JUSTICE HARBANS LAL\n\nPresent:-   Mr. Rahul Chhatwal, Advocate for the applicant.\n\n            Mr. Raman Mohinder, Advocate for the respondents.\n                        ****\nJUDGMENT\n<\/pre>\n<p id=\"p_1\">HARBANS LAL, J.\n<\/p>\n<p id=\"p_1\">            This application has been moved by Malkiat Singh under<\/p>\n<p>Section 378(4) read with <a href=\"\/doc\/1679850\/\" id=\"a_1\">Section 482<\/a> of Cr.P.C for grant of permission to<\/p>\n<p>file the appeal against judgment dated 20.2.2007 passed by the Court of<\/p>\n<p>learned Special Judge, Faridkot, whereby he dismissed the complaint<\/p>\n<p>bearing caption `<a href=\"\/doc\/333299\/\" id=\"a_1\">State v. Nachatar Singh and another<\/a>.&#8217;<\/p>\n<p>            The facts in brief are that Malkiat Singh complainant belongs to<\/p>\n<p>a scheduled caste. There is a passage adjoining his house. The accused<\/p>\n<p>have tried to decrease such passage by emerging the same with their own<\/p>\n<p>land. On 24.11.2001, various respected persons from his village gathered in<\/p>\n<p>his house in order to request the accused to decrease the passage. When<\/p>\n<p>they were discussing the matter, meanwhile, the accused reached there.<\/p>\n<p>Nachattar Singh accused was empty handed. Charanjit Singh accused was<\/p>\n<p>armed with gandasa. They both started abusing the complainant and tried to<\/p>\n<p>beat him. The respectables who had already massed there saved him from<br \/>\n<span class=\"hidden_text\" id=\"span_1\"> Criminal Misc. No.422-MA of 2007                               -2-<\/span><\/p>\n<p>the accused. The accused Charanjit Singh has said to the complainant<\/p>\n<p>&#8220;katya chuharia we will teach you a lesson for not allowing them to cut the<\/p>\n<p>passage as we would get the persons like you out of the village and no body<\/p>\n<p>can cause any harm to us.&#8221; When he requested the accused to desist from<\/p>\n<p>uttering such derogatory words then the accused again said &#8220;if we should<\/p>\n<p>not say you kutta chuhra, what we would say you, you are spoiling our<\/p>\n<p>sacred and smell is coming out of you.&#8221; The accused by entering into his<\/p>\n<p>house had humiliated the complainant by uttering these words to a great<\/p>\n<p>extent. The matter was reported to the Police Station Sadiq, but of no avail.<\/p>\n<p>The accused were charged under <a href=\"\/doc\/42436223\/\" id=\"a_2\">Section 3(X)<\/a> of the Scheduled Castes and<\/p>\n<p><a href=\"\/doc\/25085007\/\" id=\"a_3\">Scheduled Tribes (Prevention of Atrocities) Act<\/a>, 1989 and 452 of <a href=\"\/doc\/1569253\/\" id=\"a_4\">IPC<\/a> to<\/p>\n<p>which they did not plead guilty and claimed trial. To bring home guilt<\/p>\n<p>against the accused, the complainant examined his wife Gurjit Kaur PW2,<\/p>\n<p>Veer Singh PW3 in addition to his own statement as PW1. On close of the<\/p>\n<p>prosecution evidence, when examined under <a href=\"\/doc\/767287\/\" id=\"a_5\">Section 313<\/a> of Cr.P.C, the<\/p>\n<p>accused denied all the incriminating circumstances appearing in the<\/p>\n<p>prosecution evidence against them and pleaded innocence. They put forth<\/p>\n<p>that the complainant has illegally encroached the public street and they were<\/p>\n<p>stopping him from doing so. So, he filed this case against them. In their<\/p>\n<p>defence, they examined DW1 Daljit Singh and DW2 Gurmail Kaur. After<\/p>\n<p>hearing the learned counsel for the complainant, the learned Additional<\/p>\n<p>Public Prosecutor for the State, the learned defence counsel and examining<\/p>\n<p>the evidence on record, the learned trial Court dismissed the complaint.<\/p>\n<p>Feeling aggrieved therewith, he has moved this application for grant of<\/p>\n<p>leave to appeal against the judgment dated 20.2.2007.\n<\/p>\n<p id=\"p_2\">            I have heard the learned counsel for the parties, besides<br \/>\n<span class=\"hidden_text\" id=\"span_1\"> Criminal Misc. No.422-MA of 2007                                -3-<\/span><\/p>\n<p>perusing the record with due care and circumspection.\n<\/p>\n<p id=\"p_3\">            There is a delay of as many as 5 days in lodging the complaint.<\/p>\n<p>Such delay has not been explained by the prosecution. Gurjit Kaur PW2<\/p>\n<p>wife of the complainant was bound to toe line with her husband. The<\/p>\n<p>learned trial Court has observed that &#8220;this is admitted fact between the<\/p>\n<p>parties that there is a dispute of passage between the parties and this passage<\/p>\n<p>is situated in front of the house of the witnesses and the said passage is<\/p>\n<p>owned by the accused and the complainant wants to encroach upon this<\/p>\n<p>passage, which the accused persons do not allow.&#8221; In view of such a<\/p>\n<p>situation, it is very difficult to assume the taking place of the alleged<\/p>\n<p>occurrence. May be that, to exert pressure upon the accused party, the<\/p>\n<p>complaint was filed. It is also observed by the learned trial Court that the<\/p>\n<p>statements of the examined prosecution witnesses are full of discrepancies<\/p>\n<p>and are inconsistent and they all are interested witnesses. DW1 Daljit<\/p>\n<p>Singh, the then Sarpanch as well as DW2 Gurmail Kaur, the Member<\/p>\n<p>Panchayat are in unison on the point that the alleged occurrence did not take<\/p>\n<p>place. The learned trial Court has observed that &#8220;it is proved on the record<\/p>\n<p>that on 21.10.2000, the meeting of the Gram Panchayat was convened in<\/p>\n<p>which the matter was settled between the parties and that out of grudge<\/p>\n<p>because of the above said passage, the present complaint has been filed.&#8221;<\/p>\n<p>To my mind, palpably, no contrary view can be taken to these observations.<\/p>\n<p>Consequently, no case is made out for grant of leave to appeal against the<\/p>\n<p>judgment dated 20.2.2007.
