Justice ANTONY DOMINIC\n\n Dated :05\/02\/2008\n\n O R D E R\n<\/pre>\n<p id=\"p_1\">                       ANTONY DOMINIC, J.\n<\/p>\n<p id=\"p_1\">                     &#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;-\n<\/p>\n<p id=\"p_2\">                        W.P.(C)3326\/2008\n<\/p>\n<p id=\"p_3\">                     &#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;-\n<\/p>\n<p id=\"p_4\">              Dated this the 5th day of February 2008<\/p>\n<p>                             Judgment<\/p>\n<p>      Variation of permit was granted to the petitioner by Ext.P3.<\/p>\n<p>However, as against the request for Limited Stop Ordinary<\/p>\n<p>Service (LSOS), the variation granted was as ordinary service.<\/p>\n<p>An appeal was filed against the order limiting the variation of<\/p>\n<p>regular permit as ordinary service and the matter was remanded<\/p>\n<p>by Ext.P4. By the time, the matter was remanded, a new draft<\/p>\n<p>modification dated 9.5.2007 had come into force. In view of the<\/p>\n<p>overlapping on the notified route, while considering the matter<\/p>\n<p>afresh, the RTA by Ext.P6 revoked the variation granted. This is<\/p>\n<p>obviously in terms of the provisions contained in the aforesaid<\/p>\n<p>notification. The petitioner again challenged the decision of the<\/p>\n<p>RTA before the Tribunal and the matter was again considered by<\/p>\n<p>the Tribunal. In Ext.P8, the Tribunal took the view that the RTA<\/p>\n<p>while considering the request was bound by the draft notification<\/p>\n<p>dated 9.5.2007 and therefore has rightly revoked the grant itself.<\/p>\n<p id=\"p_5\">      2. Counsel for the petitioner contends that when the<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">W.P.(C)3326\/2008              2<\/span><\/p>\n<p>remand was limited to the question of confining the grant of<\/p>\n<p>extension as ordinary service, the RTA should not have revoked<\/p>\n<p>the variation granted. I am not in a position to agree with the<\/p>\n<p>learned counsel for the writ petitioner. Though the permit was<\/p>\n<p>granted before the notification dated 9.5.2007 was issued, the<\/p>\n<p>fact remains that the matter was reconsidered by the RTA only<\/p>\n<p>on 7.8.2007 which is much after the notification had come into<\/p>\n<p>force. If that be so, the RTA could not have violated the terms of<\/p>\n<p>the notification. That apart, the notification only saves the<\/p>\n<p>existing operators as on or prior 18.4.2007 and as the petitioner<\/p>\n<p>was not an existing operator, he is not entitled to the benefits of<\/p>\n<p>the saving clause. If that be so, the view taken by the Tribunal<\/p>\n<p>cannot be faulted with.\n<\/p>\n<p id=\"p_6\">       The writ petition fails.
