The following dates  are  not<br \/>\nin dispute:\n<\/p>\n<p id=\"p_1\">        The  seizure  was  on  23.04.2003;  the  show  cause  notice  is dated<br \/>\n16.10.2003 and the petitioner&#8217;s case is that, it was served on  him  on  30.10<br \/>\n.2003.   Sub  section (1) of <a href=\"\/doc\/420314\/\" id=\"a_1\">Section 110<\/a> of the Customs Act enables the proper<br \/>\nofficer, if he has reason to believe that any goods are liable to confiscation<br \/>\nunder the Act, to seize such goods.  Under SubSection (2) of  <a href=\"\/doc\/420314\/\" id=\"a_2\">Section  110<\/a>  of<br \/>\nthe Act, when any goods are seized under Sub-Section (1) referred to above and<br \/>\nno  notice  in respect thereof is given under clause (a) of <a href=\"\/doc\/341949\/\" id=\"a_3\">Section 124<\/a> of the<br \/>\nCustoms Act within six months of the seizure of the goods, the goods shall  be<br \/>\nreturned to the person from whose possession they were seized.  <a href=\"\/doc\/341949\/\" id=\"a_4\">Section 124<\/a> of<br \/>\nthe  Customs  Act  directs issue of a show cause notice before confiscation of<br \/>\ngoods.  Contending therefore that the show cause notice under <a href=\"\/doc\/341949\/\" id=\"a_5\">section  124<\/a>  of<br \/>\nthe  Customs  Act  has  been served on the petitioner beyond the period of six<br \/>\nmonths from the date of seizure of the goods, the petitioner wants  the  goods<br \/>\nto be returned to him.\n<\/p>\n<p id=\"p_2\">        2.  I  applied my mind to the arguments advanced.  The date of seizure<br \/>\nwas on 23.04.2003.  The show cause notice is issued under <a href=\"\/doc\/1510048\/\" id=\"a_6\">section 12<\/a> <a href=\"\/doc\/638437\/\" id=\"a_7\">4<\/a> of  the<br \/>\nCustoms Act.   The  notice  is dated 16.10.2003.  Assuming that the show cause<br \/>\nnotice was served on the petitioner only on 30.10.200 3, can it be  said  that<br \/>\nthe show cause notice had been issued beyond the period of six months from the<br \/>\ndate of  seizure.   A careful reading of Sub-Section (2) of <a href=\"\/doc\/420314\/\" id=\"a_8\">Section 110<\/a> of the<br \/>\nCustoms Act would show that a notice for confiscation  as  contemplated  under<br \/>\n<a href=\"\/doc\/341949\/\" id=\"a_9\">section  124<\/a> (a) of the Act should be given within six months from the date of<br \/>\nseizure of the goods.  In other words, mere despatch of notice within a period<br \/>\nof six months would be sufficient compliance of  the  requirement  of  law  as<br \/>\nprovided for under Sub-Section (2) of <a href=\"\/doc\/420314\/\" id=\"a_10\">Section 110<\/a> of the Customs Act.\n<\/p>\n<p id=\"p_3\">        3.  If the argument of the learned counsel for the petitioner that the<br \/>\ndate  of  service of such notice on the person concerned alone should be taken<br \/>\ninto account to calculate the period of six months is accepted, then it  would<br \/>\nend in  hazardous  results.    In  my  opinion,  that  cannot  be  the correct<br \/>\ninterpretation of Sub-Section (2) of <a href=\"\/doc\/420314\/\" id=\"a_11\">Section 110<\/a> of the Customs Act.   If  the<br \/>\ndate  of service of notice on the person concerned alone should be the date to<br \/>\nbe taken into account, then any person, on whom the notice is attempted to  be<br \/>\nserved, would evade receipt by avoiding and keeping the notice away from being<br \/>\nserved  on  him for a period beyond six months and then he would put that as a<br \/>\nground in the forefront to claim return of the goods.  For such a construction<br \/>\nnamely, the date of service of notice on the person concerned should be  taken<br \/>\ninto account in deciding the period of expiry of six months, I do not find any<br \/>\nsupport from  the  Statutory  provision itself and referred to above.  Learned<br \/>\ncounsel for the petitioner would rely upon <a href=\"\/doc\/138265\/\" id=\"a_12\">Section 153<\/a> of the Customs  Act  to<br \/>\ncontend that the notice must have been served in the first instance personally<br \/>\non  the petitioner and failing such service only, it ought to have been served<br \/>\nby registered post.  In this case, notice had  been  served  under  registered<br \/>\npost.   A reading of <a href=\"\/doc\/17019\/\" id=\"a_13\">section 153(a)<\/a> of the Customs Act does not show the order<br \/>\nof priority in which any order or decision or any  summons  or  notice  issued<br \/>\nunder the  Act, must be served.  In my considered opinion, the mode of service<br \/>\nas provided for in Sub-Clause (a) of <a href=\"\/doc\/239087\/\" id=\"a_14\">Section 15<\/a> <a href=\"\/doc\/169382\/\" id=\"a_15\">3<\/a> of the Customs Act is in the<br \/>\nalternative.  In other words, the serving authority can adopt any one  of  the<br \/>\nmodes prescribed  therein.   Therefore finding that the notice in this case is<br \/>\nshown to have been sent on 16.10.2003, I hold that there is strict  compliance<br \/>\nof  the  requirement  of  Sub-Section  (a)  of <a href=\"\/doc\/420314\/\" id=\"a_16\">section 110<\/a> of the Customs Act.<br \/>\nConsequently the writ petition stands dismissed.  No costs.
