No. 9 of 2008\n            =~=~=~=~=~=~=~=~=~=~=~=~=~==~=~=~=\n             Dated this the 9th day of April, 2008\n\n                         JUDGMENT\n<\/pre>\n<p id=\"p_1\">Barkath Ali, J:\n<\/p>\n<p id=\"p_1\">\n<p id=\"p_2\">      In this appeal under <a href=\"\/doc\/147367599\/\" id=\"a_1\">section 173<\/a> of the Motor Vehicles<\/p>\n<p>Act claimant in O.P.(MV) No.3513 of 2001 of the Motor<\/p>\n<p>Accidents Claims Tribunal, Thrissur            challenges the<\/p>\n<p>judgment and award of the Tribunal dated July 12, 2006<\/p>\n<p>awarding a compensation of Rs.35,400\/- for the loss caused<\/p>\n<p>to the claimant, on account of the injuries sustained by him<\/p>\n<p>in a motor accident.\n<\/p>\n<p id=\"p_3\">      2. The facts leading to this appeal, in brief, are these:-<\/p>\n<p>The claimant is a coolie, aged 24 at the time of the accident<\/p>\n<p>and used to earn 4,000\/- per month, according to him. On<\/p>\n<p>April 5, 2001 while he was cycling along Irrigation Canal<\/p>\n<p>Bridge at Nellai, a tempo van bearing registration No. KL-7-<\/p>\n<p>T 7896 came at a high speed and knocked him down. The<\/p>\n<p>claimant sustained very serious injuries. According to the<\/p>\n<p>claimant, the accident occurred due to the rash and<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">MACA 9\/2008                    2<\/span><\/p>\n<p>negligent driving of the offending tempo van by the first<\/p>\n<p>respondent. The first respondent as the driver, the second<\/p>\n<p>respondent as the owner and third respondent as the<\/p>\n<p>insurer of the offending tempo van are jointly and severely<\/p>\n<p>liable to pay the compensation to the claimant. The claimant<\/p>\n<p>claimed compensation of Rs.1,25,000\/-<\/p>\n<p id=\"p_4\">       3. Respondents 1 and 2, the driver and owner of the<\/p>\n<p>offending vehicle remained absent and were set ex parte by<\/p>\n<p>the Tribunal. The third respondent, insurer of the offending<\/p>\n<p>vehicle, filed a written statement, admitting the policy.<\/p>\n<p id=\"p_5\">       4. Exts. A1 to A9 were marked on the side of the<\/p>\n<p>claimant. Exts.B1 to B3 were marked on the side of the<\/p>\n<p>contesting    third   respondent.   The    Tribunal,  on   an<\/p>\n<p>appreciation of the evidence, awarded a compensation of<\/p>\n<p>Rs.35,400\/- with interest at the rate of 7% p.a. from the date<\/p>\n<p>of petition till realization with proportionate cost. The<\/p>\n<p>claimant has come up in appeal, challenging the quantum of<\/p>\n<p>compensation awarded by the Tribunal.\n<\/p>\n<p id=\"p_6\">       5. Heard the learned counsel for the claimant and<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">MACA 9\/2008                    3<\/span><\/p>\n<p>learned counsel for the Insurance Company.<\/p>\n<p id=\"p_7\">      6. The accident is not disputed. The finding of the<\/p>\n<p>Tribunal that the accident occurred due to the negligence<\/p>\n<p>on the part of the first respondent is not challenged in this<\/p>\n<p>appeal. Therefore, the only question for consideration is<\/p>\n<p>whether the claimant is entitled to any enhanced<\/p>\n<p>compensation.\n<\/p>\n<p id=\"p_8\">      7. The claimant sustained the following injuries, as<\/p>\n<p>revealed from Ext.A3 copy of the wound certificate :-<\/p>\n<blockquote id=\"blockquote_1\"><p>      1) Fracture shaft of right femur.<\/p>\n<\/blockquote>\n<blockquote id=\"blockquote_1\"><p>      2) Superficial injuries frontal region.<\/p>\n<\/blockquote>\n<blockquote id=\"blockquote_2\"><p>      3) Incised wound 1 x 5 c.m.<\/p><\/blockquote>\n<p id=\"p_9\">\n<p id=\"p_10\">      8. The Tribunal awarded a total compensation of<\/p>\n<p>Rs.35,400\/-. Break up of the compensation awarded is as<\/p>\n<p>under:-\n<\/p>\n<pre id=\"pre_1\">      Loss of earning                    :   Rs.Rs.6,000\/-\n      Transportation                     :   Rs.500\/-\n      Extra nourishment                  :   Rs.500\/-\n      Damage to clothing                 :   Rs.500\/-\n      Treatment expenses                 :   Rs.900\/-\n      By-stander's expenses              :   Rs.2,000\/-\n      Pain and sufferings                :   Rs.10,000\/-\n\n<span class=\"hidden_text\" id=\"span_2\">MACA 9\/2008                   4<\/span>\n\n       Discomfiture                      :    Rs.8,000\/-\n       Loss of amenities                 :    Rs.7,000\/-\n       and enjoyment of life.\n                                              ------------------\n           Total                         :    Rs.35,400\/-\n                                              =======\n\n<\/pre>\n<p id=\"p_11\">       9. The learned counsel for the appellant has mainly<\/p>\n<p>sought enhancement of compensation for the loss of<\/p>\n<p>amenities and enjoyment in life and for discomfiture. Ext.A6<\/p>\n<p>certificate shows that the claimant has suffered shortening<\/p>\n<p>of right lower limb and limitation of joints movements at the<\/p>\n<p>right knee. Taking into consideration all these aspects for<\/p>\n<p>the disability caused, we feel that a compensation of<\/p>\n<p>Rs.12,000\/- would be reasonable. Thus, on this count the<\/p>\n<p>claimant is entitled to an additional compensation of<\/p>\n<p>Rsw.4,000\/-.\n<\/p>\n<p id=\"p_12\">       10. The Tribunal awarded Rs7,000\/- for the loss of<\/p>\n<p>amenities and enjoyment in life. Having regard to the fact<\/p>\n<p>that the claimant has suffered shortening of right lower<\/p>\n<p>limb, we feel that a compensation of Rs.15,000\/- would be<\/p>\n<p>reasonable on this count. Therefore, towards loss of<\/p>\n<p><span class=\"hidden_text\" id=\"span_3\">MACA 9\/2008                   5<\/span><\/p>\n<p>amenities and enjoyment of life, the claimant is entitled to<\/p>\n<p>an additional compensation of Rs.8,000\/-. As regards the<\/p>\n<p>compensation awarded under other heads, we find the same<\/p>\n<p>to be reasonable and therefore, we are not disturbing the<\/p>\n<p>same.\n<\/p>\n<p id=\"p_13\">      11. In the result, the claimant is entitled to an<\/p>\n<p>additional compensation of Rs.12,000\/- . He is entitled to<\/p>\n<p>interest @ 9% from the date of petition till realization and<\/p>\n<p>proportionate cost. The third respondent, being the insurer<\/p>\n<p>of the offending tempo van shall deposit the amount within<\/p>\n<p>two months from the date of receipt of a copy of this<\/p>\n<p>judgment with notice to the claimant.
