From the grounds of detention, it<br \/>\nappears that two offences being Prohibition CR Nos.232 of 2009 and<br \/>\n712 of 2009 have been registered against the detenue.  Both the<br \/>\noffences have been registered with Pradhumannagar Police Station and<br \/>\nThorala Police Station of Rajkot City respectively under the<br \/>\nprovisions of Sections 66-B, 65AE, 116B and  81  of the Bombay<br \/>\nProhibition Act, wherein total quantity of 108 bottles of foreign<br \/>\nliquor was found from the possession of the detenue. On the basis of<br \/>\nregistration of these cases, the detaining authority held that the<br \/>\npresent detenue was carrying on activities of selling liquor which is<br \/>\nharmful to the health of the public. It is held by the detaining<br \/>\nauthority that as the detenue is indulged in illegal activities, it<br \/>\nis required to restrain the detenue from carrying out further illegal<br \/>\nactivities, i.e. selling of liquor. The detaining authority has<br \/>\nplaced reliance on the above registered offences and statements of<br \/>\nunnamed witnesses.  In the opinion of this Court, the activities of<br \/>\nthe detenue can, by no stretch of imagination, be said to be<br \/>\ndisturbing the  public order.  It is seen from the grounds of<br \/>\ndetention that a general statement that has been made by the<br \/>\ndetaining authority that consuming liquor is injurious to health.  In<br \/>\nfact, a perusal of the order passed by the detaining authority shows<br \/>\nthat the grounds which  are mentioned in the order are in reference<br \/>\nto the situation of  law and order  and not  public order .<br \/>\nTherefore, on this ground, the subjective satisfaction arrived at by<br \/>\nthe detaining authority is vitiated on account of non-application of<br \/>\nmind and the impugned order, therefore, deserves to be quashed and<br \/>\nset aside.\n<\/p>\n<p id=\"p_3\">4.\t\tExcept<br \/>\nthe statements of some anonymous witnesses, there is no material on<br \/>\nrecord which shows that the petitioner-detenue is carrying on<br \/>\nactivities of selling liquor which is harmful to the health of the<br \/>\npublic. In the case of <a href=\"\/doc\/687998\/\" id=\"a_1\">Ashokbhai Jivraj @ Jivabhai Solanki v.<br \/>\nPolice Commissioner, Surat<\/a> [(2001)(1)GLH 393)], having considered<br \/>\nthe decision of the Hon&#8217;ble Apex Court in the case of <a href=\"\/doc\/1733535\/\" id=\"a_2\">Ram Manohar<br \/>\nLohia v. State of Bihar<\/a> (AIR 1966 SC 740), this Court held that<br \/>\nthe cases wherein the detention order passed on the basis of the<br \/>\nstatements of the witnesses falls under the maintenance of  law and<br \/>\norder  and not  public order .\n<\/p>\n<p id=\"p_4\">5.\t\tApplying<br \/>\nthe ratio of the above decisions, it is clear that before passing an<br \/>\norder of detention  of a detenue, the detaining authority must come<br \/>\nto a definite finding that there is threat to the  public  order<br \/>\nand it is very clear that the present would not fall within the<br \/>\ncategory of threat to  public order . In that view of the matter,<br \/>\nwhen the order of detention has been passed by the detaining<br \/>\nauthority without having adequate grounds for passing the said order,<br \/>\ncannot be sustained and, therefore, it deserves to be quashed and set<br \/>\naside.\n<\/p>\n<p id=\"p_5\">6.\t\tThe<br \/>\npetition is allowed. The impugned order of detention dated 5.1.2010<br \/>\npassed against the detenu is hereby quashed and set aside. The detenu<br \/>\nis ordered to be set at liberty forthwith, if not required in any<br \/>\nother case. Rule is made absolute accordingly.
