Respondents\n                                  ----------------------------------\n<\/pre>\n<p id=\"p_1\">02\/   25.08.2011              Heard    learned     counsel   for   the<\/p>\n<p>                   petitioner, Sri Anjani Kumar, AAG-10 for the<\/p>\n<p>                   State, who has prayed for time to file counter<\/p>\n<p>                   affidavit, but considering the fact that this writ<\/p>\n<p>                   petition was filed on 22.2.2007 after serving a<\/p>\n<p>                   copy thereof on the establishment of the<\/p>\n<p>                   Advocate General, but during the period of over<\/p>\n<p>                   four years, no counter affidavit has been filed, I<\/p>\n<p>                   am not inclined to grant any further time for<\/p>\n<p>                   filing the counter affidavit.\n<\/p>\n<p id=\"p_1\">                              2. At the time of filing of this writ<\/p>\n<p>                   petition, petitioner served on the post of Junior<\/p>\n<p>                   Engineer (Mechanical) in the Water Resources<\/p>\n<p>                   Department of the State Government. He has<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                     2<\/span><\/p>\n<p>filed this writ petition praying, inter alia, to direct<\/p>\n<p>the State respondents to grant the petitioner<\/p>\n<p>seniority in the grade of Junior Engineer with<\/p>\n<p>effect from 1.1.1971, the date on which he was<\/p>\n<p>appointed as Overseer in the work charge<\/p>\n<p>establishment of Tenughat Dam Circle No.1,<\/p>\n<p>District Hazaribagh under office order bearing<\/p>\n<p>Memo No. 169 dated 23.1.1971, Annexure-1. In<\/p>\n<p>this connection, it is pointed out that services of<\/p>\n<p>the petitioner was regularized on the post of<\/p>\n<p>Junior Engineer Civil (Mechanical) in the<\/p>\n<p>Irrigation and Electricity Department of the State<\/p>\n<p>under office order bearing Memo No. 217 dated<\/p>\n<p>24.1.1979,Annexure-3.\n<\/p>\n<p id=\"p_2\">           3.   It is submitted on behalf of the<\/p>\n<p>petitioner that once the services of the petitioner<\/p>\n<p>and others was regularized on the post of Junior<\/p>\n<p>Engineer (Mechanical), they are required to be<\/p>\n<p>given seniority in the grade of Junior Engineer<\/p>\n<p>with effect from the date of their appointment in<\/p>\n<p>the   work      charge    establishment.     In    this<\/p>\n<p>connection, it is also pointed out that two of the<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                   3<\/span><\/p>\n<p>junior colleagues of the petitioner, M\/s Vijay<\/p>\n<p>Kishore Prasad and Kedar Nath Singh have been<\/p>\n<p>granted seniority in the grade of Junior Engineer<\/p>\n<p>(Mechanical) with effect from 19.3.1971, the<\/p>\n<p>date on which they were appointed in the work<\/p>\n<p>charge establishment on the post of Junior<\/p>\n<p>Engineer. Reference in this connection is made<\/p>\n<p>to the order bearing Memo No.6742 dated<\/p>\n<p>3.5.1975, Annexure-2 to this petition. During the<\/p>\n<p>pendency of the writ petition, petitioner has<\/p>\n<p>superannuated in October, 2009.\n<\/p>\n<p id=\"p_3\">          4.    Having heard counsel for the<\/p>\n<p>parties, in view of the facts noted above, I direct<\/p>\n<p>the State-respondents to consider the case of the<\/p>\n<p>petitioner for grant of seniority in the grade of<\/p>\n<p>Junior Engineer (Mechanical) with effect from<\/p>\n<p>1.1.1971, the date on which he was appointed as<\/p>\n<p>Overseer in the work charge establishment of the<\/p>\n<p>Tenughat Dam Circle No.1.\n<\/p>\n<p id=\"p_4\">          5.      Necessary     consideration    in<\/p>\n<p>compliance of my order be made by the<\/p>\n<p>Engineer-in-Chief of the       Water Resources<br \/>\n<span class=\"hidden_text\" id=\"span_2\">                           4<\/span><\/p>\n<p>         Department as early as possible, in any case<\/p>\n<p>         within two months from the date of receipt\/<\/p>\n<p>         production of a copy of this order before the<\/p>\n<p>         Engineer-in-Chief.\n<\/p>\n<p id=\"p_5\">                   6.
