They<\/p>\n<p>were, therefore, heard together and are being disposed of by this<\/p>\n<p>common judgment.\n<\/p>\n<p id=\"p_1\">W.P.(C) No.27280 of 2010:-\n<\/p>\n<p id=\"p_2\">            2. The petitioner in this writ petition is a resident of<\/p>\n<p>Peringamala Grama Panchayat in Thiruvananthapuram District.         He<\/p>\n<p>belongs to the Kani tribe which is recognised as a scheduled tribe in<\/p>\n<p>the State of Kerala. <a href=\"\/doc\/1091659\/\" id=\"a_1\">Article 243-D<\/a> of the Constitution of India and the<\/p>\n<p>provisions of the Kerala Panchayat Raj Act, 1994, hereinafter referred<\/p>\n<p>to as &#8216;the Act&#8217; for short,   provide for the reservation of seats    in<\/p>\n<p>various levels of Panchayats and office of President of Panchayats at<\/p>\n<p>various levels in favour of candidates belonging to the scheduled<\/p>\n<p>castes, the scheduled tribes and also women. Section 153 (3)(a) of<\/p>\n<p>the Kerala Panchayat Raj Act, 1994, stipulates that the offices of<\/p>\n<p>President of Village Panchayats, Block Panchayats and District<\/p>\n<p>Panchayats in the State shall be reserved by the Government for the<\/p>\n<p>scheduled castes and the scheduled tribes and the number of the<\/p>\n<p>W.P.(C) No.27264\/2010 etc.<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">                                   2<\/span><\/p>\n<p>offices of President reserved for the scheduled castes and the<\/p>\n<p>scheduled tribes in the Panchayats at each level in the State shall<\/p>\n<p>bear, as nearly as may be, the same proportion to the total number of<\/p>\n<p>offices of President at each level as the population of the scheduled<\/p>\n<p>castes in the State or of the scheduled tribes in the State bears to the<\/p>\n<p>total population of the State. Clause (b) of sub-section (3) of section<\/p>\n<p>153 provides that         50% each of the total number of offices of<\/p>\n<p>President of Village Panchayats, Block Panchayats and District<\/p>\n<p>Panchayats in the State reserved under clause (a) and 50% each of<\/p>\n<p>the total number of offices of President of Village Panchayats, Block<\/p>\n<p>Panchayats and District Panchayats in the State, not so reserved, shall<\/p>\n<p>be reserved      by the Government for women.       Clause (a) of sub-<\/p>\n<p>section (4) of section 153 of the Act stipulates that the offices of the<\/p>\n<p>President reserved under sub-section (3) shall be allotted to every<\/p>\n<p>level of    Panchayat in the different districts by the State Election<\/p>\n<p>Commission by notification in the Gazette. Clause (b) of sub-section<\/p>\n<p>(4) of section 153 of the Act stipulates that in the case of Block<\/p>\n<p>Panchayats and Village Panchayats, the office of President reserved<\/p>\n<p>for the scheduled castes and the scheduled tribes shall be allotted<\/p>\n<p>W.P.(C) No.27264\/2010 etc.<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">                                    3<\/span><\/p>\n<p>proportionate to their population in the respective districts.  Clause<\/p>\n<p id=\"p_3\">(c) of sub-section (4) of section 153 stipulates that in the case of<\/p>\n<p>Village Panchayats, the reserved seats in each district shall be<\/p>\n<p>distributed among the Village Panchayats within the area of the<\/p>\n<p>various Block Panchayats in the district. Clause (d) of sub-section (4)<\/p>\n<p>of section 153 stipulates that    before issuing the notification for<\/p>\n<p>General Election, the State Election Commission shall allot by rotation<\/p>\n<p>the reserved seats under clause (a), (b) and (c) and the rotation shall<\/p>\n<p>start from the Panchayat in which the scheduled castes, or the<\/p>\n<p>scheduled tribes or women have the largest percentage of population<\/p>\n<p>and then passed on to the next Panchayat having their largest<\/p>\n<p>percentage of population and so on.\n<\/p>\n<p id=\"p_4\">              3. In the elections to the local bodies held for the first<\/p>\n<p>time after the Kerala Panchayat Raj Act, 1994, was enacted, the<\/p>\n<p>office of President of Vithura Grama Panchayat in Vellanad Block<\/p>\n<p>Panchayat of Thiruvananthapuram District was reserved for the<\/p>\n<p>scheduled tribes. In the elections held during the year 2000, there<\/p>\n<p>was no reservation of the office of President of Grama Panchayat in<\/p>\n<p>favour of the scheduled tribes in the whole of Thiruvananthapuram<\/p>\n<p>W.P.(C) No.27264\/2010 etc.<\/p>\n<p><span class=\"hidden_text\" id=\"span_2\">                                     4<\/span><\/p>\n<p>District.   In    the next elections, viz., during 2005, the office of<\/p>\n<p>President       of     Tholicode Grama Panchayat      in Vellanad Block<\/p>\n<p>Panchayat (the very same Block Panchayat of which Vithura Grama<\/p>\n<p>Panchayat is also a part) was reserved in favour of the scheduled<\/p>\n<p>tribes. The grievance voiced by the petitioner in this writ petition is<\/p>\n<p>that in the ensuing elections, viz., elections scheduled to be held in<\/p>\n<p>October 2010, the office of President of Vithura Grama Panchayat has<\/p>\n<p>again been reserved for the scheduled tribes by Ext.P1 notification<\/p>\n<p>dated 26.8.2010 published in the Kerala Gazette (Extra ordinary)<\/p>\n<p>dated 26.8.2010. It is contended that the State Election Commission<\/p>\n<p>ought to have reserved the office of President applying clause (d) of<\/p>\n<p>sub-section (4) of Section 154 of the Act by rotation among the<\/p>\n<p>various Grama Panchayats in Thiruvananthapuram District and that<\/p>\n<p>instead they have confined the reservation only to Panchayats in<\/p>\n<p>Vellanad Block Panchayat. The petitioner contends that the decision<\/p>\n<p>taken    by the State Election Commission to reserve         the office of<\/p>\n<p>President of Vithura Grama Panchayat for the scheduled tribes is<\/p>\n<p>arbitrary and illegal and is liable to be set aside. It is contended that<\/p>\n<p>applying the rule of rotation stipulated in section 153(4)(d) of the Act,<\/p>\n<p>W.P.(C) No.27264\/2010 etc.<\/p>\n<p><span class=\"hidden_text\" id=\"span_3\">                                    5<\/span><\/p>\n<p>the office of the President of Peringamala Grama Panchayat in<\/p>\n<p>Vamanapuram Block Panchayat should have been reserved in favour<\/p>\n<p>of the scheduled tribes.\n<\/p>\n<p id=\"p_5\">W.P.(C) No.27264 of 2010<\/p>\n<p id=\"p_6\">              4. The petitioner herein is a resident of Vithura Grama<\/p>\n<p>Panchayat. In this writ petition wherein contentions similar to those<\/p>\n<p>in W.P.(C) No.27280 of 2010 are raised, the petitioner contends that<\/p>\n<p>the reservation of the office of President of Vithura Grama Panchayat<\/p>\n<p>in favour of the scheduled tribes is arbitrary and illegal. The factual<\/p>\n<p>details are as set out in W.P.(C) No.27280 of 2010 and are therefore,<\/p>\n<p>not set out separately.\n<\/p>\n<p id=\"p_7\">W.P.(C) No.27940 of 2010<\/p>\n<p id=\"p_8\">              5. The petitioner herein is a resident of Chithra Grama<\/p>\n<p>Panchayat in Kollam District. Chithra Grama Panchayat is one among<\/p>\n<p>the eight Grama Panchayats in Chadayamangalam Block. During the<\/p>\n<p>elections held in the year 1995, the office of President of Chithra<\/p>\n<p>Grama Panchayat was not reserved in favour of either women<\/p>\n<p>candidates or the scheduled castes or the scheduled tribes.<\/p>\n<p>However, in the next elections, viz., the elections held in the year<\/p>\n<p>W.P.(C) No.27264\/2010 etc.<\/p>\n<p><span class=\"hidden_text\" id=\"span_4\">                                     6<\/span><\/p>\n<p>2000, the office of President of Chithra Grama Panchayat was<\/p>\n<p>reserved in favour of the scheduled castes.    In the next elections,<\/p>\n<p>viz., the    elections held during 2005, the office of President was<\/p>\n<p>reserved in favour of women candidates. In the ensuing elections,<\/p>\n<p>the office of President of Chithra Grama Panchayat is reserved for the<\/p>\n<p>scheduled      castes. The notification issued by the State Election<\/p>\n<p>Commission in that regard and published in the Kerala Gazette (Extra<\/p>\n<p>ordinary) dated 26.8.2010 is under challenge in this writ petition. The<\/p>\n<p>petitioner contends that the percentage of population of the scheduled<\/p>\n<p>castes in Chithra Grama Panchayat is 13.70 and that as the office of<\/p>\n<p>President of Chithra Grama Panchayat was reserved during the year<\/p>\n<p>2000 in favour of the scheduled castes and during the year 2005 in<\/p>\n<p>favour of women candidates, in the ensuing elections, the office of<\/p>\n<p>President      of Elamad Grama Panchayat, the additional third<\/p>\n<p>respondent in the writ petition, should have been reserved for the<\/p>\n<p>scheduled castes.         The petitioner contends that the rotation<\/p>\n<p>contemplated in section 153(4)(d) of the Act is among the various<\/p>\n<p>Panchayats in Malappuram Districts and that the State Election<\/p>\n<p>Commission has not applied the rotation correctly. On this ground, the<\/p>\n<p>W.P.(C) No.27264\/2010 etc.<\/p>\n<p><span class=\"hidden_text\" id=\"span_5\">                                     7<\/span><\/p>\n<p>petitioner challenges     the reservation of the office of President of<\/p>\n<p>Chithra Grama Panchayat in favour of the scheduled castes.<\/p>\n<p>W.P.(C) No.28088 of 2010<\/p>\n<p id=\"p_9\">              6. The petitioner herein is a resident of Mankada Grama<\/p>\n<p>Panchayat in Malappuram District.      It is stated that in the elections<\/p>\n<p>held in the year 2000, the office of President of Mankada Grama<\/p>\n<p>Panchayat was reserved in favour of the scheduled castes, in the<\/p>\n<p>elections held in the year 2005, the office of President was reserved in<\/p>\n<p>favour of women candidates and that in the ensuing elections, the<\/p>\n<p>office of President of Mankada Grama Panchayat          has again been<\/p>\n<p>reserved in favour of the scheduled castes. The petitioner contends<\/p>\n<p>that the State Election Commission erred in successively reserving<\/p>\n<p>the office of President of Mankada Grama Panchayat in favour of the<\/p>\n<p>scheduled castes, and therefore, the notification issued by the State<\/p>\n<p>Election Commission in that regard is liable to be set aside.       It is<\/p>\n<p>contended that the office of President of Koottilangadi Grama<\/p>\n<p>Panchayat or Makkaraparamba Grama Panchayat ought to have been<\/p>\n<p>reserved applying the rule of rotation contemplated in clause (d) of<\/p>\n<p>sub-section (4) of section 153 of the Act.\n<\/p>\n<p id=\"p_10\">W.P.(C) No.27264\/2010 etc.<\/p>\n<p><span class=\"hidden_text\" id=\"span_6\">                                    8<\/span><\/p>\n<p id=\"p_11\">              7. In all these cases, the State Election Commission has<\/p>\n<p>filed separate statements. As regards the Vithura Grama Panchayat,<\/p>\n<p>it is stated that the Government had reserved one office of President<\/p>\n<p>of Grama Panchayat in the whole of Thiruvananthapuram District in<\/p>\n<p>favour of the scheduled tribes as per G.O.(MS) No.155\/10\/LSGD<\/p>\n<p>dated 22.7.2010; that the total number of offices of President thus<\/p>\n<p>reserved in Thiruvananthapuram district in favour of various<\/p>\n<p>categories including the scheduled castes, the scheduled tribes and<\/p>\n<p>women candidates was 14; that out of the 11 Block Panchayats in<\/p>\n<p>Thiruvananthapuram, Vellanad Block Panchayat consisting of 8 Grama<\/p>\n<p>Panchayats is having the highest percentage of scheduled tribe<\/p>\n<p>population and therefore, for the purpose of reserving the office of<\/p>\n<p>President of Grama Panchayat       in Thiruvananthapuram District   in<\/p>\n<p>favour of the scheduled tribes, Vellanad Block Panchayat was chosen.<\/p>\n<p>It is further stated that since Vithura Grama Panchayat has the<\/p>\n<p>highest percentage of scheduled tribe        population in that Block<\/p>\n<p>Panchayat and the office of President of Vithura Grama Panchayat<\/p>\n<p>had not been reserved for the scheduled tribes during the elections<\/p>\n<p>held in the year 2005 a decision was taken by the State Election<\/p>\n<p>W.P.(C) No.27264\/2010 etc.<\/p>\n<p><span class=\"hidden_text\" id=\"span_7\">                                   9<\/span><\/p>\n<p>Commission to reserve the office of President of Vithura Grama<\/p>\n<p>Panchayat for the scheduled tribes in the ensuing elections.    With<\/p>\n<p>reference to Mankada Grama Panchayat in Malappuram District and<\/p>\n<p>Chithra Grama Panchayat in Kollam District, similar contentions are<\/p>\n<p>raised. In other words, from a reading of the statements filed by the<\/p>\n<p>State Election Commission, it is     evident that the State Election<\/p>\n<p>Commission has not identified the Grama Panchayat in which office of<\/p>\n<p>President has to be reserved either in favour of scheduled castes or<\/p>\n<p>the scheduled tribes having regard to the population of the scheduled<\/p>\n<p>castes or the scheduled tribes, as the case may be, in the various<\/p>\n<p>Grama Panchayats of the revenue district.\n<\/p>\n<p id=\"p_12\">              8.       I  heard Sri.G.Ram   Mohan,    Sri.M.R.Rajesh,<\/p>\n<p>Sri.T.R.Harikumar and Sri.K.Abdul Jawad, the learned counsel<\/p>\n<p>appearing for the petitioners in the respective writ petitions,<\/p>\n<p>Smt.K.R.Deepa, learned Government Pleader appearing for the State<\/p>\n<p>of Kerala, Sri.Murali Purushothaman, learned Standing Counsel<\/p>\n<p>appearing for the Kerala State Election Commission, Sri.V.Rajendran<\/p>\n<p>(Perumbavoor), learned counsel appearing for the Vithura Grama<\/p>\n<p>Panchayat and Sri.M.Dinesh, the learned counsel appearing for the<\/p>\n<p>W.P.(C) No.27264\/2010 etc.<\/p>\n<p><span class=\"hidden_text\" id=\"span_8\">                                   10<\/span><\/p>\n<p>Peringamala Grama Panchayat. I have also considered the pleadings<\/p>\n<p>and the materials on record. The learned counsel for the petitioners<\/p>\n<p>contended that as the Election Commission has admittedly not<\/p>\n<p>followed the stipulations in clauses (b) and (c) of sub-section (4) of<\/p>\n<p>Section 153 of the Act while identifying the Grama Panchayat, the<\/p>\n<p>office of President of which is to be reserved either in favour of the<\/p>\n<p>scheduled castes or the scheduled tribes, the decision taken by the<\/p>\n<p>Commission is liable to be set aside as it is one made in violation of<\/p>\n<p>the statutory provisions. Relying on the decision of the Apex Court in<\/p>\n<p><a href=\"\/doc\/1685522\/\" id=\"a_1\">Comptroller and Auditor General of India, Gian Prakash, New<\/p>\n<p>Delhi and Another v. K.S.Jagannathan and Another<\/a> (1986 (2)<\/p>\n<p>SCC 679), Sri.M.R.Rajesh, the learned counsel for the petitioner in<\/p>\n<p>W.P.(C) No.27280 of 2010 contended that where a public authority<\/p>\n<p>has failed to exercise or has wrongly exercised the discretion<\/p>\n<p>conferred upon it by a statute or a rule or a policy decision of the<\/p>\n<p>Government or has exercised such discretion mala fide          or on<\/p>\n<p>irrelevant considerations or by ignoring the relevant considerations<\/p>\n<p>and materials or in such a manner as to frustrate the object of<\/p>\n<p>conferring such discretion or the policy for implementing which such<\/p>\n<p>W.P.(C) No.27264\/2010 etc.<\/p>\n<p><span class=\"hidden_text\" id=\"span_9\">                                    11<\/span><\/p>\n<p>discretion has been conferred, this Court exercising jursidcition under<\/p>\n<p><a href=\"\/doc\/1712542\/\" id=\"a_2\">Article 226<\/a> of the Constitution of India can in a fit and proper case<\/p>\n<p>compel the performance in a proper and lawful manner of the<\/p>\n<p>discretion conferred upon the Government or a public authority, and<\/p>\n<p>in a proper case, in order to prevent injustice resulting to the<\/p>\n<p>concerned parties, this Court can itself pass an order or give<\/p>\n<p>directions which the Government or the public authority should have<\/p>\n<p>passed. He submitted that if that be so, in an area where the Election<\/p>\n<p>Commission has no discretion, the Commission cannot take shelter<\/p>\n<p>under the plea that its decision should not be interfered with as it will<\/p>\n<p>result in unsettling the election schedule.\n<\/p>\n<p id=\"p_13\">              9. Per contra, Sri.Murali Purushothaman, the learned<\/p>\n<p>standing counsel appearing for the State Election Commission<\/p>\n<p>contended, relying on the decision of a learned single Judge of this<\/p>\n<p>Court in Viswanath B. v. The State of Kerala and others (ILR<\/p>\n<p>2002 (1) Kerala 42) that in the absence of any allegation of<\/p>\n<p>favouritism or malafides, as the State Election Commission has<\/p>\n<p>followed a uniform procedure through the State, the decision of the<\/p>\n<p>Election Commission should not be interfered with.        The learned<\/p>\n<p>W.P.(C) No.27264\/2010 etc.<\/p>\n<p><span class=\"hidden_text\" id=\"span_10\">                                    12<\/span><\/p>\n<p>counsel for the State Election Commission also contended that the<\/p>\n<p>reservation in the instant cases does not amount to successive<\/p>\n<p>reservation to the same category of candidates.<\/p>\n<p id=\"p_14\">              10.   I have considered the submissions made at the Bar<\/p>\n<p>by the learned counsel appearing on either side. The short question<\/p>\n<p>that arises for consideration in these cases is whether the procedure<\/p>\n<p>adopted by the State Election Commission for identifying the Grama<\/p>\n<p>Panchayats in which the office of President is to be reserved is illegal.<\/p>\n<p>Sub-sections (3) and (4) of section 153 of the Kerala Panchayat Raj<\/p>\n<p>Act, 1994 which are relevant for the purpose of these cases are<\/p>\n<p>extracted below for easy reference.\n<\/p>\n<blockquote id=\"blockquote_1\"><p>                    &#8220;Section 153. Election of President and<br \/>\n             Vice-President:-\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_1\"><p>                    (1)&#8212;&#8212;&#8212;&#8212;&#8212;<br \/>\n                    (2)&#8212;&#8212;&#8212;&#8212;&#8212;<\/p><\/blockquote>\n<blockquote id=\"blockquote_2\"><p>                    (3)(a) The offices of President of Village<br \/>\n             Panchayats, Block Panchayats and District<br \/>\n             Panchayats in the State shall be reserved by the<br \/>\n             Government for the Scheduled castesand the<br \/>\n             Schedued tribes and the number of the offices<br \/>\n             of President reserved for Scheduled castesand<br \/>\n             the Scheduled tribes in the Panchayats at each<br \/>\n             level in the State shall bear, as nearly as may<br \/>\n             be, the same proportion to the total number of<br \/>\n             offices of President at each level as the<br \/>\n             population of the Scheduled castesin the State<br \/>\n             or of the Scheduled tribes in the State bears to<\/p>\n<p>W.P.(C) No.27264\/2010 etc.<\/p>\n<p><span class=\"hidden_text\" id=\"span_11\">                                    13<\/span><\/p>\n<p>             the total population of the State:\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_3\"><p>                    (b)(i)    [Fifty percent (in the case of<br \/>\n             fraction it shall be fixed to the next higher<br \/>\n             integer)] each of the total number of offices of<br \/>\n             President      of   Village    Panchayats,    Block<br \/>\n             Panchayats and District Pachayats in the State<br \/>\n             reserved under clause (a); and\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_4\"><p>                    (ii)[Fifty percent (in the case of fraction it<br \/>\n             shall be fixed to the next higher integer)] each<br \/>\n             of the total number of offices of President of<br \/>\n             Village Panchayats, Block Panchayats and<br \/>\n             District Panchayats in the State, not so<br \/>\n             reserved, shall be reserved by the Government,<br \/>\n             for women.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_5\"><p>                    (4)(a)     The offices of the President<br \/>\n             reserved under sub-section (3) shall be allotted<br \/>\n             to every level of the Panchayat in the different<br \/>\n             districts by the State Election Commission by<br \/>\n             notification in the Gazette.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_6\"><p>                    (b) In the case of Block Panchayats and<br \/>\n             Village Panchayats the reserved seats for the<br \/>\n             Scheduled castesand Scheduled tribes shall be<br \/>\n             allotted proportionate to their population in the<br \/>\n             respective districts.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_7\"><p>                    (c) In the case of Village Panchayat, the<br \/>\n             reserved seats in each district shall be<br \/>\n             distributed among the Village Panchayats<br \/>\n             within the area of the various Block Panchayats<br \/>\n             in the district.<\/p><\/blockquote>\n<p id=\"p_15\">\n<p id=\"p_16\">                    (d) Before issuing notification for General<br \/>\n             election, the State Election Commission shall<br \/>\n             allot by rotation the reserved seats under<br \/>\n             clause (a), (b) and (c) and the rotation shall<br \/>\n             start     from the Panchayat in which the<br \/>\n             scheduled castes, or the scheduled tribes or<br \/>\n             women        have  the   largest   percentage     of<br \/>\n             population and then passed on to the next<br \/>\n             Panchayat having their largest percentage of<\/p>\n<p>W.P.(C) No.27264\/2010 etc.<\/p>\n<p><span class=\"hidden_text\" id=\"span_12\">                                    14<\/span><\/p>\n<p>             population and so on:\n<\/p>\n<p id=\"p_17\">                    (e) In the case of an election to the office<br \/>\n             of the President reserved for Scheduled<br \/>\n             castesor Scheduled tribes, a member, if he is<br \/>\n             not a person elected from a seat reserved for<br \/>\n             Scheduled castesor Scheduled tribes as the<br \/>\n             case may be, shall not be eligible for Election to<br \/>\n             the office of the President, unless he produces<br \/>\n             before the Returning Officer a community<br \/>\n             certificate issued by a competent officer stating<br \/>\n             that he is a member of the Scheduled casteor<br \/>\n             Scheduled tribe;\n<\/p>\n<p id=\"p_18\">                    (f) A member elected to the office of the<br \/>\n             President reserved for        Scheduled castesor<br \/>\n             Scheduled tribes who has been proved under<br \/>\n             the Kerala ( Scheduled castesand Scheduled<br \/>\n             tribes) Regulation of Issue of Community<br \/>\n             Certificate Act, 1996 (11 of 1996) or under any<br \/>\n             other law for the time being in force, that he<br \/>\n             does not belong to            Scheduled casteor<br \/>\n             Scheduled tribe, as the case may be, and<br \/>\n             declared as such he shall not be entitled to<br \/>\n             continue in office of the President from the date<br \/>\n             of such declaration and his membership shall<br \/>\n             stand       forfeited  and  the  State    Election<br \/>\n             Commission shall declare the offices of the<br \/>\n             President and the member to be vacant.]<br \/>\n                    Provided that where the Panchayat the<br \/>\n             office of President of which is to be reserved for<br \/>\n             women and the Scheduled castesand Scheduled<br \/>\n             tribes is one and the same; in so reserving the<br \/>\n             Office of President, preference shall be given to<br \/>\n             the Scheduled castesor Scheduled tribes and in<br \/>\n             lieu, the        office of the President in the<br \/>\n             Panchayat next having their largest percentage<br \/>\n             population of women shall be reserved for<br \/>\n             women:\n<\/p>\n<p id=\"p_19\">                    Provided further that in Panchayats the<\/p>\n<p>W.P.(C) No.27264\/2010 etc.<\/p>\n<p><span class=\"hidden_text\" id=\"span_13\">                                    15<\/span><\/p>\n<p>             office of President of which is reserved for the<br \/>\n             Scheduled casteor Scheduled tribes, those in<br \/>\n             which the women have the more percentage of<br \/>\n             population of women shall be reserved for<br \/>\n             women belonging to them:\n<\/p>\n<p id=\"p_20\">                    Provided also that the office of President<br \/>\n             of any Panchayat shall be reserved            for the<br \/>\n             scheduled castesor scheduled tribes or women<br \/>\n             belonging to them only if at least one<br \/>\n             constituency of that Panchayat is reserved for<br \/>\n             that category.\n<\/p>\n<p id=\"p_21\">              11. There is no dispute that applying sub-section(3) of<\/p>\n<p>section 153 of the Act, the Government have decided to reserve one<\/p>\n<p>office   of   President    of  Grama    Panchayat  in   the   whole   of<\/p>\n<p>Thiruvananthapuram District in favour of the scheduled tribes.<\/p>\n<p>Likewise, there is no dispute regarding the number of the offices of<\/p>\n<p>President of Grama Panchayat reserved by the Government in favour<\/p>\n<p>of the scheduled castes in Malappuram and Kollam Districts.        Sub-<\/p>\n<p>section (4) of section 153 of the Act sets out the manner in which the<\/p>\n<p>office of President reserved by the Government under sub-section (3)<\/p>\n<p>of section 153 of the Act has to be allotted to every level of Panchayat<\/p>\n<p>in the different districts by the State Election Commission. Clause (b)<\/p>\n<p>of sub-section (4) of Section 153 states that in the case of Block<\/p>\n<p>Panchayats and in the case of Village Panchayats, the offices reserved<\/p>\n<p>W.P.(C) No.27264\/2010 etc.<\/p>\n<p><span class=\"hidden_text\" id=\"span_14\">                                      16<\/span><\/p>\n<p>for the scheduled castes and the scheduled tribes shall be allotted<\/p>\n<p>proportionate to their population in the respective districts. Clause (c)<\/p>\n<p>of sub-section (4) of section 153 states that in the case of Village<\/p>\n<p>Panchayats, the reserved seats in each district shall be distributed<\/p>\n<p>among the Village Panchayats within the area of various Block<\/p>\n<p>Panchayats in the district.     From a reading of clauses (b) and (c) of<\/p>\n<p>sub-section (4) of section 153, it is evident that in the case of Village<\/p>\n<p>Panchayats, when the Government have reserved a particular number<\/p>\n<p>of offices of President of Village Panchayat either in favour of the<\/p>\n<p>scheduled castes or the scheduled tribes, the State Election<\/p>\n<p>Commission is bound to allot the seats having regard to the<\/p>\n<p>population of the scheduled castes or the scheduled tribes, as the<\/p>\n<p>case may be,       in the respective districts.   Clause (c) clarifies the<\/p>\n<p>position by reiterating that the reserved offices in each district shall<\/p>\n<p>be distributed among the Village Panchayats within the area of various<\/p>\n<p>Block Panchayats.         In my opinion, the effect of clauses (b) and (c)<\/p>\n<p>of sub-section (4) of section 153 of the Act is that the offices of<\/p>\n<p>President of Grama Panchayats reserved for the scheduled castes and<\/p>\n<p>the scheduled tribes shall be distributed among the various Grama<\/p>\n<p>W.P.(C) No.27264\/2010 etc.<\/p>\n<p><span class=\"hidden_text\" id=\"span_15\">                                  17<\/span><\/p>\n<p>Panchayats within the revenue district.     The first proviso to sub-<\/p>\n<p>section (4) of section 153 stipulates that where the Panchayat the<\/p>\n<p>office of President of which is to be reserved for women and the<\/p>\n<p>scheduled castes and scheduled tribes is one and the same; in so<\/p>\n<p>reserving the Office of President, preference shall be given to the<\/p>\n<p>scheduled castes or scheduled tribes and in lieu, the office of the<\/p>\n<p>President in the Panchayat next having       their largest percentage<\/p>\n<p>population of women shall be reserved for women.           The second<\/p>\n<p>proviso stipulates that in Panchayats, the office of President of which<\/p>\n<p>is reserved for the scheduled caste or scheduled tribes, those in which<\/p>\n<p>the women have the more percentage of population shall be reserved<\/p>\n<p>for scheduled caste women or scheduled tribe women, as the case<\/p>\n<p>may be. The third proviso stipulates that such reservation in favour of<\/p>\n<p>the scheduled castes or scheduled tribes or women belonging to the<\/p>\n<p>scheduled castes or scheduled tribes shall be made only if at least one<\/p>\n<p>constituency of that Panchayat is reserved for that category. The<\/p>\n<p>State Election Commission was therefore, in my opinion, bound to<\/p>\n<p>allot the offices of President of Grama Panchayat reserved for the<\/p>\n<p>scheduled castes and the scheduled tribes having regard to the<\/p>\n<p>W.P.(C) No.27264\/2010 etc.<\/p>\n<p><span class=\"hidden_text\" id=\"span_16\">                                   18<\/span><\/p>\n<p>percentage of population of the scheduled castes and the scheduled<\/p>\n<p>tribes in the various Grama Panchayats in the revenue district, guided<\/p>\n<p>by the three privosos to sub-section (4) of Section 153 of the Act.<\/p>\n<p id=\"p_22\">              12. In the instant case, it is evident from Annexure-E<\/p>\n<p>worksheet produced in W.P.(C) No.27280 of 2010 that the Grama<\/p>\n<p>Panchayat having the highest percentage of population of scheduled<\/p>\n<p>tribes is Vithura Grama Panchayat (12.31%).         The next highest<\/p>\n<p>percentage of population of scheduled tribes is in Peringamala Grama<\/p>\n<p>Panchayt (12.22%). The Peringamala Grama Panchayat is impleaded<\/p>\n<p>as the additional third respondent in W.P.(C) No.27280 of 2010 and<\/p>\n<p>the Vithura Grama Panchayat is impleaded as the additional fourth<\/p>\n<p>respondent       in W.P.(C) No.27264 of 2010.      The State Election<\/p>\n<p>Commission has, in my opinion, by reserving the office of President of<\/p>\n<p>Vithura Grama Panchayat for the scheduled tribes acted in violation<\/p>\n<p>of the stipulations contained in clause (d) of sub-section 4 of section<\/p>\n<p>153 of the Act. It did not rotate the office of President reserved in<\/p>\n<p>favour of the scheduled tribes among the various Panchayats in<\/p>\n<p>Thiruvananthapuram district having regard to the percentage of<\/p>\n<p>population of the scheduled tribes in the respective Panchayats. In<\/p>\n<p>W.P.(C) No.27264\/2010 etc.<\/p>\n<p><span class=\"hidden_text\" id=\"span_17\">                                   19<\/span><\/p>\n<p>such circumstances, I am constrained to hold that the reservation of<\/p>\n<p>the office of President of Vithura Grama Panchayat in favour of the<\/p>\n<p>scheduled tribes cannot be sustained.\n<\/p>\n<p id=\"p_23\">              13. It is brought to my notice that the State Election<\/p>\n<p>Commission has taken steps to notify the elections and that the<\/p>\n<p>notification will be issued on 27.9.2010. By virtue of the directions<\/p>\n<p>issued by a Division Bench of this Court, the elections will have to be<\/p>\n<p>completed before 1.11.2010. In view of the admitted factual position<\/p>\n<p>and the fact that the Peringamala Grama Panchayat             which is<\/p>\n<p>represented by counsel has no objection to the office of President of<\/p>\n<p>that Grama Panchayat being reserved in favour of the scheduled<\/p>\n<p>tribes, I am of the opinion that no prejudice will be caused to any of<\/p>\n<p>the parties and the election process will not also be stalled if, while<\/p>\n<p>notifying the elections, the State Election Commission reserves the<\/p>\n<p>office of President of Peringamala Grama Panchayat for the scheduled<\/p>\n<p>tribes. The State Election Commission can also issue a corrigendum<\/p>\n<p>notification suitably amending Notification No.214\/2010\/SEC dated<\/p>\n<p>26.8.2010 published in the Kerala Gazette (Extra Ordinary) dated<\/p>\n<p>26.8.2010. I accordingly allow W.P.(C) Nos.27264 of 2010 and 27280<\/p>\n<p>W.P.(C) No.27264\/2010 etc.<\/p>\n<p><span class=\"hidden_text\" id=\"span_18\">                                   20<\/span><\/p>\n<p>of 2010, quash Ext.P2 notification dated 26.8.2010 produced in W.P.<\/p>\n<p>(C) No.27280 of 2010 to the extent it reserves the office of President<\/p>\n<p>of Vithura Grama Panchayat in favour of the scheduled tribes and<\/p>\n<p>direct     the State Election Commission to reserve the office of<\/p>\n<p>President of Peringamala Grama Panchayat for the scheduled tribes.<\/p>\n<p>The Election Commission shall issue the election notification<\/p>\n<p>incorporating the above changes and shall also issue a corrigendum<\/p>\n<p>notification in the Gazette suitably amending Notification No.<\/p>\n<p>214\/2010\/SEC dated 26.8.2010        published  in the Kerala Gazette<\/p>\n<p>(Extra Ordinary) dated 26.8.2010.\n<\/p>\n<p id=\"p_24\">              14. I shall now deal with   W.P.(C) No.28088 of 2010<\/p>\n<p>which relates to Mankada Grama Panchayat in Malappuram District.<\/p>\n<p>Mankada Grama Panchayat         is a constituency in Mankada Block<\/p>\n<p>Panchayat      which consists of 6 Grama Panchayats.     Malappuram<\/p>\n<p>Revenue District consists of 100 Grama Panchayats and 15 Block<\/p>\n<p>Panchayats. The reservation of the office of President of Mankada<\/p>\n<p>Grama Panchayat in favour of the scheduled castes is under challenge<\/p>\n<p>in this writ petition. Going by the worksheet produced by the State<\/p>\n<p>Election Commission, the highest percentage of population of the<\/p>\n<p>W.P.(C) No.27264\/2010 etc.<\/p>\n<p><span class=\"hidden_text\" id=\"span_19\">                                       21<\/span><\/p>\n<p>scheduled caste is in Thiruvali Grama Panchayat in Wandoor Block<\/p>\n<p>Panchayat (21.15%). The next highest percentage of population of<\/p>\n<p>the scheduled castes is in Thavanur Grama Panchayat in Ponnani<\/p>\n<p>Block Panchayat (15.7%).          The office of President of  Thavanoor<\/p>\n<p>Grama Panchayat has been reserved in favour of Women candidates<\/p>\n<p>but the office of President of Thiruvali Grama Panchayat has not been<\/p>\n<p>reserved in favour of the women or the scheduled castes or the<\/p>\n<p>scheduled tribes.      It is evident from the work sheet produced by the<\/p>\n<p>State Election Commission that there are Panchayats          other than<\/p>\n<p>Mankada Grama Panchayat having a much higher percentage of<\/p>\n<p>population of the scheduled castes. It has therefore to be necessarily<\/p>\n<p>held that the State Election Commission has not correctly applied the<\/p>\n<p>rule of rotation while reserving the office of President of Mankada<\/p>\n<p>Grama Panchayat in favour of the scheduled castes. The provisions of<\/p>\n<p>section 153 of the Act do not envisage the Panchayats being heard or<\/p>\n<p>put on notice before the office of President is reserved in favour of<\/p>\n<p>either the scheduled castes or the scheduled tribes or           women<\/p>\n<p>candidates. In such circumstances, I am of the opinion that the State<\/p>\n<p>Election Commission should re-examine the issue and reserve the<\/p>\n<p>W.P.(C) No.27264\/2010 etc.<\/p>\n<p><span class=\"hidden_text\" id=\"span_20\">                                     22<\/span><\/p>\n<p>office of President of a Grama Panchayat other than Mankada Grama<\/p>\n<p>Panchayat in favour of the scheduled castes based on the percentage<\/p>\n<p>of population of          the scheduled castes in the various Grama<\/p>\n<p>Panchayats in Malappuram District. The Commission shall undertake<\/p>\n<p>the above exercise and issue a corrigendum notification amending<\/p>\n<p>Notification No.214\/2010\/SEC dated 26.8.2010, published in the<\/p>\n<p>Kerala Gazette (Extra ordinary) dated 26.8.2010. The revised decision<\/p>\n<p>will necessarily have to be reflected in the Election Notification which<\/p>\n<p>the Commission will be issuing on 27.9.2010. I accordingly allow W.P.<\/p>\n<p>(C) No.28088 of 2010 and quash the decision taken by the State<\/p>\n<p>Election Commission to reserve the office of President of Mankada<\/p>\n<p>Grama Panchayat in favour of the scheduled castes. The Commission<\/p>\n<p>shall re-examine the issue and identify another Grama Panchayat<\/p>\n<p>having regard to the population of the scheduled castes in the various<\/p>\n<p>Grama Panchayats in Malappuram District after ascertaining whether<\/p>\n<p>the office of President of such other Grama Panchayats has already<\/p>\n<p>been reserved in favour of other categories eligible for reservation,<\/p>\n<p>viz., the scheduled tribes and women candidates.           The Election<\/p>\n<p>Commission shall issue the election notification incorporating       its<\/p>\n<p>W.P.(C) No.27264\/2010 etc.<\/p>\n<p><span class=\"hidden_text\" id=\"span_21\">                                     23<\/span><\/p>\n<p>revised decision and shall also issue a corrigendum notification in the<\/p>\n<p>Gazette suitably amending Notification No. 214\/2010\/SEC dated<\/p>\n<p>26.8.2010 published in the Kerala Gazette (Extra Ordinary) dated<\/p>\n<p>26.8.2010.\n<\/p>\n<p id=\"p_25\">              15. I shall now deal with W.P.(C) No.27940 of 2010 which<\/p>\n<p>relates to Chithra Grama Panchayat in Kollam district. It is evident<\/p>\n<p>from the worksheet produced by the State Election Commission in<\/p>\n<p>respect of Kollam district that     there are Panchayats    other than<\/p>\n<p>Chithra Grama Panchayat having a higher percentage of population of<\/p>\n<p>the scheduled castes. The worksheet shows that Ariyankavu Grama<\/p>\n<p>Panchayat in Anchal Block Panchayat has the highest percentage of<\/p>\n<p>population of scheduled castes (23.73%),        Kulathurpuzha   Grama<\/p>\n<p>Panchayat in Anchal Block Panchayat has the second highest<\/p>\n<p>population     (21.4%) of       scheduled castes and Elamad Grama<\/p>\n<p>Panchayat in Chadayamangalam Block Panchayat            has the third<\/p>\n<p>highest population        (13.47%) of  scheduled castes. The office of<\/p>\n<p>President of Ariyankavu Grama Panchayat has been reserved in favour<\/p>\n<p>of the scheduled castes (women), but the office of President of<\/p>\n<p>Kulathurpuzha Grama Panchayat in Anchal Block Panchayat and<\/p>\n<p>W.P.(C) No.27264\/2010 etc.<\/p>\n<p><span class=\"hidden_text\" id=\"span_22\">                                   24<\/span><\/p>\n<p>Elamad Grama Panchayat in Chadayamangalam Block Panchayat have<\/p>\n<p>not been reserved in favour of any category of candidates. It is thus<\/p>\n<p>evident that that the State Election Commission has     not identified<\/p>\n<p>the Grama Panchayat in which the office of President has to be<\/p>\n<p>reserved in favour of the scheduled castes having regard to the<\/p>\n<p>population of the scheduled castes in the various Grama Panchayats<\/p>\n<p>of the revenue district. No reasons are also forthcoming as to why<\/p>\n<p>notwithstanding the availability of other Grama Panchayats having a<\/p>\n<p>larger percentage of population of the scheduled castes, the office of<\/p>\n<p>President of Chithra Grama Panchayat       was reserved in favour of<\/p>\n<p>scheduled castes. In such circumstances, I am of the opinion, the<\/p>\n<p>Commission should re-examine the issue and reserve the office of<\/p>\n<p>President of a Grama Panchayat other than Chithra Grama Panchayat<\/p>\n<p>in favour of the scheduled castes, based on the percentage of<\/p>\n<p>population of the scheduled castes in the various Grama Panchayats in<\/p>\n<p>Kollam District.    The Commission shall undertake the above exercise<\/p>\n<p>and     issue   a   corrigendum  notification  amending    Notification<\/p>\n<p>No.214\/2010\/SEC dated 26.8.2010, published in the Kerala Gazette<\/p>\n<p>(Extra ordinary) dated 26.8.2010. The revised decision will necessarily<\/p>\n<p>W.P.(C) No.27264\/2010 etc.<\/p>\n<p><span class=\"hidden_text\" id=\"span_23\">                                    25<\/span><\/p>\n<p>have to be reflected in the Election Notification which the Commission<\/p>\n<p>will be issuing on 27.9.2010. I accordingly allow W.P.(C) No.27940<\/p>\n<p>of 2010 and quash the decision taken by the State Election<\/p>\n<p>Commission to reserve the office of President of Chithra Grama<\/p>\n<p>Panchayat in favour of the scheduled castes. The Commission shall<\/p>\n<p>re-examine the issue and identify another Grama Panchayat having<\/p>\n<p>regard to the population of the scheduled castes in the various Grama<\/p>\n<p>Panchayats in Kollam District after ascertaining whether the office of<\/p>\n<p>President of such other Grama Panchayats has already been reserved<\/p>\n<p>in favour     of other categories    eligible for reservation, viz., the<\/p>\n<p>scheduled tribes and women candidates.         The Election Commission<\/p>\n<p>shall issue the election notification incorporating its revised decision<\/p>\n<p>and shall also issue a corrigendum notification in the Gazette suitably<\/p>\n<p>amending Notification No. 214\/2010\/SEC dated 26.8.2010 published<\/p>\n<p>in the Kerala Gazette (Extra Ordinary) dated 26.8.2010.<\/p>\n<p id=\"p_26\">              The writ petitions are allowed in the above terms.
