State respondent<\/p>\n<p>The present 482 <a href=\"\/doc\/445276\/\" id=\"a_1\">Cr.P.C<\/a>. petition has been filed for quashing the Non-bailable<br \/>\nwarrant against the applicants in case crime no. 56 of 2003 under section 2\/3<br \/>\nof U.P. Gangster and Anti Social Activities(Prevention ) Act, 1986 P.S.<br \/>\nTundla, District Firozabad.\n<\/p>\n<p id=\"p_1\">The contention of the counsel for the applicants is that no offence against the<br \/>\napplicants is disclosed and the present prosecution has been instituted with a<br \/>\nmalafide intention for the purposes of harassment. He pointed out certain<br \/>\ndocuments and statements in support of his contention. It is further contended<br \/>\nthat applicants are resident of Bihar.\n<\/p>\n<p id=\"p_2\">From the perusal of the material on record and looking into the facts of the<br \/>\ncase at this stage it cannot be said no offence is made out against the<br \/>\napplicants. All the submission made at the bar relates to the disputed question<br \/>\nof fact, which cannot be adjudicated upon by this Court under <a href=\"\/doc\/1679850\/\" id=\"a_1\">Section 482<\/a><br \/>\nCr.P.C. At this stage only prima facie case it to be seen.\n<\/p>\n<p id=\"p_3\">The prayer for quashing the non bailable warrant order is refused.\n<\/p>\n<p id=\"p_4\">However, it is provided that if the applicants appear and surrender before the<br \/>\ncourt below within 60 days from today and apply for bail, then their prayer for<br \/>\nbail shall be considered in view of the settled law laid by the Seven Judges&#8217;<br \/>\ndecision of this Court in the case of Amrawati and another Vs. State of U.P.<br \/>\nreported in 2004 (57) ALR 290 as well as judgement passed by Hon&#8217;ble Apex<br \/>\nCourt reported in 2009 (3) ADJ 322 (SC) Lal Kamlendra Pratap Singh Vs.<br \/>\nState of U.P. For a period of 60 days from today or till the disposal of the<br \/>\napplication for grant of bail whichever is earlier, no coercive action shall be<br \/>\ntaken against the applicants.
