After a prolonged<\/p>\n<p>legal battle, he was sanctioned pension under the<\/p>\n<p>Swatantrata Sainik Samman Pension Scheme of the Central<\/p>\n<p>Government (S.S.S.P.).          But the pension was sanctioned<\/p>\n<p>only with effect from 07.08.2005, although the petitioner<\/p>\n<p>had filed an application for pension under the Swatantrata<\/p>\n<p>Sainik Samman Pension Scheme on 24.05.1998 and the 2nd<\/p>\n<p>respondent acknowledged it on 05.01.1999. It is under the<\/p>\n<p>above circumstances the petitioner has filed this writ<\/p>\n<p>petition seeking the following reliefs:<\/p>\n<blockquote id=\"blockquote_1\"><p>      i.  issue a writ of mandamus directing the respondent to<br \/>\n          sanction pension under the S.S.S. Pension Scheme from<br \/>\n          5-1-99 to the petitioner and pay the arrears accordingly<br \/>\n          till 7-8-2005 within a time schedule to be fixed by this<br \/>\n          Hon&#8217;ble Court.<\/p><\/blockquote>\n<p id=\"p_1\">\n<p id=\"p_2\">     2.   A Division Bench of this court in 2005 (4) KLT 27<\/p>\n<p>has held that pension should be given to the applicant from<\/p>\n<p>the date on which the original application was received<\/p>\n<p>irrespective of whether the application is filed with or<\/p>\n<p>W.P.(C)No. 31144 of 2009<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                               -2-<\/span><\/p>\n<p>without requisite evidence. The sanction of pension would<\/p>\n<p>however be subject to the requisite proof in support of the<\/p>\n<p>claim.      The relevant date is the date on which the<\/p>\n<p>application was received by the authorities. Here, already<\/p>\n<p>petitioner&#8217;s claim for pension has been sanctioned by Ext.P5<\/p>\n<p>order. Therefore, the arrears of pension have to be paid<\/p>\n<p>with effect from the date of receipt of the application,<\/p>\n<p>namely 05.01.1999. Accordingly I hold that the petitioner is<\/p>\n<p>entitled to pension under the S.S.S.P. Scheme pursuant to<\/p>\n<p>Ext.P5, with effect from 05.01.1999.         Accordingly the<\/p>\n<p>respondent is directed to pay arrears of pension under the<\/p>\n<p>S.S.S.P. Scheme to the petitioner with effect from<\/p>\n<p>05.01.1999. The arrears shall be disbursed to the petitioner<\/p>\n<p>within three months from the date of receipt of a copy of<\/p>\n<p>this judgment.\n<\/p>\n<p id=\"p_3\">      The writ petition is disposed of as above.<\/p>\n<p id=\"p_4\">                                                S.
