DAVE\n\t\t\n\t\n\n \n\nDate\n: 07\/07\/2011 \n\n \n\n \nORAL\nORDER<\/pre>\n<p id=\"p_1\">This<br \/>\n\tapplication is filed under <a href=\"\/doc\/1290514\/\" id=\"a_1\">Section 439<\/a> of the Code of Criminal<br \/>\n\tProcedure in connection with First Information Report registered as<br \/>\n\tI-C.R. No.66\/2010 with Prantij Police Station, Sabarkantha for the<br \/>\n\toffences punishable u\/s. 394, 427 and 114<a href=\"\/doc\/1569253\/\" id=\"a_1\"> of the Indian Penal Code<\/a> &amp;<br \/>\n\tu\/s. 135 of the Bombay Police Act.\n<\/p>\n<p id=\"p_1\">Learned<br \/>\n\tCounsel appearing for the applicant submits that charge-sheet<br \/>\n\tis filed and considering the punishment prescribed and that it is a<br \/>\n\tmagistrate triable case, the applicant may be enlarged on<br \/>\n\tbail.\n<\/p>\n<p id=\"p_2\">Heard<br \/>\n\tlearned APP Mrs. Manisha L. Shah for the respondent-State.\n<\/p>\n<p id=\"p_3\">Having<br \/>\n\theard learned Counsels for the parties and perusing the record of<br \/>\n\tthe case and taking into consideration the facts of the case, nature<br \/>\n\tof allegations, role attributed to the applicant, by imposing<br \/>\n\tsuitable conditions, I deem it just and proper to enlarge the<br \/>\n\tapplicant on bail.\n<\/p>\n<p id=\"p_4\">Learned<br \/>\n\tCounsels for the parties do not press for further reasoned order.\n<\/p>\n<p id=\"p_5\">In<br \/>\n\tthe facts and circumstances of the case, the application is allowed<br \/>\n\tand the applicant is ordered to be released on bail in connection<br \/>\n\twith First Information Report registered as I-C.R. No.66\/2010 with<br \/>\n\tPrantij Police Station, Sabarkantha, on executing a bond of<br \/>\n\tRs.5,000\/- (Rupees Five Thousand Only) with one surety of the like<br \/>\n\tamount to the satisfaction of the Trial Court and subject to the<br \/>\n\tconditions that he shall;\n<\/p>\n<p id=\"p_6\">a) not take undue advantage of liberty<br \/>\n\tor misuse liberty;\n<\/p>\n<p id=\"p_7\">b) not act in a manner injurious to<br \/>\n\tthe interest of the prosecution;\n<\/p>\n<p id=\"p_8\">c) surrender his passport, if any, to<br \/>\n\tthe lower court within a week;\n<\/p>\n<p id=\"p_9\">d) not leave the State of Gujarat<br \/>\n\twithout prior permission of the Sessions Judge concerned;\n<\/p>\n<p id=\"p_10\">e) mark or before the concerned Police<br \/>\n\tStation on every 1st and 15th day of every<br \/>\n\tEnglish Calendar month between 11.00 a.m. to 2.00 p.m. for three<br \/>\n\tmonths only;\n<\/p>\n<p id=\"p_11\">f) furnish the present address of his<br \/>\n\tresidence to the Investigating Officer and also to the Court at the<br \/>\n\ttime of execution of the bond and shall not change the residence<br \/>\n\twithout prior permission of this Court;\n<\/p>\n<p id=\"p_12\">g) not enter within the City and<br \/>\n\tDistrict limits of Himmatnagar for three months, except, for the<br \/>\n\tpurpose of attending the trial or marking presence.\n<\/p>\n<p id=\"p_13\">The<br \/>\n\tauthorities will release the applicant only if not required in<br \/>\n\tconnection with any other offence for the time being.\n<\/p>\n<p id=\"p_14\">If<br \/>\n\tbreach of any of the above conditions is committed, the Sessions<br \/>\n\tJudge concerned will be free to issue warrant or take appropriate<br \/>\n\taction in the matter.\n<\/p>\n<p id=\"p_15\">Bail<br \/>\n\tbond to be executed before the lower court having jurisdiction to<br \/>\n\ttry the case.\n<\/p>\n<p id=\"p_16\">At<br \/>\n\tthe trial, the Trial Court shall not be influenced by the<br \/>\n\tobservations of preliminary nature, qua the evidence at this stage,<br \/>\n\tmade by this Court while enlarging the applicant on bail.\n<\/p>\n<p id=\"p_17\">Rule<br \/>\n\tmade absolute.
