Mr.B.Chandran\n***\n\n\n:JUDGMENT\n<\/pre>\n<p id=\"p_1\">\tThis criminal appeal has been filed to remand the case back for trial by<br \/>\nsetting aside the order dated 22.01.2010, made in S.T.C.No.45 of 2007, on the<br \/>\nfile of the learned Judicial Magistrate No.IV, Madurai.\n<\/p>\n<p id=\"p_1\">\t2. The petitioner is the complainant in S.T.C.No.45 of 2007, on the file<br \/>\nof the learned Judicial Magistrate No.IV, Madurai.  He filed a private complaint<br \/>\nunder <a href=\"\/doc\/1823824\/\" id=\"a_1\">Section 138<\/a> of the Negotiable Instruments Act against the respondent. The<br \/>\nrespondent filed an application to refer the cheque with the handwriting expert<br \/>\nand the same was allowed on 31.07.2009.  Even on that day, the complainant was<br \/>\nnot present.  Afterwards, on six occasions including the one on 22.01.2010, he<br \/>\nwas not present before the Court and there was no representation on his side for<br \/>\nall the said hearings.  On 22.01.2010, the learned Judicial Magistrate dismissed<br \/>\nthe complaint. The order of dismissal is as follows:\n<\/p>\n<p id=\"p_2\">\t&#8220;Complainant absent. No representation. Complainant absent even after<br \/>\nCourt Notice. Accused absent. 317 <a href=\"\/doc\/445276\/\" id=\"a_2\">Cr.P.C<\/a>. petition filed and allowed.  Hence,<br \/>\nthe complaint is dismissed and the accused is acquitted in terms of Sec.256<br \/>\n<a href=\"\/doc\/445276\/\" id=\"a_3\">Cr.P.C<\/a>.&#8221;\n<\/p>\n<p id=\"p_3\">\t3. Mr.K.Sudalaiyandi, learned counsel appearing for the petitioner<br \/>\nstrenuously argued that the presence of the complainant was not necessary on<br \/>\nthat date of hearing viz., on 22.01.2010 and hence, the dismissal of the<br \/>\ncomplaint by the learned Judicial Magistrate is not warranted.  In support of<br \/>\nhis contention, he placed reliance upon a decision of this Court in the case of<br \/>\nR.Murali v. D.Udhayakumar, (2007) 1 MLJ (Crl.) 981, in which the learned Judge<br \/>\nhas followed a decision of the Hon&#8217;ble Supreme Court in <a href=\"\/doc\/1219241\/\" id=\"a_4\">Associated Cement<br \/>\nCompany Limited v. Keshvanand<\/a>, (1998) MLJ (Crl) SC 170 in which it has been held<br \/>\nas follows:\n<\/p>\n<p id=\"p_4\">&#8220;Two constraints are imposed on the Court for exercising the power under <a href=\"\/doc\/1132672\/\" id=\"a_5\">Section<br \/>\n256<\/a>, First is, if the Court thinks that in a situation it is proper to adjourn<br \/>\nthe hearing then the Magistrate shall not acquit the accused.  Second is, when<br \/>\nthe Magistrate considers that personal attendance of the complainant is not<br \/>\nnecessary on that day the Magistrate has the power to dispense with his<br \/>\nattendance and proceed with the case.  When the Court notices that the<br \/>\ncomplainant is absent on a particular day the Court must consider whether<br \/>\npersonal attendance of the complainant is essential on that day for the progress<br \/>\nof the case and also whether the situation does not justify the case being<br \/>\nadjourned to another date due to any other reason.  If the situation does not<br \/>\njustify the case being adjourned the Court is free to dismiss the complaint and<br \/>\nacquit the accused.  But if the presence of the complainant on that day was<br \/>\nquite unnecessary, then resorting to the step of axing down the complaint may<br \/>\nnot be a proper exercise of the power envisaged in the Section.  The discretion<br \/>\nmust, there, be exercised judicially and fairly without impairing the cause of<br \/>\nadministration of criminal justice.&#8221;\n<\/p>\n<p id=\"p_5\">\t4. In the light of the above said decision, it is not proper for the<br \/>\nlearned Judicial Magistrate to dismiss the complaint in the absence of the<br \/>\ncomplainant when his presence was not required for further proceedings.  As far<br \/>\nas the present case is concerned, the matter had been posted for receipt of the<br \/>\nopinion of the handwriting expert and on perusal of the pleadings shows that it<br \/>\nhas not been received so far.  Hence, on 22.01.2010, the presence of the<br \/>\ncomplainant was not essential and the dismissal of the complaint on that date is<br \/>\nnot at all proper.\n<\/p>\n<p id=\"p_6\">\t5. This Court also observes that when the Court dismisses the complaint<br \/>\nfor the absence of the complainant, it is expected to record reasons as to the<br \/>\nnecessity of presence of the complainant before the Court.  In other words,<br \/>\nthere shall be a finding in the order of the Court below that without the<br \/>\npresence of the complainant, the case could not be proceeded with on the<br \/>\nparticular date which paved way for the learned Judicial Magistrate to dismiss<br \/>\nthe complaint.  Of course, for six hearings the complainant was not present and<br \/>\nthere was no representation for him still the law requires that unless the<br \/>\npresence of the complainant is essential for a particular hearing, the learned<br \/>\nJudicial Magistrate cannot dismiss the complaint.  In these circumstances, the<br \/>\norder challenged before this Court deserves to be set aside which is accordingly<br \/>\nset aside.\n<\/p>\n<p id=\"p_7\">\t6. In the result, the Criminal Appeal is allowed.
