Justice K.T.SANKARAN\n\n Dated :27\/05\/2009\n\n O R D E R\n                      K.T.SANKARAN, J.\n\n               -----------------------------------------\n                       B.A.No. 1888 of 2009\n               -----------------------------------------\n\n               Dated this the 27th May, 2009\n\n                            O R D E R\n<\/pre>\n<p id=\"p_1\">      This is an application for anticipatory bail under <a href=\"\/doc\/1783708\/\" id=\"a_1\">Section<\/p>\n<p>438<\/a> of the Code of Criminal Procedure. The petitioners are the<\/p>\n<p>accused in Crime No. 45\/2009 of Maranalloor Police Station.<\/p>\n<p id=\"p_1\">      2. The offences alleged against the petitioners are under<\/p>\n<p><a href=\"\/doc\/1289794\/\" id=\"a_1\">Sections 452<\/a>, <a href=\"\/doc\/1266667\/\" id=\"a_2\">354<\/a>, <a href=\"\/doc\/661069\/\" id=\"a_3\">341<\/a>, <a href=\"\/doc\/770961\/\" id=\"a_4\">323<\/a>, <a href=\"\/doc\/267625\/\" id=\"a_5\">324<\/a> and <a href=\"\/doc\/1326470\/\" id=\"a_6\">427<\/a> read with 34<a href=\"\/doc\/1569253\/\" id=\"a_7\"> of the<\/p>\n<p>Indian Penal Code<\/a>.\n<\/p>\n<p id=\"p_2\">      3. Learned counsel for petitioners submitted that the<\/p>\n<p>incident is alleged to have occurred on 27.2.2009 and the<\/p>\n<p>matter was reported to the police only on 2.3.2009. Wound<\/p>\n<p>certificate issued by the medical officer on 27.2.2009 does not<\/p>\n<p>show any external injury on the de facto complainant. The<\/p>\n<p>contention of the petitioners is that the case was foisted<\/p>\n<p>against them and <a href=\"\/doc\/838469\/\" id=\"a_8\">Section 452<\/a> IPC is included only to see that<\/p>\n<p>the petitioners are not released on bail.\n<\/p>\n<p id=\"p_3\"><span class=\"hidden_text\" id=\"span_1\">  BA.1888\/09                      2<\/span><\/p>\n<p id=\"p_4\">     4. Taking into account the facts and circumstances of the<\/p>\n<p>case, the nature of the offences, the injury sustained and other<\/p>\n<p>circumstances, I am of the view that anticipatory bail can be<\/p>\n<p>granted to the petitioners. There will be a direction that in the<\/p>\n<p>event of the arrest of the petitioners, the officer in charge of<\/p>\n<p>the police station shall release them on bail for a period of one<\/p>\n<p>month on their executing bond for Rs.25,000\/- each with two<\/p>\n<p>solvent sureties for the like amount to the satisfaction of the<\/p>\n<p>officer concerned, subject to the following conditions:<\/p>\n<blockquote id=\"blockquote_1\"><p>      A)        The petitioners shall report before the<\/p>\n<p>                 investigating officer between 9 AM and 11<\/p>\n<p>                 AM on all Mondays, till the final report is<\/p>\n<p>                 filed or until further orders;<\/p>\n<p>      B)        The petitioners shall appear before the<\/p>\n<p>                 investigating officer for interrogation as<\/p>\n<p>                 and when required;\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_1\"><p>      C)        The petitioners shall not try to influence the<\/p>\n<p>                 prosecution witnesses or tamper with the<\/p>\n<p>                 evidence;\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_2\"><p>      D)       The petitioners shall not commit any offence<\/p>\n<p>                 or indulge in any prejudicial activity while<\/p>\n<p>                 on bail.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_3\"><p><span class=\"hidden_text\" id=\"span_1\"> BA.1888\/09                     3<\/span><\/p>\n<p>     E)       On the    expiry of the period mentioned<\/p>\n<p>              above, the petitioners shall surrender<\/p>\n<p>              before the Magistrate concerned and seek<\/p>\n<p>              regular bail.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_4\"><p>     F)       In case of breach of any of the conditions<\/p>\n<p>              mentioned above, the bail shall be liable to<\/p>\n<p>              be cancelled.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_5\"><p>    The Bail Application is allowed as above.<\/p><\/blockquote>\n<p id=\"p_5\">\n<p id=\"p_6\">                                K.T.SANKARAN, JUDGE<br \/>\nvgs.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Praveen @ Kichu vs State Of Kerala on 27 May, 2009 IN THE HIGH COURT OF KERALA AT ERNAKULAM Bail Appl..No. 1888 of 2009() 1.
