A.L.DAVE)<\/p>\n<p>\tThis<br \/>\npetition was suo-motu  initiated by this Court on the basis of a<br \/>\ncommunication received alleging that Nasirali Basaratali Saiyed died<br \/>\nof police atrocities at Surat.\n<\/p>\n<p id=\"p_1\">2.\tWe<br \/>\nhave heard learned advocate Mr.Shalin Mehta, Amicus Curiae, and<br \/>\nlearned Government Pleader Mr.Jani appearing with learned A.P.P. Mr.<br \/>\nDave.\n<\/p>\n<p id=\"p_2\">3.\tMr.Jani<br \/>\nhas shown to us the post-mortem notes. We have also examined the<br \/>\naffidavit of Mr.A.H.Khan, Police Inspector, Salabatpura Police<br \/>\nStation, Surat City, who is the investigating officer.\n<\/p>\n<p id=\"p_3\">4.\tWe<br \/>\nfind that the Investigating Officer had formulated about six<br \/>\nquestions and  put them to the Doctor. We also find that according to<br \/>\nthe medical opinion, no specific cause of death could be given. The<br \/>\npost-mortem notes indicate that there were abrasions and other<br \/>\nsuperficial injuries on the face of the deceased. The injuries were<br \/>\nboth on left and right sides of the face as well as on the forehead<br \/>\nof the deceased. The doctor has opined that these injuries are<br \/>\npossible out of a fall. We are unable to understand the finding of<br \/>\nfacts regarding injuries on both the sides of the face, the opinion<br \/>\nof the doctor that the injuries are possible out of a fall and the<br \/>\nmaterial on record showing that the deceased got down from the<br \/>\nrickshaw and fell on the ground and died. The investigating agency<br \/>\nhas also not held T.I.Parade to fix the identity of the person, who<br \/>\nis alleged to have committed the assault on the deceased. These<br \/>\naspects were brought to the notice of learned Public Prosecutor. He<br \/>\nstated that he will ensure that the investigation is entrusted to a<br \/>\nsenior officer of the rank of Assistant Commissioner of Police or<br \/>\nDeputy Commissioner of Police.\n<\/p>\n<p id=\"p_4\">5.\tOn<br \/>\nexamining the post-mortem notes, we find that there were no external<br \/>\nor internal injuries other than superficial injuries on the face and<br \/>\nforehead of the deceased. The histopathological report is also<br \/>\nreported to be negative.\n<\/p>\n<p id=\"p_5\">6.\tIn<br \/>\nthe above set of facts, we drop the proceedings with an expectation<br \/>\nthat the investigation shall be carried out by a responsible senior<br \/>\npolice officer, as per the statement made by learned Public<br \/>\nProsecutor Mr.Jani.
