SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 16\/06\/2010 \n\n \n\n \nORAL\nORDER<\/pre>\n<p id=\"p_1\">1.\t\tThe<br \/>\npresent Second Appeal under Section 100 of the Code of Civil<br \/>\nProcedure has been preferred by the appellant herein   original<br \/>\nplaintiff to quash and set aside the impugned judgement and order<br \/>\ndated 31\/12\/2007 passed in Regular Civil Appeal No.23 of 2007.\n<\/p>\n<p id=\"p_1\">2.\t\tIt<br \/>\nis to be noted that the present Second Appeal has been preferred in<br \/>\nthe month of February,2008 and, thereafter, the same was adjourned at<br \/>\nleast for 42 times and it was again taken up for admission-hearing on<br \/>\n28\/04\/2010. On 28\/04\/2010, learned advocate appearing on behalf of<br \/>\nthe appellant was absent and, therefore, this Court dismissed the<br \/>\naforesaid Appeal for non-prosecution with the following order :\n<\/p>\n<p id=\"p_2\"> This<br \/>\nSecond Appeal is adjourned atleast for 42 times and on most of the<br \/>\noccasions, the same is adjourned due to non-availability of Shri<br \/>\nBhairavia, learned advocate appearing on behalf of the appellant.<br \/>\nDespite the order dated 21\/04\/2010, again the learned advocate<br \/>\nappearing on behalf of the appellant is not available.  Hence,<br \/>\ndismissed for non-prosecution.\n<\/p>\n<p id=\"p_3\"> CIVIL<br \/>\nAPPLICATION No. 1648\/2008<\/p>\n<p>As<br \/>\nthe main Second Appeal is dismissed for non-prosecution, the Civil<br \/>\nApplication is also dismissed for non-prosecution.  Notice is<br \/>\ndischarged.  Ad-interim relief granted earlier, if any, stands<br \/>\nvacated.\n<\/p>\n<p id=\"p_4\">3.\t\tThat<br \/>\nthereafter the application to restore the aforesaid Second Appeal was<br \/>\npreferred, which came to be considered by this Court and this Court<br \/>\nrestored the said Second Appeal by specifically observing that the<br \/>\nSecond Appeal is restored to file on assurance given by Mr.Bhairavia,<br \/>\nlearned advocate appearing on behalf of the appellant that as and<br \/>\nwhen the aforesaid Second Appeal is taken up for admission-hearing,<br \/>\nhe will make himself available or make alternative arrangement.<br \/>\nThereafter, after restoration of the Second Appeal, it is again<br \/>\nplaced for admission-hearing today.\n<\/p>\n<p id=\"p_5\">4.\t\tToday<br \/>\n when the Second Appeal is taken up for admission-hearing,<br \/>\nMr.Bhairavia, learned advocate appearing on behalf of the appellant<br \/>\nhas declared before the Court that the appellant has relieved him<br \/>\nand, therefore, he has filed Note before the Registry of this Court<br \/>\npermitting him to retire.  Mr.Bhairavia, learned advocate appearing<br \/>\non behalf of the appellant has also stated at the bar that he has<br \/>\npersonally informed the appellant with respect to today&#8217;s date. He<br \/>\nhas also stated that he has taken writing from the appellant to this<br \/>\neffect also.\n<\/p>\n<p id=\"p_6\">\t\tIn<br \/>\nview of the above, Mr.Bhairavia, learned advocate is hereby permitted<br \/>\nto retire today from the matter. It is reported that despite the fact<br \/>\nthat the appellant is informed about today&#8217;s date of hearing, still<br \/>\nno alternative arrangement is made, hence, the present Second Appeal<br \/>\nis dismissed for non-prosecution again.\n<\/p>\n<p id=\"p_7\">5.<br \/>\n\tIn view of dismissal of the Second Appeal, no order in the Civil<br \/>\nApplication and the same is also accordingly dismissed. Notice is<br \/>\ndischarged. Interim relief, if any, stands vacated forthwith.
