Justice M.SASIDHARAN NAMBIAR\n\n Dated :18\/11\/2008\n\n O R D E R\n               M.SASIDHARAN NAMBIAR, J.\n               --------------------------------------------------\n            Crl.Revision Petition No. 3715 of 2008\n           -----------------------------------------------------------\n          Dated this the 18th day of November, 2008\n\n                                O R D E R\n<\/pre>\n<p id=\"p_1\">           Revision petitioners are the sureties of the accused in<\/p>\n<p>C.C.377\/2005 on the file of Judicial First Class Magistrate -II,<\/p>\n<p>Chengannoor. By executing a bond undertaking to produce the<\/p>\n<p>accused, if he fails to appear as and when called for. Petitioners<\/p>\n<p>got the accused released on bail. The accused subsequently<\/p>\n<p>failed to appear. In spite of notices, petitioners did not produce<\/p>\n<p>the accused. Learned Magistrate, cancelled the bond and issued<\/p>\n<p>notice to the petitioners to show cause why the bond shall not be<\/p>\n<p>forfeited and the penalty should not be imposed against them<\/p>\n<p>under <a href=\"\/doc\/1286551\/\" id=\"a_1\">Section 446<\/a> of Cr.P.C. Though petitioners appeared, they<\/p>\n<p>did not show any reason. Learned Magistrate, thereafter, passed<\/p>\n<p>an order directing the petitioners to pay penalty of Rs.5,000\/-<\/p>\n<p>each. Petitioners challenged that order before the Additional<\/p>\n<p>Sessions Court, Mavelikkara in Crl.Appeal No.2\/2008. Learned<\/p>\n<p>Additional Sessions Judge on re-appreciation of the materials<\/p>\n<p>Crl.R.P.No.3715\/2008\n<\/p>\n<p id=\"p_1\">                                &#8211; 2 &#8211;\n<\/p>\n<p id=\"p_2\">confirmed the order and dismissed the appeal. It is challenged in<\/p>\n<p>the revision.\n<\/p>\n<p id=\"p_3\">\n<p id=\"p_4\">      2.     Learned counsel appearing for the petitioners was<\/p>\n<p>heard. The learned counsel submitted that though the accused<\/p>\n<p>did not originally appeared in C.C.377\/2005, subsequently<\/p>\n<p>judgment in C.C.377\/2005 was challenged before the Sessions<\/p>\n<p>Court and the sentence was suspended. It was argued that<\/p>\n<p>failure of the accused to appear was due to brain tumor and<\/p>\n<p>accused had undergone a major surgery and in such<\/p>\n<p>circumstances, courts below should have viewed the matter<\/p>\n<p>leniently, and no penalty should have been imposed.<\/p>\n<p id=\"p_5\">      3.     On hearing the learned counsel and going through the<\/p>\n<p>orders of the courts below, I do not find any reason to interfere<\/p>\n<p>this order. There was no procedural irregularity. Both the<\/p>\n<p>courts have considered all the relevant aspects. Petitioners who<\/p>\n<p>had executed a bond undertaking to produce the accused and<\/p>\n<p>Crl.R.P.No.3715\/2008\n<\/p>\n<p id=\"p_6\">                                  &#8211; 3 &#8211;\n<\/p>\n<p id=\"p_7\">failed to produce in spite of the directions are bound to pay the<\/p>\n<p>penalty as provided in the bond. Learned Magistrate only<\/p>\n<p>imposed a fine of Rs.5,000\/- each, which is quite reasonable.<\/p>\n<p id=\"p_8\">             In the result, Criminal Revision Petition is dismissed.<\/p>\n<p id=\"p_9\">                                 M.
