The doctor<br \/>\nhas advised her angiography.\n<\/p>\n<p id=\"p_3\">3.\tIn<br \/>\nthe communication it is mentioned that the doctor has not given any<br \/>\nspecific date for angiography and wife of the convict is not admitted<br \/>\nin the hospital.\n<\/p>\n<p id=\"p_4\">That<br \/>\nis not the averment either in the application or in any manner.  That<br \/>\nis why there is no question of the said aspect having been<br \/>\nhighlighted in the communication.  The very fact that the convict&#8217;s<br \/>\nwife has taken treatment as an out-door patient from the doctor and<br \/>\nthe doctor has advised her angiography made the convict to apply for<br \/>\ntemporary bail for 45 so as to make available required treatment to<br \/>\nhis ailing wife.\n<\/p>\n<p id=\"p_5\">4.\tThe<br \/>\napplicant- appellant- original accused has been convicted for the<br \/>\noffences punishable under <a href=\"\/doc\/1560742\/\" id=\"a_1\">sections 302<\/a>, <a href=\"\/doc\/1096965\/\" id=\"a_1\">143<\/a>, <a href=\"\/doc\/1258372\/\" id=\"a_2\">147<\/a>, <a href=\"\/doc\/763672\/\" id=\"a_3\">148<\/a>, <a href=\"\/doc\/999134\/\" id=\"a_4\">149<\/a>, <a href=\"\/doc\/1011035\/\" id=\"a_5\">323<\/a>,<br \/>\n<a href=\"\/doc\/455873\/\" id=\"a_6\">206(2)<\/a> of the IPC and section 135 of the Bombay Police Act to suffer<br \/>\nimprisonment for life with fine of Rs.6900\/-, in default to further<br \/>\nundergo imprisonment for 1 year, 4 months and 22 days as awarded by<br \/>\nthe learned Additional Sessions Judge, Court No.2, Mehsana vide<br \/>\njudgement dated 20th September 2010 in Sessions Case No. 6<br \/>\nof 2010.\n<\/p>\n<p id=\"p_6\">5.\tThe learned<br \/>\nAPP has invited attention of the Court to the Jail remarks.   The<br \/>\nconvict has undergone  1 year, 6 months and 5 days in Jail as on<br \/>\n16.04.2011.  The convict had availed temporary bail once.\n<\/p>\n<p id=\"p_7\">6.\tIn the<br \/>\nresult, this application is allowed. The convict is ordered to be<br \/>\nreleased on  temporary bail for a period of 30  (thirty)<br \/>\ndays from the date of his release on his executing a personal<br \/>\nbond of Rs.5000\/- (Rupees five thousand only) to the satisfaction of<br \/>\nthe Jail authorities.\n<\/p>\n<p id=\"p_8\">7.\tThe<br \/>\napplicant shall surrender himself to the Jail authorities on expiry<br \/>\nof the above temporary bail period.\tThe application is allowed.
