(J)\n\nCITATION:\n 1996 SCALE  (5)824\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p id=\"p_1\">\t\t\t O R D E R<br \/>\n     The appellant, the aggrieved party in these two special<br \/>\nappeals, was  granted\/leave limited  to the  question as  to<br \/>\nwhether the  learned Single  Judge of  the  High  Court\t was<br \/>\njustified in  passing strictures  against the  appellant. On<br \/>\nmerit of the matter, the fate of the cases stands sealed.\n<\/p>\n<p id=\"p_1\">     The reference  to the  appellant in the judgment of the<br \/>\nlearned Single\tJudge is in two capacities : (i) as a party-<br \/>\nrespondent connected with the merits of the matter; and (ii)<br \/>\nhis brooding  presence as  a Minister  of the  time to\thave<br \/>\ninfluenced the\tdecision-making of  the\t Land  Tribunal,  it<br \/>\nbeing a\t land reforms  matter. The  learned Single  Judge in<br \/>\nparagraph 4 of his judgment observed as follows :\n<\/p>\n<blockquote id=\"blockquote_1\"><p>     &#8220;But, in this case it appears to me<br \/>\n     that    the    regular    procedure<br \/>\n     prescribed by  the Land Reforms Act<br \/>\n     for conferring  occopation\t of  the<br \/>\n     lands immediately prior to 1.8.1974<br \/>\n     had been abused by the Chairman and<br \/>\n     the  members  of  the  Tribunal  to<br \/>\n     casue   wilful    loss    to    the<br \/>\n     petitioners and  they did\tnot have<br \/>\n     the courage of their convictions to<br \/>\n     stand up  to  the\tmachinations  of<br \/>\n     respondent\t &#8211;   3\t(the   appellant<br \/>\n     herein)  who   was\t  admittedly   a<br \/>\n     Minister of the State Government at<br \/>\n     the   relevant   time.&#8221;   (emphasis<br \/>\n     supplied)<br \/>\n     On appeal\tto the\tDivision Bench\tof the High Court at<br \/>\nthe instance of the appellant, the Division Bench in para 31<br \/>\nof its judgment observed as follows :\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_1\"><p>     &#8220;As earlier  observed,  we\t do  not<br \/>\n     find any  direct evidence\tto  hold<br \/>\n     that the  impugned order was passed<br \/>\n     by the  Tribunal at  the behest  of<br \/>\n     the  appellant  who  exercised  his<br \/>\n     influence on  them. But  the  facts<br \/>\n     and circumstances of the case leave<br \/>\n     no manner\tof doubt  that after the<br \/>\n     passing  of   a   decree\tin   the<br \/>\n     partition suit, a determined effort<br \/>\n     which was\twithin the  knowledge of<br \/>\n     the appellant,  was made  to defeat<br \/>\n     the claim of Naikwadi family, which<br \/>\n     in\t   our\t   view\t   was\t  wholly<br \/>\n     unjustified.&#8221;\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_2\"><p>     The Bench further observed in paragraph 37 as follows :<br \/>\n     &#8220;Having arrived  at  the  aforesaid<br \/>\n     conclusion,  one\tquestion   still<br \/>\n     remains  to   be\tanswered   i.e.,<br \/>\n     whether respondent\t &#8211; 3 (appellant)<br \/>\n     exerted  his  extra  constitutional<br \/>\n     power and\tinfluence on the members<br \/>\n     of the  Tribunal who  yielded &#8211;  to<br \/>\n     such influence.  On this aspect, it<br \/>\n     was very  fairly  conceded\t by  Mr.<br \/>\n     Bannurmath, learned counsel for the<br \/>\n     writ   petitioners, that  there was<br \/>\n     no evidence  to  prove  any  direct<br \/>\n     link  between   the  appellant  and<br \/>\n     members of\t the Tribunal. Even  we,<br \/>\n     after   going   through   all   the<br \/>\n     relevant evidence\tfind that  there<br \/>\n     is no  positive direct  evidence to<br \/>\n     prove the\texervising of  the extra<br \/>\n     constitutional power  and influence<br \/>\n     on the  members  of  the  Tribunal.<br \/>\n     That being\t so, the  next\tquestion<br \/>\n     that   arises   for   consideration<br \/>\n     whether there is any circumstantial<br \/>\n     evidence on the basis of which such<br \/>\n     an inference  can be  drawn. In our<br \/>\n     view on the facts and circumstances<br \/>\n     of this  case, it would be too much<br \/>\n     stretching to  hold that to procure<br \/>\n     the   impugned    order   such   an<br \/>\n     influence\twas   exerted\tby   the<br \/>\n     appellant\t(respondent-3)\thimself.<br \/>\n     The facts of the case do reveal the<br \/>\n     revival of\t interest of respondents\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_3\"><p>     &#8211; 3  in the land in dispute and the<br \/>\n     determined\t effort\t of  Smt.  Aruna<br \/>\n     Devi to  deny the possession of the<br \/>\n     Naikwadi family  and  defeat  their<br \/>\n     claim. But\t these\tfacts  plus  the<br \/>\n     fact that\trespondent  &#8211;  3  was  a<br \/>\n     Minister in  the State  cabinet  by<br \/>\n     themselves, in  our opinion  do not<br \/>\n     lead to  a positive conclusion that<br \/>\n     the impugned  order is  the outcome<br \/>\n     of\t  the\t exercise   of\t  extra-\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_4\"><p>     constitutional power  and influence<br \/>\n     on the members of the Tribunal, yet<br \/>\n     suspicion is left unerased that the<br \/>\n     impugned order may have been passed<br \/>\n     to please\trespondent-3 or\t at  his<br \/>\n     behest.&#8221;<\/p><\/blockquote>\n<blockquote id=\"blockquote_5\"><p>     We have  been taken through the other relevant portions<br \/>\nof the judgments of the learned Single Judge as well as that<br \/>\nof the\tDivision Bench\twhich reflect  on the conduct of the<br \/>\nappellant in  his capacity  as a  litigant, for\t it was\t his<br \/>\nlands which  were being\t subjected to  the provisions of the<br \/>\nrelevant Land  Reforms Act.  His conduct as a litigant could<br \/>\ndefinitely be  commented upon by the courts and that part of<br \/>\nthe order  would have  to sustain, for expunction of remarks<br \/>\ncannot be  sought by  a litigant  if those were legitimately<br \/>\nmade from  the conclusions  and inferences drawn by a court.\n<\/p><\/blockquote>\n<p id=\"p_2\">But, here  we have his name as a Minister brought in to cast<br \/>\na shadow  on the  merits of  the matters and this is a pinch<br \/>\nunbearable to the appellant.\n<\/p>\n<p id=\"p_3\">     It is evident from the afore=extracted passage from the<br \/>\njudgment of  the learned Single Judge that the spelled out a<br \/>\ndirect nexus  between the  conduct of  the  members  of\t the<br \/>\nTribunal and  the appellant being a Minister at the relevant<br \/>\ntime. The Division Bench however could not sustain that view<br \/>\nof the\tSingle Bench  as is  evident  from  the\t two  afore-<br \/>\nextracted passages  from its  judgment. It  has been  viewed<br \/>\nthat there was neither direct nor circumstantial evidence to<br \/>\nprove any nexus between the appellant and the members of the<br \/>\ntribunal, The finding was dressed down to be described as an<br \/>\n&#8216;usnerased suspicion&#8217;  that the impugned order may have been<br \/>\npassed to  please respondent  No.3 (the appellant) or at his<br \/>\nbehest. On  such  infirm  and  shaky  finding,\twe  are\t not<br \/>\nprepared to  sustain the  remarks passed  by the  High Court<br \/>\nagainst the  appellant as  a Minister. In our view, the High<br \/>\nCourt at both the stages was in error in linking or dragging<br \/>\nthe appellant&#8217;s name as a Minister with the deliberations of<br \/>\nthe Tribunal.  The tribunal  may have gone wrong or right on<br \/>\nthe merit  of the  matters but the presence of the appellant<br \/>\nas being a Minister at the relevant time could not be linked<br \/>\nin any\tmanner with the legal proceedings. The remarks which<br \/>\nreflect the  conduct of\t the appellant\tas  a  Minister\t are<br \/>\nhereby expunged\t from the  judgments at\t all places wherever<br \/>\nfiguring but  the remarks  confined to\this  conduct  as  an<br \/>\nindividual litigant shall sustain.\n<\/p>\n<p id=\"p_4\">     The appeals are partially allowed to the afore extent.<br \/>\n     No costs.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India V L Patil vs Arjun Halappa Naikawadi &amp; Ors on 7 August, 1996 Equivalent citations: 1996 SCALE (5)824 Author: M Punchhi Bench: Punchhi, M.M.
