petitioner is<\/p>\n<p>not able to peacefully live in the locality because of the harassment<\/p>\n<p>of the Circle Inspector, who is falsely implicating the petitioner in<\/p>\n<p>various crimes, it is submitted.\n<\/p>\n<p id=\"p_4\">      5. The petitioner&#8217;s mother filed a complaint, Annexure A2,<\/p>\n<p>before the Superintendent of Police on 5.4.2008, narrating the<\/p>\n<p>alleged harassment from the police at the instance of the Circle<\/p>\n<p>Inspector. Annexure A3 is the another complaint filed against police<\/p>\n<p>harassment before the Superintendent of Police on 17.4.2008 by<\/p>\n<p>the petitioner&#8217;s mother. On 21.5.2008 also, two days after the<\/p>\n<p>alleged incident in this case, she lodged a complaint before the<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">   BA.4369\/08                       3<\/span><\/p>\n<p>Superintendent of Police and the copy of the same is Annexure A4.<\/p>\n<p>It is specifically stated therein that on the date on which the<\/p>\n<p>incident is allegedly occurred, the petitioner was very much present<\/p>\n<p>in the house, since there was a dinner in connection with the arrival<\/p>\n<p>of the petitioner&#8217;s elder brother from Gulf on that day. Throughout<\/p>\n<p>the day, the petitioner was resent in the house but there was an<\/p>\n<p>attempt to falsely implicate the petitioner in the present crime.<\/p>\n<p id=\"p_5\">      6. Learned counsel for petitioner submitted that petitioner is<\/p>\n<p>only the victim of the animosity of a financing group and false cases<\/p>\n<p>are registered against him by influencing the Circle Inspector of<\/p>\n<p>Police.   Petitioner was not even present at the scene and the<\/p>\n<p>petitioner was not arrested also. In case he is arrested, it is likely<\/p>\n<p>that he will be tortured at the police station. It is also submitted<\/p>\n<p>that after filing the first complaint, Annexure A2, signed blank<\/p>\n<p>papers were obtained from the petitioner&#8217;s mother, who was<\/p>\n<p>approached by the Circle Inspector for compelling her to withdraw<\/p>\n<p>the earlier complaint. These facts are stated in Annexure A3.<\/p>\n<p id=\"p_6\">      7. This petition is opposed. Learned Public Prosecutor<\/p>\n<p>submitted that the allegations made are all incorrect and no<\/p>\n<p>complaints are received against the Circle Inspector of Police.<\/p>\n<p>Learned Public Prosecutor submitted that this is not a case where<\/p>\n<p>anticipatory bail can be granted. It may not be proper to exercise<\/p>\n<p>the jurisdiction under <a href=\"\/doc\/1783708\/\" id=\"a_3\">Section 438<\/a> Cr.P.C., it is submitted. But the<\/p>\n<p><span class=\"hidden_text\" id=\"span_2\">   BA.4369\/08                         4<\/span><\/p>\n<p>learned counsel for petitioner produced for perusal a receipt to<\/p>\n<p>show that Annexure A4 was received by the Superintendent of<\/p>\n<p>Police on 21.5.2008. In Annexure A4, a reference is made regarding<\/p>\n<p>the complaints given by the petitioner to the Superintendent of<\/p>\n<p>Police on 5.4.2008 and 17.4.2008 also (Annexures A2 and A3).<\/p>\n<p id=\"p_7\">      8. On hearing both sides and going through the documents<\/p>\n<p>produced in this case, I am satisfied that on the facts of this case,<\/p>\n<p>the failure to grant anticipatory bail will result in serious harm and<\/p>\n<p>injury to the petitioner.
