The<br \/>\n        second  defendant is admittedly a society registered under<br \/>\n        the <a href=\"\/doc\/1700055\/\" id=\"a_1\">Societies Registration Act<\/a> formed for  charitable  and<br \/>\n        educational purpose.   It is also governed by the rules of<br \/>\n        any one of the sections of  Muslim  called  Safi,  Hanafi,<br \/>\n        Hambali or Maliki.\n<\/p>\n<p id=\"p_4\">        \t2.   Pursuant  to  a  direction  by  this Court in<br \/>\n        C.R.P.1846\/2003 to the Wakf Tribunal, Ernakulam to  decide<br \/>\n        this  question  afresh  the  Tribunal  considered  it as a<br \/>\n        preliminary issue and found that the second defendant is a<br \/>\n        wakf and is subject to the jurisdiction of  the  Tribunal.<br \/>\n        This  revision  petition  is filed by the first defendant,<br \/>\n        the President Darul Aman Islamic Complex, Kalladikode.\n<\/p>\n<p id=\"p_5\">        \t3.  The suit is filed for the following reliefs:\n<\/p>\n<p id=\"p_6\">         1)   To  pass  a  decree  declaring that the first@@<br \/>\n        i<br \/>\n                defendant is not legally entitled to  continue  as<br \/>\n                Chairman of the 2nd defendant-Association.\n<\/p>\n<p id=\"p_7\">         2) To pass a decree directing the 2nd defendant to@@<br \/>\n        i<br \/>\n                convene  meeting  of  general body by allowing the<br \/>\n                members as on 5-7-2003 and excluding  the  members<br \/>\n                admitted  illegally  by  the  first  defendant  by<br \/>\n                making false  entries  in  Minutes  Book  kept  in<br \/>\n                Police custody.\n<\/p>\n<p id=\"p_8\">         3)   To  pass a decree directing the 2nd defendant@@<br \/>\n        i<br \/>\n                to conduct the meeting of  the  Working  Committee<br \/>\n                and  to  discuss  about  the illegal action of the<br \/>\n                first defendant and to take decision thereon.\n<\/p>\n<p id=\"p_9\">         4)   To  pass  a  decree  appointing  a  Presiding@@<br \/>\n        i<br \/>\n                Officer to preside over the meeting of the general<br \/>\n                body  by  ordering the said officer to conduct the<br \/>\n                general body  meeting  with  the  members  existed<br \/>\n                prior to 5-7-2003.\n<\/p>\n<p id=\"p_10\">         5)  To  pass  a decree directing the 3rd defendant@@<br \/>\n        i<br \/>\n                Wakf Board to appoint an officer to conduct  audit<br \/>\n                of  the  accounts  of  the  2nd  defendant  and to<br \/>\n                recover the amounts due from the  first  defendant<br \/>\n                and   also  to  order  initiating  of  prosecution<br \/>\n                against   the   first   defendant   for    illegal<br \/>\n                misappropriation of Wakf fund.\n<\/p>\n<p id=\"p_11\">         6)   To  pass  a  decree declaring that any person@@<br \/>\n        i<br \/>\n                inducted as  member  by  the  first  defendant  is<br \/>\n                having  no  right to participate in the meeting of<br \/>\n                the  2nd defendant.\n<\/p>\n<p id=\"p_12\">         7)  To  pass  a  decree  for permanent prohibitory@@<br \/>\n        i<br \/>\n                injunction restraining the  first  defendant  from<br \/>\n                discharging  any  function  as Chairman of the 2nd<br \/>\n                defendant-Association   expending   any   amounts,<br \/>\n                collecting any income, amounts, etc.<\/p>\n<p id=\"p_13\">         8)   Grant such other reliefs as may be prayed for@@<br \/>\n        i<br \/>\n                and which this Honourable Tribunal deems  fit  and<br \/>\n                proper  in  the  interest  of  justice  during the<br \/>\n                course of the trial of this suit.\n<\/p>\n<p id=\"p_14\">        \t4.  In the plaint it is stated that the plaintiffs<br \/>\n        are  the  Working  Committee Members and office bearers of<br \/>\n        Darul Aman Islamic Complex  which  is  a  wakf  registered<br \/>\n        under  the  Literary and <a href=\"\/doc\/1700055\/\" id=\"a_1\">Charitable Societies Registration<br \/>\n        Act<\/a>.  Though the nomenclature Islamic Complex is used, the<br \/>\n        provisions in the byelaw clearly showed that it is a  wakf<br \/>\n        and the Managing Committee is a Muthawalli Committee.  The<br \/>\n        rest  of  the  averments  in  the  plaint  relates  to the<br \/>\n        complaint against the first defendant and the attempts  of<br \/>\n        the plaintiffs to convene general body etc.  which are not<br \/>\n        very  material  for the decision of the issues involved in<br \/>\n        this revision petition.\n<\/p>\n<p id=\"p_15\">        \t5.  In the written statement the  first  defendant<br \/>\n        contended that  the  2nd  defendant  is  not  a wakf.  The<br \/>\n        properties are not registered with the Wakf  Board.    The<br \/>\n        properties  of the 2nd defendant have not been permanently<br \/>\n        dedicated for the purposes recognised as pious, religious,<br \/>\n        charitable with an intention to  create  wakf.    The  2nd<br \/>\n        defendant  is  a  charitable  society registered under the<br \/>\n        Literary and Charitable Societies Registration act,  1860.<br \/>\n        The Ist  defendant  is  the  founder  President.   The Ist<br \/>\n        defendant and other  founder  members  never  intended  to<br \/>\n        establish   a   wakf   institution  and  to  dedicate  the<br \/>\n        properties as wakf.  Since the  2nd  defendant  is  not  a<br \/>\n        wakf,  the  Tribunal  has no jurisdiction to try the suit.<br \/>\n        The other averments in the plaint are also denied  in  the<br \/>\n        written statement.\n<\/p>\n<p id=\"p_16\">        \t6.  Therefore the question  to  be  considered  is<br \/>\n        whether the  Darul  Aman  Islamic  Complex is a wakf.  The<br \/>\n        Tribunal has held that even though  there  is  no  express<br \/>\n        dedication  it can be validly found that the 2nd defendant<br \/>\n        is a wakf by user.  The learned counsel for  the  revision<br \/>\n        petitioner   contends   that   the  Tribunal  has  totally<br \/>\n        misunderstood  the  expression  &#8220;Wakf  by  user&#8221;  and  the<br \/>\n        finding  that  the  2nd  defendant is a wakf is absolutely<br \/>\n        wrong.\n<\/p>\n<p id=\"p_17\">        \t7.  Ext.B1 is  the  byelaw  of  Kalladikode  Darul<br \/>\n        Islamic  Complex Committee and Ext.B5 is the Memorandum of<br \/>\n        Association dated 23-12-1988.  A reading of Exts.B1 and B5<br \/>\n        discloses the following aspects.  In Ext.B1  the  aims  of<br \/>\n        the society are to give protection to the orphans and give<br \/>\n        them  education  religious, technical and professional and<br \/>\n        to establish Yathimkhana, Arabic College, Mosque, Training<br \/>\n        Institute, Health Care Centre,  Madrassa,  Nursery  School<br \/>\n        etc.   The  activities of the society will be based on the<br \/>\n        faith of Asu Ari, Mathurithi and based on any one  of  the<br \/>\n        tenets  of  the  sections  called Safi, Hanafi, Hambali or<br \/>\n        Maliki.  The disputes are to be settled on  the  basis  of<br \/>\n        decisions  of  the Pandits of Samastha Kerala Jam Iyyathul<br \/>\n        Ulama.  The life members have to contribute Rs.6,000\/- and<br \/>\n        ordinary members have to contribute Rs.51\/-  and  must  be<br \/>\n        persons willing  to  abide by the byelaws.  The income has<br \/>\n        to be spent for the purposes above mentioned.  In case the<br \/>\n        society is to stop functioning the  assets  must  vest  in<br \/>\n        some  other  institutions of the same objects or otherwise<br \/>\n        it will vest in the State.  It is with these provisions in<br \/>\n        the byelaws that we have to consider the  question  as  to<br \/>\n        whether the 2nd defendant is a wakf or not.\n<\/p>\n<p id=\"p_18\">        \t8.  A wakf is defined under Sec.3 (r) of the  <a href=\"\/doc\/631210\/\" id=\"a_2\">Wakf<br \/>\n        Act<\/a> 1995.    It  is  a  permanent  dedication  by a person<br \/>\n        professing Islam, of any movable or immovable property for<br \/>\n        any  purpose  recognised  by  the  Muslim  Law  as  pious,<br \/>\n        religious or charitable and includes a wakf by user, grant<br \/>\n        and wakf-alal-aulad subject to the conditions mentioned in<br \/>\n        the section.   The basic thing for a wakf is dedication of<br \/>\n        movable or immovable  property  for  pious,  religious  or<br \/>\n        charitable purpose.    The  Tribunal has found that though<br \/>\n        there is no such dedication it can be treated as a wakf by<br \/>\n        user.  For that purpose the Tribunal  has  relied  on  the<br \/>\n        decisions of  this  Court  in Pookoya Haji Vs.  Cheiyakoya@@<br \/>\n                                      AAAAAAAAAAAAAAAAAAAAAAAAAAAA<br \/>\n        (2003 (3) KLT 32).  The question considered in  that  case@@<br \/>\n        AAAAAAAAAAAAAAAAAA<br \/>\n        was the scope of the power of the Tribunal.  It is clearly<br \/>\n        stated by the Division Bench that a wakf normally requires<br \/>\n        express  dedication,  but  if land has been used from time<br \/>\n        immemorial for a religious purpose then the land becomes a<br \/>\n        wakf by user.  Can it  be  said  in  this  case  when  the<br \/>\n        society  was  formed  in  1988  under  a  byelaw  that the<br \/>\n        property has been used from time immemorial?   We  are  of<br \/>\n        opinion  that  it  cannot  be  said  and  the Tribunal was<br \/>\n        clearly in error in placing reliance on a  decision  which<br \/>\n        has no  application  to the facts of the case.  As noticed<br \/>\n        by this Court in Mariyumma Vs.  Andunhi (1979 KLT 231) the@@<br \/>\n                         AAAAAAAAAAAAAAAAAAAAAAAAAAAAAAAAAAAAA<br \/>\n        creation of a wakf is the tying  up  of  property  in  the<br \/>\n        ownership  of  God  the  Almighty  and the devotion of the<br \/>\n        profits for the benefit of human beings.  As a  result  of<br \/>\n        the creation of a wakf, the right of wakif is extinguished<br \/>\n        and the ownership is transferred to the Almighty.  In this<br \/>\n        case  there is even provision for devolution of the entire<br \/>\n        property to the State if the society is to extinguish  and<br \/>\n        there  is no other similar organisation to which it can be<br \/>\n        transferred.  Though such a possibility is very remote and<br \/>\n        almost nil it is an indicator to show  that  there  is  no<br \/>\n        complete dedication of property to the Almighty.\n<\/p>\n<p id=\"p_19\">        \t9.   The  Supreme  Court  in  Zain  Yar  Jung  Vs.@@<br \/>\n                                       AAAAAAAAAAAAAAAAAAAA<br \/>\n        Director  of  Endowments  (AIR 1963 SC 985) dealt with the@@<br \/>\n        AAAAAAAAAAAAAAAAAAAAAAAAAAAAAAAAAAAAAAAAAAA<br \/>\n        distinction between  public  charitable  trust,  wakf  and<br \/>\n        religious endowments  recognised  by  Hindu  Law.  In that<br \/>\n        case since the beneficiaries were the  general  public  it<br \/>\n        was found  to be not a wakf.  In the present case there is<br \/>\n        no dedication  of  any  particular  movable  or  immovable<br \/>\n        property for  religious  or  charitable trust.  It is only<br \/>\n        the objects of the trust that is mentioned in Ext.B5.  The<br \/>\n        qualification to become a life member or  ordinary  member<br \/>\n        also is  mentioned as contribution of certain amounts.  In<br \/>\n        that respect also it can be said that  there  is  no  wakf<br \/>\n        created by  Exts.B1  and  B5.   Though some decisions have<br \/>\n        been referred to by the counsel on both  sides  they  were<br \/>\n        rendered  under  the  <a href=\"\/doc\/631210\/\" id=\"a_3\">Wakf  Act<\/a>,  1954  and  after the new<br \/>\n        enactment in 1995 they have lost relevance  and  therefore<br \/>\n        we are  not  referring to them.  But the fact remains that<br \/>\n        even after  the  new  Act  the  essential  requirement  of<br \/>\n        permanent  dedication of movable or immovable property for<br \/>\n        pious, religious or charitable purpose is required.  Since<br \/>\n        even  according  to  the  Tribunal  there  is  no  express<br \/>\n        dedication  and  it is a wakf by user and wakf by user can<br \/>\n        be presumed only in case where a property  has  been  used<br \/>\n        from  time  immemorial  for a religious purpose, we are of<br \/>\n        the opinion that the Tribunal has gone  wrong  in  holding<br \/>\n        that the 2nd defendant is a wakf.<br \/>\n        \tWe therefore allow this  Civil  Revision  Petition<br \/>\n        and  hold that the Tribunal has no jurisdiction to try the<br \/>\n        suit.
