The Applicant filed an RTI application dt.5.7.07 with the CPIO, SR, Palghat.\n<\/p>\n<p id=\"p_1\">      He stated that he had parked his Hero Honda Splender Motor Bike at<br \/>\n      Koyilandy Railway Station vehicle parking centre at 12.00 hrs on 4.7.06 vide<br \/>\n      receipt No.25 dt.4.7.06 and approached the said centre for taking the bike at<br \/>\n      17.30 hrs on the same day but to his dismay the bike was untraceable at the<br \/>\n      parking area. He had complained to the Station Master, Koyilandy on 5.7.06<br \/>\n      and Sr. Divisional Manager (Commercial) on 28.2.07 but there were no words<br \/>\n      from them.      He wants the matter to be investigated besides affecting the<br \/>\n      compensation. The CPIO replied on 11.7.07 stating that on verification of the<br \/>\n      application, it is noticed that the matter contained therein is like a public<br \/>\n      complaint rather than seeking information. However, on verifying the matter<br \/>\n      with the concerned section, it is learnt that the matter is pending before<br \/>\n      Hon&#8217;ble Consumer Forum and Railway is not an opposite party as per<br \/>\n      contractual agreement. Hence no correspondence has been made as a matter<br \/>\n      of sub-judice.    Not satisfied with the reply, the Applicant filed an appeal<br \/>\n      dt.17.8.07 with the Appellate Authority.   The Appellate Authority replied on<br \/>\n      12.10.07 stating that     the Applicant has filed a complaint before Hon&#8217;ble<br \/>\n      Consumer Forum, Kannur with the Contractor and Station Master, Quilandy as<br \/>\n      opposite parties.    Since the responsibility vests with the Contractor, it is<br \/>\n      requested to take up the matter with him and any further attempt to interfere<br \/>\n      at this stage would not be correct since the matter is sub-judice. Aggrieved<br \/>\n      with the reply, the Applicant filed a second appeal dt.23.4.08 before CIC<br \/>\n      requesting the Commission to authorize the Railway to compensate for the<br \/>\n      lost vehicle.\n<\/p>\n<p id=\"p_2\">2.    The Bench of Mrs. Annapurna Dixit, Information Commissioner, scheduled the<br \/>\n      hearing on May 15, 2009.\n<\/p>\n<p id=\"p_3\">3.    Both the Respondent and Appellant were absent at the hearing.\n<\/p>\n<p id=\"p_4\">Decision<\/p>\n<p id=\"p_5\">4.    The Commission observed that the Appellant is not seeking any information<br \/>\n      and holds that directing the Railways to pay him compensation is beyond the<br \/>\n      purview of the <a href=\"\/doc\/671631\/\" id=\"a_1\">RTI Act<\/a>.\n<\/p>\n<p id=\"p_6\"> 5.
