Interlocutory Application No. 7199 of 2010:\n<\/p>\n<blockquote id=\"blockquote_1\"><p>                                  Though served the respondent no. 7 has not<br \/>\n                      entered appearance.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_1\"><p>                                   This application under <a href=\"\/doc\/100581\/\" id=\"a_1\">Section 5<\/a> of the<br \/>\n                      Limitation Act has been filed by the appellant for<br \/>\n                      condonation of delay of 37 days occurred in filing the<br \/>\n                      Letters Patent Appeal.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_2\"><p>                                   On the facts and in the circumstances of the<br \/>\n                      case, the delay is condoned.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_3\"><p>                                  Interlocutory Application stands disposed of.\n<\/p><\/blockquote>\n<p><span class=\"hidden_text\" id=\"span_1\">                -2-<\/span><\/p>\n<p id=\"p_2\">Letters Patent Appeal No. 1272 of 2010:-\n<\/p>\n<p id=\"p_3\">            The appellant, a Middle School Teacher, has<br \/>\npreferred this appeal under Clause X of the Letters<br \/>\nPatent to challenge the judgment and order dated 10th<br \/>\nMay 2010 passed by the learned single Judge in above<br \/>\nC.W.J.C. No. 219 of 2010.\n<\/p>\n<p id=\"p_4\">            The service of the appellant as teacher in the<br \/>\nmiddle school run and managed by the respondent no.7<br \/>\nhas been terminated under communication dated 14th<br \/>\nOctober 2009 with effect from 21st March 2008. The<br \/>\nchallenge to the said order before the learned single<br \/>\nJudge has failed. Therefore, the present appeal.\n<\/p>\n<p id=\"p_5\">            Learned Advocate Mr. Subodh Kumar Jha<br \/>\nhas appeared for the appellant. He has submitted that the<br \/>\nimpugned order is ex facie bad in so far as the service of<br \/>\nthe appellant has been terminated with retrospective<br \/>\neffect. He has also submitted that the decision to<br \/>\nterminate the service of the appellant was taken on 22nd<br \/>\nMarch 2009, long before the date of communication<br \/>\ndated 14th October 2009. On that ground alone the<br \/>\nimpugned order is required to be set aside. In support of<br \/>\nhis argument he has relied upon the judgment of the<br \/>\nHon&#8217;ble Supreme Court in the matter of <a href=\"\/doc\/1018127\/\" id=\"a_1\">H.L.Trehan v.<br \/>\nUnion of India<\/a>, (1989) 1 SCC 764.\n<\/p>\n<p id=\"p_6\">            In the above referred judgment the Hon&#8217;ble<br \/>\nSupreme Court has deprecated the practice of post<br \/>\ndecision hearing. Present is not a case of post decision<br \/>\nhearing. The said judgment, therefore, does not apply to<br \/>\nthe facts of the present case.\n<\/p>\n<p id=\"p_7\">            The appellant possesses the educational<br \/>\nqualification of passing 12th standard examination. By<br \/>\norder dated 3rd January 2000 she was temporarily<br \/>\nappointed as teacher in the middle school run and<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                            -3-<\/span><\/p>\n<p>          managed by the respondent no.7. Since the month of<br \/>\n          March 2008 she remained absent from duty without<br \/>\n          leave continuously till the date of the order. It is apparent<br \/>\n          that the appellant was given show cause notice on 27th<br \/>\n          February 2009 and a reminder on 6th April 2009. She did<br \/>\n          not respond to the either. In absence of any explanation<br \/>\n          by the appellant pursuant to the resolution dated 22nd<br \/>\n          March 2009 passed by the managing committee the<br \/>\n          appellant&#8217;s service was terminated with effect from 21st<br \/>\n          March 2008, the date since which the appellant was<br \/>\n          absent from service.\n<\/p>\n<p id=\"p_8\">                      We see no irregularity in the procedure<br \/>\n          adopted by the respondent no.7, the management. The<br \/>\n          resolution dated 22nd March 2009 was passed after the<br \/>\n          appellant failed to respond to the notice dated 27th<br \/>\n          February 2009. In spite of the resolution dated 22nd<br \/>\n          March 2009, the respondent no. 7 gave one more<br \/>\n          opportunity to the appellant by sending a reminder on 6th<br \/>\n          April 2009. The impugned order was made more than six<br \/>\n          months thereafter. Thus, the appellant was given<br \/>\n          adequate opportunity.\n<\/p>\n<p id=\"p_9\">                      In above view of the matter, we are of the<br \/>\n          opinion that the learned single Judge has rightly rejected<br \/>\n          writ petition.\n<\/p>\n<p id=\"p_10\">                      No case for interference is made out. The<br \/>\n          Appeal is dismissed in limine.\n<\/p>\n<p id=\"p_11\">                                 (R.M.
