Justice THOMAS P.JOSEPH\n\n Dated :16\/11\/2010\n\n O R D E R\n                    THOMAS P.JOSEPH, J.\n            ====================================\n                      O.P(C) No.740 of 2010\n            ====================================\n         Dated this the 16th     day of November,      2010\n\n\n                           J U D G M E N T\n<\/pre>\n<p id=\"p_1\">       This petition is filed by the plaintiffs in O.S.No.15 of 2008 of<\/p>\n<p>the court of learned Sub Judge, Palakkad aggrieved by Ext.P7, a<\/p>\n<p>single word order whereby the learned Sub Judge has allowed the<\/p>\n<p>application for impleadment made by the respondent under Rule<\/p>\n<p>10(2) of Order I of the Code of Civil Procedure (for short, &#8220;the<\/p>\n<p>Code&#8221;). According to the petitioners they are the legal heirs of<\/p>\n<p>Aiyya Pattar to whom the suit property &#8211; 7.97 acres belonged. It is<\/p>\n<p>the case of petitioners that Aiyya Pattar had given on lease certain<\/p>\n<p>other items belonging to him to one Mallu. Petitioners and other<\/p>\n<p>legal heirs of Aiyya Pattar filed O.S. No.337 of 1989 for partition of<\/p>\n<p>the suit property impleading one Retna Babu also as defendant<\/p>\n<p>since he claimed right over property. Regarding the claim of<\/p>\n<p>Retna Babu over the suit property, the suit was decreed for<\/p>\n<p>partition among the other legal heirs of Aiyya Pattar.       Decree in<\/p>\n<p>O.S. No.337 of 1989 has become final and was put into execution.<\/p>\n<p>In the meantime Retna Babu filed O.S. No.267 of 1989 for specific<\/p>\n<p>performance of an alleged agreement for sale of a share of the suit<\/p>\n<p>O.P(C) No.740 of 2010<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                 -: 2 :-<\/span><\/p>\n<p>property against some other legal heirs of Aiyya Pattar. That suit<\/p>\n<p>ended in a dismissal and that has become final. In the course of<\/p>\n<p>execution of decree in O.S. No.337 of 1989 respondent herein<\/p>\n<p>made a claim that the suit property was also leased out by Aiyya<\/p>\n<p>Pattar to Mallu from whom he got it on          sub lease.   That<\/p>\n<p>application was opposed by petitioners and other legal heirs of<\/p>\n<p>Aiyya Pattar. Executing court dismissed that application which<\/p>\n<p>the respondent challenged in appeal (Ex.F.A. No.38 of 2010). This<\/p>\n<p>Court by Ext.P3, judgment dated 21.10.2010 set aside the order<\/p>\n<p>(Ext.P2) and remitted the matter to the executing court for fresh<\/p>\n<p>decision after giving both sides opportunity to adduce evidence.<\/p>\n<p>Claim made by the respondent in E.P. No.76 of 2008 in O.S.<\/p>\n<p>No.337 of 1989 is pending consideration of the executing court.<\/p>\n<p>In the meantime petitioners filed O.S. No.15 of 2008 for recovery<\/p>\n<p>of possession of the suit property from Retna Babu. Respondent<\/p>\n<p>filed I.A. No.2260    of 2009 in O.S.No.15 of 2008 for his<\/p>\n<p>impleadment obviously on the claim that he is a sub lessee of<\/p>\n<p>the suit property from Mallu who allegedly got a lease of the<\/p>\n<p>property from Aiyya Pattar. Though that application was resisted<\/p>\n<p>by petitioners learned Sub Judge as aforesaid by a single word<\/p>\n<p>order allowed the application.        Learned Senior Advocate<\/p>\n<p>O.P(C) No.740 of 2010<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                 -: 3 :-<\/span><\/p>\n<p>appearing for petitioners    contended that respondent is not a<\/p>\n<p>necessary party in O.S. No.15 of 2008 and that at any rate the<\/p>\n<p>order is passed without taking into account objection raised by<\/p>\n<p>petitioners and without application of mind.\n<\/p>\n<p id=\"p_1\">      2.     No doubt, learned Sub Judge has not passed a<\/p>\n<p>speaking order and passed the order &#8220;allowed&#8221;.           It is quite<\/p>\n<p>unfortunate that such a non-speaking order was passed. Parties<\/p>\n<p>and the superior courts before which the order is challenged are<\/p>\n<p>entitled to know the reason for the subordinate court passing the<\/p>\n<p>order. Learned Sub Judge ought to have passed a speaking order<\/p>\n<p>taking into account the contentions raised by the parties. But<\/p>\n<p>having regard to the facts and circumstances of the case I do not<\/p>\n<p>think it necessary to remit the case to direct learned Sub Judge<\/p>\n<p>pass a speaking order if otherwise the matter could be disposed<\/p>\n<p>of in this proceeding. Petitioners filed O.S. No.15 of 2008 against<\/p>\n<p>Retna Babu whose suit for specific performance of the agreement<\/p>\n<p>has been dismissed and that dismissal has become final and with<\/p>\n<p>him also on the party array in O.S. No.337 of 1989 there is a<\/p>\n<p>confirmed verdict for partition of the suit property.      Question<\/p>\n<p>whether respondent      has any right, interest or possession of<\/p>\n<p>whole or any portion of the suit property is pending consideration<\/p>\n<p>O.P(C) No.740 of 2010<br \/>\n<span class=\"hidden_text\" id=\"span_2\">                                 -: 4 :-<\/span><\/p>\n<p>of the executing court in O.S. No.337 of 1989. It is in such a<\/p>\n<p>situation that respondent has sought impleadment in O.S. No.15<\/p>\n<p>of 2008. Assuming that he is not a necessary party, it cannot be<\/p>\n<p>said that he is not a proper party to O.S. No.15 of 2008. For, he<\/p>\n<p>has made a claim in E.P. No.76 of 2008 in O.S. No.337 of 1989<\/p>\n<p>which is yet to be decided by the executing court and in that<\/p>\n<p>situation if without the respondent also as party in O.S. No.15 of<\/p>\n<p>2008 that suit is disposed of there is possibility of divergent<\/p>\n<p>findings regarding possession being entered by the courts in the<\/p>\n<p>respective proceedings. In these circumstances respondent is a<\/p>\n<p>proper party in O.S. No.15 of 2008 and hence I find no reason to<\/p>\n<p>interfere with the impugned order notwithstanding that it is not a<\/p>\n<p>speaking order.\n<\/p>\n<p id=\"p_2\">      3.     Learned Senior Advocate     submitted    that since in<\/p>\n<p>view of impleadment of respondent question of possession and<\/p>\n<p>right that he may raise in that suit is also involved in E.P. No.76<\/p>\n<p>of 2008 in O.S. No.337 of 1989 and hence it may be appropriate<\/p>\n<p>to stay the trial of O.S. No.15 of 2008 until disposal of the claim<\/p>\n<p>made by respondent in E.P. No.76 of 2008 in O.S.No.337 of 1989<\/p>\n<p>and hence     petitioners may be permitted to move appropriate<\/p>\n<p>application for stay in O.S. No.15 of 2008. I make it clear that if<\/p>\n<p>O.P(C) No.740 of 2010<br \/>\n<span class=\"hidden_text\" id=\"span_3\">                                 -: 5 :-<\/span><\/p>\n<p>the law so provides it will be open to the petitioners to move<\/p>\n<p>appropriate application in that regard in O.S. No.15 of 2008 and<\/p>\n<p>seek appropriate relief as provided under law.<\/p>\n<p id=\"p_3\">     With the above observation petition is dismissed.<\/p>\n<p id=\"p_4\">                                 THOMAS P.
