SIRI JAGAN, J.\n                   ------------------------------\n                    O.P.No. 16659 OF 2000\n                  -------------------------------\n            Dated this the 31st day of August, 2010\n\n                        J U D G M E N T\n<\/pre>\n<p id=\"p_1\">     The petitioners were Manager and Assistant Gr.I of the first<\/p>\n<p>respondent. They were issued with Exts.P1 and P2 show causes<\/p>\n<p>notices directing them to show cause why the value of stock<\/p>\n<p>found short on stock verification should not be recovered from<\/p>\n<p>them.     The petitioners filed Exts.P3 and P4 explanation.<\/p>\n<p>However, by Exts.P5 and P6 orders issued by the internal auditor,<\/p>\n<p>the petitioners were directed to pay an amount of Rs.55,049\/-<\/p>\n<p>and Rs.73,399\/- respectively towards liability for shortage in<\/p>\n<p>stock. The petitioners filed appeals before the Board of Directors<\/p>\n<p>which were rejected by Exts.P9 and P10 orders. Further appeals<\/p>\n<p>to be forwarded to the Government, Exts.P11 and P12, were<\/p>\n<p>refused to be forwarded to the Government on the ground that<\/p>\n<p>there is no provision in the rule for an appeal to the Government.<\/p>\n<p>Later on, the petitioners directly filed appeals before the<\/p>\n<p>Government and although the Government heard the same, no<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">O.P.No.16659\/2000                     2<\/span><\/p>\n<p>orders were passed. It is under the above circumstances, the<\/p>\n<p>petitioners have filed this original petition seeking the following<\/p>\n<p>reliefs:\n<\/p>\n<blockquote id=\"blockquote_1\"><p>            &#8220;i)   To issue a writ of certiorari or other appropriate<br \/>\n            writ, order or direction to quash Exhibits P5, p6, P9<br \/>\n            and P10.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_1\"><p>             ii)  To issue a writ of mandamus or other<br \/>\n            appropriate writ, order or direction declaring all the<br \/>\n            steps taken by the 1st respondent to recover amounts<br \/>\n            from the salary of the petitioners by the 1st respondent<br \/>\n            on the basis of Exhibits P5, P6, P9 and P10 as illegal<br \/>\n            and void&#8221;\n<\/p><\/blockquote>\n<p id=\"p_1\">Among other contentions, the petitioners would raise a specific<\/p>\n<p>contention that Exts.P5 and P6 orders passed by the internal<\/p>\n<p>auditor are without jurisdiction, in so far as there is no power<\/p>\n<p>vested with an internal auditor to pass orders fixing liability on<\/p>\n<p>the petitioners. It is further pointed out that Exts.P1 and P2<\/p>\n<p>show cause notices were issued by the Managing Director<\/p>\n<p>himself and therefore, the Managing Director was the<\/p>\n<p>appropriate authority having powers to pass orders pursuant to<\/p>\n<p>the show cause notices and therefore, clearly Exts.P5 and P6<\/p>\n<p>orders passed by the internal auditor are unsustainable.<\/p>\n<p>Although other contentions are also raised, I am not inclined to<\/p>\n<p>go into the same, since this particular contention of the<\/p>\n<p>petitioner finds favour with me. Admittedly, Exts.P1 and P2<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">O.P.No.16659\/2000                3<\/span><\/p>\n<p>show cause notices were issued by the Managing Director.<\/p>\n<p>Exts.P5 and P6 orders have been passed by the internal<\/p>\n<p>auditor, who does not have any powers to fix any liability on<\/p>\n<p>the petitioners which power lies exclusively with the Managing<\/p>\n<p>Director.\n<\/p>\n<p id=\"p_2\">     2.     In the above circumstances, Exts.P5 and P6 orders<\/p>\n<p>and Exts.P9 and P10 orders on the basis of the decision of the<\/p>\n<p>Board of Directors are hereby quashed. The writ petition is<\/p>\n<p>disposed of with a direction to the Managing Director to pass<\/p>\n<p>fresh orders after considering the contentions of the petitioners<\/p>\n<p>in Exts.P3 and P4 and affording them an opportunity of being<\/p>\n<p>heard.\n<\/p>\n<p id=\"p_3\">\n<p id=\"p_4\">                                    S.
