1.     This appeal arises from the final order dated<\/p>\n
28th   of    February,   2001   of   the   High   Court       of<\/p>\n
Judicature, Andhra Pradesh at Hyderabad in Civil<\/p>\n
Revision Petition No.3326 of 1997.\n<\/p>\n
2.     An application made by the appellants under the<\/p>\n
Andhra Pradesh Land Reforms (Ceiling on Agricultural<\/p>\n
Holdings) Act, 1973 (hereinafter referred to as the<\/p>\n
“Andhra Land Reforms Act, 1973”) was filed before the<\/p>\n
concerned authorities in respect of the land in<\/p>\n
question. The authorities by a detailed order held that<\/p>\n
since the appellants were tenants, they were entitled<\/p>\n
to retain the land in question. An appeal was taken<\/p>\n

\nagainst the aforesaid order of the authorities under<\/p>\n
the Andhra Land Reforms Act, 1973 in which the<\/p>\n
order     of        the    authorities   was   also    affirmed.<\/p>\n
Subsequently, a revision was also moved and by the<\/p>\n
impugned order the High Court had set aside the<\/p>\n
concurrent orders of the authorities and the tribunal<\/p>\n
holding that the authorities under the Andhra Pradesh<\/p>\n
(Andhra Area) Tenancy Act, 1956 (hereinafter referred<\/p>\n
to the “Andhra Tenancy Act, 1956”) was only conferred<\/p>\n
with the power to determine the question of tenancy in<\/p>\n
respect        of    the    land   in    question     and   such<\/p>\n
determination could not be made under the Andhra<\/p>\n
Land Reforms Act, 1973, i.e., the authorities had no<\/p>\n
jurisdiction to determine the question of tenancy in<\/p>\n
respect of the lands in question. However, liberty was<\/p>\n
given by the High Court to the appellants to approach<\/p>\n
the authorities under the Andhra Tenancy Act, 1956<\/p>\n
for determination of the question of tenancy relating to<\/p>\n
the land in question. It is this order of the High Court<\/p>\n
which is now challenge before us.\n<\/p>\n

3.   Having heard the learned counsel for the parties<\/p>\n
and after considering the relevant provisions of both<\/p>\n
the Acts viz., Andhra Land Reforms Act, 1973 and<\/p>\n
Andhra Tenancy Act, 1956, we do not find any reason<\/p>\n
to interfere with the impugned order of the High<\/p>\n
Court, as we find that the learned counsel for the<\/p>\n
appellants had failed to satisfy us that the Andhra<\/p>\n
Land Reforms Act, 1973 also conferred with the power<\/p>\n
to determine right of tenancy in respect of the lands in<\/p>\n
question.\n<\/p>\n
4.   That being the position, we are not inclined to<\/p>\n
interfere with the impugned order of the High Court in<\/p>\n
the exercise of our power under Article 136<\/a> of the<\/p>\n
constitution excepting that it would be open to the<\/p>\n
appellants to approach the authorities under the<\/p>\n
Andhra Tenancy Act, 1956 for determination of the<\/p>\n
tenancy right relating to the land in question and if<\/p>\n
such approach is made, the authorities under the<\/p>\n
Andhra Tenancy Act, 1956 are directed to decide the<\/p>\n
same in accordance with law after giving proper<\/p>\n

\nopportunity of hearing to the parties as expeditiously<\/p>\n
as possible.\n<\/p>\n
5.   Subject to the above observations, the appeal is<\/p>\n
dismissed with no order as to costs. Interim order, if<\/p>\n
any, stands vacated.\n<\/p>\n
