Misc. No. 1788 of 2011 and<\/p>\n<p>                 Mr. Binod Kumar appearing in Cr. Misc. No. 2877 of 2011, and<\/p>\n<p>                 learned A.P.P. for State.\n<\/p>\n<p id=\"p_1\">                           Both the above-said Cr. Misc. Cases arise out of the<\/p>\n<p>                 same case i.e. Beldour P.S. case No. 29 of 2010 registered<\/p>\n<p>                 under sections-147, 148, 149, 302, 341, 323<a href=\"\/doc\/1569253\/\" id=\"a_1\"> of the Indian Penal<\/p>\n<p>                 Code<\/a> and accordingly, the above-said Cr. Misc. Cases are<\/p>\n<p>                 being heard and disposed of by this common order.<\/p>\n<p id=\"p_2\">                           Petitioner in Cr. Misc. No. 1788 of 2011 is not named<\/p>\n<p>                 in the FIR as the father&#8217;s name of the petitioner has been<\/p>\n<p>                 disclosed as Darogi Singh whereas one, Ajay Singh, S\/o Ram<\/p>\n<p>                 Singh is named in the F.I.R. So far petitioner in Cr Misc. No.<\/p>\n<p>                 2877 of 2011 is concerned, he is named in the FIR but no<\/p>\n<p>                 specific overt act has been attributed against the petitioner in Cr<\/p>\n<p>                 Misc. No. 2877 of 2011 in the written report of the informant but<\/p>\n<p>                 it    appears   from   Annexure-2   series   that   in   course   of<\/p>\n<p>                 investigation, the statement of some witnesses were recorded<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                             -2-<\/span><\/p>\n<p>        u\/S 164 of the <a href=\"\/doc\/445276\/\" id=\"a_1\">Cr.P.C<\/a>. in which they stated specifically against<\/p>\n<p>        the accused persons. Furthermore, the aforesaid witnesses<\/p>\n<p>        also disclosed the roles played by accused persons of the case.<\/p>\n<p id=\"p_3\">                  I find from perusal of Annexure-2 series that one<\/p>\n<p>        witness, namely, Hemant Kumar has stated that the petitioner in<\/p>\n<p>        Cr Misc. No 2877 of 2011 rubbed sand on the eyes of the<\/p>\n<p>        deceased at the time of alleged occurrence. Moreover, it<\/p>\n<p>        appears to me that having more or less similar allegation,<\/p>\n<p>        several co-accused persons have already been released either<\/p>\n<p>        on anticipatory bail or on regular bail by different benches of<\/p>\n<p>        this court.\n<\/p>\n<p id=\"p_4\">                  In view of the aforesaid facts and circumstances, let<\/p>\n<p>        both the petitioners, namely,    Ajay Singh (in Cr.Misc. No.1788<\/p>\n<p>        of 2011) and Surendra Singh (in Cr,. Misc.
