Chauhan, Advocate for the applicant\/appellants\n\n\nK.C.Puri, J.\n<\/pre>\n<p id=\"p_1\">            This is an appeal directed by the complainants against judgment<\/p>\n<p>dated 23.3.2007 passed by Mr. Virender Malik, Sub Divisional Judicial<\/p>\n<p>Magistrate, Kosli, vide which complaint under <a href=\"\/doc\/1011035\/\" id=\"a_1\">sections 323<\/a>, <a href=\"\/doc\/1133601\/\" id=\"a_1\">325<\/a>, <a href=\"\/doc\/1258372\/\" id=\"a_2\">147<\/a>, <a href=\"\/doc\/763672\/\" id=\"a_3\">148<\/a>,<\/p>\n<p><a href=\"\/doc\/999134\/\" id=\"a_4\">149<\/a>, <a href=\"\/doc\/180217\/\" id=\"a_5\">506<\/a>, <a href=\"\/doc\/162506\/\" id=\"a_6\">447<\/a> IPC filed by the complainants against the accused-<\/p>\n<p>respondents, was dismissed.       The complainants have alleged that their<\/p>\n<p>uncle Luxmi Narayan had purchased the land measuring 2 kanal 13 marlas<\/p>\n<p>from the land 9 kanal 8 marla vide registered sale deed dated 23.4.1997 and<\/p>\n<p>become owner of that land.    Their uncle had sown the arhar crop on the<\/p>\n<p>said land. On 13.10.1997, at about 5.00 PM, when they were harvesting the<\/p>\n<p>crops, accused persons came there armed with lathis and jellies and asked<\/p>\n<p>them that they will teach the lesson for purchasing the land. Accused Shree<\/p>\n<p>Chand gave a jelly blow to Surender on his right hand. Blood was oozing<br \/>\n Criminal Misc. No. 710-MA of 2008 (O&amp;M)                          -2-\n<\/p>\n<p id=\"p_1\">\nand his right hand&#8217;s little finger was got fractured.    Accused Raj Kumar<\/p>\n<p>gave a lathi blow to Jogender and accused Suresh gave lathi blow on the<\/p>\n<p>back of Jogender.       Accused Roshan gave a lathi blow on the head of<\/p>\n<p>Jogender and accused Nos. 4 to 9 gave fist blows to the complainants. On<\/p>\n<p>raising alarm, Luxmi Narayan, Fateh Singh and Heera Lal came there and<\/p>\n<p>rescued them from the clutches of the accused persons. On 14.10.1997, the<\/p>\n<p>complainants were got medico-legally examined and X-ray was conducted<\/p>\n<p>on 23.10.1997.    The matter was reported to the police but no action was<\/p>\n<p>taken. Hence, the complaint was filed.\n<\/p>\n<p id=\"p_2\">             In   the    preliminary    evidence,   complainants       examined<\/p>\n<p>themselves as PW1 and PW2 and also examined Mangtu Ram PW3, Fateh<\/p>\n<p>Singh PW4, Luxmi Narayana PW5 and closed their preliminary evidence.<\/p>\n<p id=\"p_3\">             The accused were ordered to be summoned under <a href=\"\/doc\/1011035\/\" id=\"a_7\">sections 323<\/a>,<\/p>\n<p><a href=\"\/doc\/1133601\/\" id=\"a_8\">325<\/a>, <a href=\"\/doc\/37788\/\" id=\"a_9\">34<\/a> IPC by the trial court.\n<\/p>\n<p id=\"p_4\">             In pre-charge evidence, the complainants themselves appeared<\/p>\n<p>and also examined Fateh Singh PW1, Mangtu Ram PW2, Dr. Vinod Kumar<\/p>\n<p>PW3. The accused were charge sheeted under <a href=\"\/doc\/763672\/\" id=\"a_10\">sections 148<\/a>, <a href=\"\/doc\/1011035\/\" id=\"a_11\">323<\/a>, <a href=\"\/doc\/724142\/\" id=\"a_12\">324<\/a> IPC<\/p>\n<p>read with <a href=\"\/doc\/999134\/\" id=\"a_13\">section 149<\/a> IPC.\n<\/p>\n<p id=\"p_5\">             After charge, the complainants appeared for cross-examination<\/p>\n<p>and learned defence counsel states that he does not want to cross-examine<\/p>\n<p>the remaining witnesses after charge.\n<\/p>\n<p id=\"p_6\">             Learned trial court after appraisal of the evidence reached to the<\/p>\n<p>conclusion that no case for conviction is made out.        Consequently, the<\/p>\n<p>accused were acquitted.\n<\/p>\n<p id=\"p_7\">             Feeling dis-satisfied with the above said judgment, the<\/p>\n<p>complainants have preferred the present appeal.\n<\/p>\n<p id=\"p_8\"> Criminal Misc. No. 710-MA of 2008 (O&amp;M)                         -3-\n<\/p>\n<p id=\"p_9\">\n<p id=\"p_10\">            There is an application under <a href=\"\/doc\/100581\/\" id=\"a_14\">section 5<\/a> of the Limitation Act<\/p>\n<p>for condonation of delay of 556 days in filing the appeal.<\/p>\n<p id=\"p_11\">            The only ground taken in the application for condonation of<\/p>\n<p>delay is that the Clerk of the counsel for the complainants in the trial court<\/p>\n<p>has not informed the appellant about the preparation of the copy of the<\/p>\n<p>judgment. It cannot be believed that there could be delay of more than one<\/p>\n<p>and half years. No name of the Clerk of counsel for the complainants has<\/p>\n<p>been given nor affidavit of any Clerk has been placed on the file.      So no<\/p>\n<p>ground for condonation of delay is made out.\n<\/p>\n<p id=\"p_12\">            On merits also, from the perusal of medical evidence it is<\/p>\n<p>revealed that there was only one lacerated wound on the lateral aspect of left<\/p>\n<p>little finger, middle and terminal phalynx of Surender.       There was one<\/p>\n<p>abrasion on the left hand of Jogender and other two injuries were complaint<\/p>\n<p>of pain and there was no mark of injury.          The appellants wanted the<\/p>\n<p>conviction of nine persons for those two injuries.    Learned trial court has<\/p>\n<p>observed that the evidence produced by the prosecution is highly discrepant,<\/p>\n<p>as detailed in para no. 18 of the judgment. The trial court has elaborately<\/p>\n<p>dealt with each aspect of the case.      So, on merits also, no ground for<\/p>\n<p>interference is made out.   Consequently, the application for leave to appeal<\/p>\n<p>as well as appeal stands dismissed.<\/p>\n<pre id=\"pre_1\">\n\n\n                                                     ( K.C.
