RAMKUMAR, J.\n\n                                 - - - - - - - - - - - - - - - - -\n\n                           Bail Application No. 7238 of 2006\n\n                                  - - - - - - - - - - - - - - - -\n\n                                    DATED: 12-12-2006\n\n\n                                           O R D E R\n<\/pre>\n<p id=\"p_1\">        In this Petition filed under Sec. 438 <a href=\"\/doc\/445276\/\" id=\"a_1\">Cr.P.C<\/a>. the petitioner who is the sole<\/p>\n<p>accused in Crime No.  164\/04  of Thrikkunnappuzha  Police Station for  offences<\/p>\n<p>punishable   under   <a href=\"\/doc\/390591\/\" id=\"a_1\">Sections   55(a)<\/a>   and   (g)   read   with   Sec.   8(1)   and   8(2)   of   the<\/p>\n<p>Abkari Act for allegedly having been found in possession of 20 liters of wash and<\/p>\n<p>5 liters of illicit arrack on 12-11-2004,   seeks anticipatory Bail.<\/p>\n<p id=\"p_1\">        2.      Consequent   on     the   non-appearance   of   the   petitioner   before   the<\/p>\n<p>committal   court   namely,   J.F.C.M.-I,   Haripad   in   C.P.   100\/06,   admittedly,   non-<\/p>\n<p>bailable warrant of arrest  are pending against the petitioner.   Anticipatory bail<\/p>\n<p>cannot   be   granted   to   nullify   the   process   issued   by   a   court   of   competent<\/p>\n<p>jurisdiction.  There is no reason why the petitioner should not seek regular bail<\/p>\n<p>after   surrendering   before   the     magistrate   concerned.
