DENESAN, J.\n\n\n\n                 = = = = = = = = = = = = = = =\n\n                  W.P.(C) No. 4492 OF 2005 I\n\n                 = = = = = = = = = = = = = = =\n\n\n\n               Dated this the 1st January, 2007\n\n\n\n                          J U D G M E N T\n<\/pre>\n<p id=\"p_1\">     Challenge   is   to   Ext.   P2   order   passed   by   the<\/p>\n<p>Government   rejecting   the   request   of   the   petitioner   to<\/p>\n<p>grant   her   pensionary   benefits,   if   any,   as   per   the<\/p>\n<p>directions   issued   by   this   Court   in   Ext.   P4   judgment.\n<\/p>\n<p id=\"p_1\">She has sought for a declaration to make available the<\/p>\n<p>benefits granted to one Smt. T.P. Clara who had worked<\/p>\n<p>as   Casual   Female   Warden   along   with   the   petitioner   on<\/p>\n<p>the ground that she is similarly placed.\n<\/p>\n<p id=\"p_2\">     2.   The   petitioner   has   got   to   her   credit   temporary<\/p>\n<p>service   on   daily   wage   basis   for   a   period   of   about   38<\/p>\n<p>years.     Posts  were  sanctioned  in  1998,  and  immediately<\/p>\n<p>thereafter,   candidates   appointed   by   the   P.S.C.   joined<\/p>\n<p>duty   on   regular   basis.     At   that   stage,   the   petitioner<\/p>\n<p>and   some   others   approached   this   Court   with   the   prayer<\/p>\n<p>that   the   respondents   ought   to   have   regularised     their<\/p>\n<p>services   and   having   regard   to   the   service   already<\/p>\n<p>rendered,   they   shall   be   granted   the   pensionary<\/p>\n<p>benefits.  A learned Single Judge of this Court allowed<\/p>\n<p>the   writ   petition.     However,   the   Division   Bench   in<\/p>\n<p>appeal   reversed   the   judgment   of   the   learned   Single<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">WPC No.4492 \/2005                              -2-<\/span><\/p>\n<p>Judge as seen from Ext. P4 holding that the appointment<\/p>\n<p>of   the   petitioner   cannot   be   treated   as   a   regular   one<\/p>\n<p>since   the   materials   placed   for   consideration   were<\/p>\n<p>insufficient   to   treat   the   appointment   as   regular.     A<\/p>\n<p>distinction          was         drawn          between         similarly         placed<\/p>\n<p>employees   in  whose  cases  service  books  were  opened  and<\/p>\n<p>the case of the petitioner who did not have the benefit<\/p>\n<p>of   a   service   book.     It   was   held   that   the   petitioner<\/p>\n<p>cannot   claim   the   benefit   of   regularisation   in   service.\n<\/p>\n<p id=\"p_3\">However,   the   Division   Bench   observed   vide   paragraph   5<\/p>\n<p>of Ext. P4 as follows:\n<\/p>\n<blockquote id=\"blockquote_1\"><p>            &#8220;We   find   all   the   same   the   matter<\/p>\n<p>      requires   consideration   at   the   hands   of   the<\/p>\n<p>      Government and decide as to whether any other<\/p>\n<p>      relief  can   be   given   to   them   considering   the<\/p>\n<p>      fact   that   they   were   engaged   on   daily   wages<\/p>\n<p>      for quite some time.   In such circumstances,<\/p>\n<p>      without   examining   the   matter   on   merits   we<\/p>\n<p>      leave   the   matter   to   the   Government   to<\/p>\n<p>      consider the requests made by the petitioners<\/p>\n<p>      in these cases and pass appropriate orders in<\/p>\n<p>      accordance with law within a period of three<\/p>\n<p>      months from the date of receipt of a copy of<\/p>\n<p>      this judgment.&#8221; (emphasis supplied)<\/p>\n<\/blockquote>\n<blockquote id=\"blockquote_1\"><p>     3.   Thereafter   Ext.   P2   order   was   passed   in   the<\/p>\n<p>following lines:\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_2\">\n<\/blockquote>\n<blockquote id=\"blockquote_3\"><p>           &#8220;I   am   to   invite   your   attention   to   the<\/p>\n<p>     reference   cited.     Government   have   considered<\/p>\n<p>     the   observations   made   by   the   Hon&#8217;ble   High<\/p>\n<p>     Court   in   the   Judgment   cited.     As   per   the<\/p>\n<p>     existing   rules,   there   is   no   provision   for<\/p>\n<p>     regularizing   the   appointment   of   daily   rated<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">WPC No.4492 \/2005                        -3-<\/span><\/p>\n<p>     employees   in   Government   service.     Persons<\/p>\n<p>     appointed   on   daily   wages   basis   are   not<\/p>\n<p>     eligible   for   any   service   benefits   apart   from<\/p>\n<p>     the   wage   as   prescribed   by   Government   from<\/p>\n<p>     time to time.   Also there is no provision in<\/p>\n<p>     the  existing  rules  to  grant  any  other  relief<\/p>\n<p>     such   as   pensionary   benefits   to   the   persons<\/p>\n<p>     were   engaged   on   daily   wages   for   quite   some<\/p>\n<p>     time.  In the circumstances, I am directed to<\/p>\n<p>     inform          you         that         your          request                for<\/p>\n<p>     regularization of appointment is rejected.&#8221;<\/p>\n<\/blockquote>\n<blockquote id=\"blockquote_4\"><p>It is evident from Ext. P2 that the Government have not<\/p>\n<p>considered   the   case   of   the   petitioner   in   the<\/p>\n<p>perspective   in   which   the   Division   Bench   wanted   the<\/p>\n<p>Government to deal with the case of the petitioner and<\/p>\n<p>similarly   placed   persons.     Learned   counsel   for   the<\/p>\n<p>petitioner           submits          that           though         a         plea             for<\/p>\n<p>regularisation   in  service  cannot  be  put  forward  by  the<\/p>\n<p>petitioner,   it   is   open   to   the   Government   to   take   into<\/p>\n<p>consideration   the   peculiar   situation   in   which   she   is<\/p>\n<p>placed   and   having   regard   to   the   length   of   service<\/p>\n<p>rendered   by   her,   to   pass   orders   granting   &#8220;any   other<\/p>\n<p>reliefs&#8221; made mention by the Division Bench in Ext. P4<\/p>\n<p>judgment.<\/p><\/blockquote>\n<p id=\"p_4\">     4.   I   have   heard   the   Govt.   Pleader   for   the<\/p>\n<p>respondent.\n<\/p>\n<p id=\"p_5\">     5. Since that has not been done, Ext. P2 is liable<\/p>\n<p>to be set aside.   Ext. P2 order deals with the case of<\/p>\n<p><span class=\"hidden_text\" id=\"span_2\">WPC No.4492 \/2005                             -4-<\/span><\/p>\n<p>the petitioner in a routine manner.   This Court should<\/p>\n<p>be   presumed   to   have   taken   note   of   the   fact   that   the<\/p>\n<p>petitioner will not be entitled for pensionary benefits<\/p>\n<p>had her case  been dealt with strictly according to the<\/p>\n<p>rules   in   force.     The   fact   that   the   Division   Bench<\/p>\n<p>observed   that   the   petitioner&#8217;s   claim   for   any   other<\/p>\n<p>benefit          can         be         considered         by         the         Government,<\/p>\n<p>necessarily   postulates   that   even   in   the   absence   of<\/p>\n<p>rules,   the   Government   will   have   the   right   to   show   due<\/p>\n<p>indulgence   to  the  petitioner  and  pass  orders  which  the<\/p>\n<p>Government would feel appropriate.\n<\/p>\n<p id=\"p_6\">        6.     The   respondent   has   not   considered   the   case   of<\/p>\n<p>the   petitioner   as   directed   by   the   Division   Bench   in<\/p>\n<p>Ext.   P4   judgment.     Hence,   I   set   aside   Ext.   P2.     The<\/p>\n<p>case   of   the   petitioner   shall   be   considered   by   the<\/p>\n<p>respondent   and  fresh  orders  passed  within  six  weeks  on<\/p>\n<p>receipt of a copy of the judgment.\n<\/p>\n<p id=\"p_7\">        The writ petition is disposed of as above.\n<\/p>\n<p id=\"p_8\">                                                                       K.K.
