His\nperformance during probation period though was recorded as\n'average', but the petitioner was improving. However, without\nconsidering this aspect, the petitioner's services were terminated\nand the Tribunal without considering this aspect has dismissed\nthe original application.\n       From the perusal of the record, we find that the petitioner's\nfather G.P.Jaiswal was working as Machinist (Skilled) in Vehicle\nFactory, Jabalpur. He died in harness on 10.7.1998.At that time,\nthe petitioner was minor. On attaining majority, the petitioner was\nappointed as L.D.C on compassionate ground vide order dated\n24.10.2001. The petitioner was appointed for a period of two\nyears on probation However, the period of probation was\nextended from time to time and lastly vide order dated\n24.11.2005.      Since his performance during the probationary\nperiod was not found satisfactory, his services were terminated\nvide order dated 19.6.2006., which was challenged before the\nTribunal.\n       Before the Tribunal, the respondents filed reply in which it\nwas stated that because performance of the petitioner was below\naverage and there was no sign of improvement inspire of\nrepeated advice to the petitioner, his services were terminated.\nThe Tribunal considered this aspect at length. And relying on the\n                          WP No.2106\/2010(S)\n\nAjay Jaiswal                               Union of India and others.\n                                 ( 2)\n\n\n\n\njudgment of the Apex Court in                 <a href=\"\/doc\/1973416\/\" id=\"a_1\">Oil and Natural Gas\nCommission vs. Dr. Md.S.Iskander Ali<\/a>, AIR 1980 SC 1242\nfound that no case was made out for interference in the order of\ntermination and dismissed the original application.\n        Though the learned counsel for the petitioner tried to assail\nthe aforesaid order, but was unable to show               that during the\nperiod of extended probation, performance was not satisfactory\nand was below average and in spite of issuance of repeated\nadvice, the petitioner had not shown any improvement                    then\nwhether it was incumbent on the part of the respondents either to\nextend the period of probation or to continue the services of the\npetitioner. Nothing has been stated except that the respondents\nought to have extended one more opportunity to the petitioner to\nimprove.\n        The apex Court in various judgments considered this\naspect and held that a probationer is on test and if his services\nare found not be satisfactory, the employer has, in terms of letter\nof    appointment,   a   right    to    terminate   the   services.     <a href=\"\/doc\/1392246\/\" id=\"a_1\">See\nKrishnadevaraya Education Trust and another vs. L.A.\nBalakrishna<\/a> (2001)9 SCC 319.\n        In the light of the aforesaid settled position of law, if the\nrespondents have terminated the services of the petitioner during\nperiod of probation, no fault is found.
