RAMKUMAR, J.\n\n                            - - - - - - - - - - - - - - - - -\n\n                  BAIL APPLICATION NO. 915  OF 2007\n\n               - - - - - - - - - ----------------------- - - - - - -\n\n             DATED THIS THE 19th DAY OF FEBRUARY, 2007\n\n\n                                      O R D E R\n<\/pre>\n<p id=\"p_1\">       Petitioner   who   is   the   3rd  accused   in   Crime   No.360\/06   of<\/p>\n<p>Vattappara Police Station for offences punishable under sections 109,<\/p>\n<p>120B,   212,   449,   427,   307   and   302   read   with   <a href=\"\/doc\/37788\/\" id=\"a_1\">section   34<\/a>   IPC   and<\/p>\n<p><a href=\"\/doc\/244673\/\" id=\"a_1\">section 27<\/a> of the Arms Act, 1959 seeks anticipatory bail.<\/p>\n<p id=\"p_1\">       2.     Learned   Public   Prosecutor   opposed   the   application<\/p>\n<p>submitting, inter alia, that accused 1 to 7 including the petitioner had<\/p>\n<p>trespassed into the house of the deceased and had attacked him with<\/p>\n<p>sword and other deadly weapons resulting in his death.<\/p>\n<p id=\"p_2\">       3.     It is too early to accept the petitioner&#8217;s contention that he<\/p>\n<p>had   only   given   a   lift   in   his   vehicle   to   the   second   accused   without<\/p>\n<p>knowing   about   his   complicity   in   the   occurrence   and   that   the<\/p>\n<p>petitioner&#8217;s mother was hospitalised during the said period.<\/p>\n<p id=\"p_3\">       4.     Anticipatory bail cannot be granted in a case of this nature.<\/p>\n<p>There is no reason why the petitioner should not surrender before the<\/p>\n<p>Investigating Officer for interrogation and seek regular bail thereafter.<\/p>\n<p>Accordingly,   the   petitioner   is   directed   to   surrender   before   the<\/p>\n<p>Investigating Officer on any day between 22.2.2007 and 24.2.2007 for<\/p>\n<p>the   purpose   of   interrogation.     The   petitioner   shall   thereafter   be<\/p>\n<p>BA.915\/07<\/p>\n<p>                                       Page numbers<\/p>\n<p>produced   before   the   Magistrate   concerned   on   the   same   day.
