No.5652 of 2011\n                                   NITISH KUMAR\n                                          Versus\n                               THE STATE OF BIHAR\n                                        -----------\n<\/pre>\n<p id=\"p_1\">2   22.04.2011                Heard learned counsels for the petitioner and<\/p>\n<p>                 the State.\n<\/p>\n<p id=\"p_1\">                              The    petitioner    being     the        husband    is<\/p>\n<p>                 apprehending his arrest in a complaint case in which<\/p>\n<p>                 cognizance has been taken under <a href=\"\/doc\/1011035\/\" id=\"a_1\">Sections 323<\/a>, <a href=\"\/doc\/399026\/\" id=\"a_1\">399<\/a> and<\/p>\n<p>                 <a href=\"\/doc\/538436\/\" id=\"a_2\">498A<\/a> of the Indian Penal Code and <a href=\"\/doc\/751411\/\" id=\"a_3\">Section 3<\/a>\/<a href=\"\/doc\/1023340\/\" id=\"a_4\">4<\/a> of the<\/p>\n<p>                 Dowry Prohibition Act.\n<\/p>\n<p id=\"p_2\">                              The    petitioner   is   ready       to     keep    the<\/p>\n<p>                 complainant as wife with full dignity and honour.<\/p>\n<p id=\"p_3\">                              It appears that the petitioner has earlier filed<\/p>\n<p>                 a restitution case in which complainant appeared but<\/p>\n<p>                 she was not ready to resume the conjugal life. The<\/p>\n<p>                 petitioner is still ready to keep the complainant as wife<\/p>\n<p>                 with full dignity and honour.\n<\/p>\n<p id=\"p_4\">                              Considering the aforesaid facts, let the above<\/p>\n<p>                 named        petitioner,   be    released     on        provisional<\/p>\n<p>                 anticipatory bail for six months, in the event of his<\/p>\n<p>                 arrest or surrender before the learned Court below<\/p>\n<p>                 within a period of 12 weeks from today, on furnishing<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                    2<\/span><\/p>\n<p>             bail bond of Rs. 10,000\/- (ten thousand) with two<\/p>\n<p>             sureties of the like amount each to the satisfaction of<\/p>\n<p>             the learned Chief Judicial Magistrate, Nawada in<\/p>\n<p>             connection with Complaint Case No.               989\/2009,<\/p>\n<p>             subject to the conditions as laid down under <a href=\"\/doc\/1692057\/\" id=\"a_5\">Section<\/p>\n<p>             438(2)<\/a> Cr.P.C.\n<\/p>\n<p id=\"p_5\">                           Let the learned court below issue notice to<\/p>\n<p>             the complainant and on her appearance, the petitioner<\/p>\n<p>             will take back the complainant to her matrimonial<\/p>\n<p>             house to keep her as wife with full dignity and honour.<\/p>\n<p id=\"p_6\">                           The provisional bail of the petitioner will be<\/p>\n<p>             confirmed in two eventualities (i) if the matrimonial<\/p>\n<p>             harmony is substantially restored or (ii) if the<\/p>\n<p>             complainant deliberately refuses to reside with the<\/p>\n<p>             petitioner.\n<\/p>\n<p id=\"p_7\">\n<p id=\"p_8\">                                             (Dinesh Kumar Singh, J.)<br \/>\nAmrendra\/-<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Nitish Kumar vs The State Of Bihar on 22 April, 2011 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.Misc.
