Justice P.Q.BARKATH ALI\n\n Dated :21\/05\/2009\n\n O R D E R\n          PIUS.C.KURIAKOSE &amp; P.Q.BARKATH ALI, JJ.\n                       ------------------------\n                   W.P.(C).No.13878 OF 2009\n                       ------------------------\n\n               Dated this the 21st day of May, 2009\n\n                             JUDGMENT\n<\/pre>\n<p id=\"p_1\">Pius C.Kuriakose, J.\n<\/p>\n<p id=\"p_1\">      In this writ petition under <a href=\"\/doc\/1331149\/\" id=\"a_1\">Article 227<\/a>, the petitioner tenant<\/p>\n<p>impugns order passed by the Rent Control Court, Tirur in I.A.<\/p>\n<p>No.706\/1999 in R.C.P. No.24\/2008. Neither a certified copy nor<\/p>\n<p>even a true copy is made available.           But, it is seen from<\/p>\n<p>documents Exts.P1 to P6 produced by the petitioner that the<\/p>\n<p>impugned order was passed by the Rent Control Court on an<\/p>\n<p>application filed by the petitioner to set aside the ex-parte order<\/p>\n<p>of eviction passed against him.      It is conceded that the above<\/p>\n<p>order was passed when the petitioner tenant failed to appear<\/p>\n<p>before the court on the day the case was special listed for trial.<\/p>\n<p>The ground raised by him in the application was that he was laid<\/p>\n<p>up and was being treated by a particular doctor.          A medical<\/p>\n<p>certificate issued by the said doctor was also produced. To the<\/p>\n<p>application, Ext.P6 objection      contending inter alia that the<\/p>\n<p>petitioner&#8217;s case of having been laid up is not correct and that he<\/p>\n<p>was actually carrying on business on the day the ex parte order<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">WPC.No.13878\/2009                 2<\/span><\/p>\n<p>was passed was filed. Admittedly, the petitioner did not adduce<\/p>\n<p>any evidence, which means that there was no evidence to<\/p>\n<p>substantiate the petitioner&#8217;s case that he was laid up. The doctor<\/p>\n<p>was     not examined.          The learned Rent Control Court<\/p>\n<p>nevertheless allowed the application, imposing a condition that a<\/p>\n<p>sum of Rs.5,000\/- should be paid on or before 22\/5\/2009. It is<\/p>\n<p>conceded that the petitioner is carrying on business in the<\/p>\n<p>building in question.     It is also conceded that the monthly<\/p>\n<p>contract rent of the building is Rs.1,350\/-.<\/p>\n<p id=\"p_2\">      2.  Sri.C.M.Mohammed        Iquabal learned counsel for the<\/p>\n<p>petitioner would submit that the amount fixed by the court by<\/p>\n<p>way of cost payable is exorbitant. We cannot agree. At any rate<\/p>\n<p>we are of the view that the visitorial jurisdiction of this under<\/p>\n<p><a href=\"\/doc\/1331149\/\" id=\"a_1\">Article 227<\/a> is not be invoked to correct orders passed by the Rent<\/p>\n<p>Control Court in exercise of discretion vested in it under law.<\/p>\n<p>However, having regard to the appealing submissions of Sri.<\/p>\n<p>Mohammed Equabal regarding the financial constraint of client,<\/p>\n<p>even as we dismiss the writ petition, we direct the Rent Control<\/p>\n<p>Court to permit the petitioner     to remit the sum of Rs.5,000\/-<\/p>\n<p>ordered as payable by way of cost in two equal monthly<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">WPC.No.13878\/2009                 3<\/span><\/p>\n<p>instalment of Rs.2,500\/- payable on 22\/5\/1999 and on or before<\/p>\n<p>22\/6\/2009.\n<\/p>\n<p id=\"p_3\">      The writ petition is disposed of as above.\n<\/p>\n<p id=\"p_4\">\n<p id=\"p_5\">                                    PIUS C.KURIAKOSE,JUDGE<\/p>\n<p>                                       P.Q.BARKATH ALI, JUDGE<br \/>\ndpk<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Pokkatt Musthafa vs Palakkal Kadeeja on 21 May, 2009 IN THE HIGH COURT OF KERALA AT ERNAKULAM WP(C).No. 13878 of 2009(D) 1.
