     The prayer of the petitioner is for directing the first<\/p>\n
respondent to issue ‘Certificate of Registration’ to her     as a<\/p>\n
Notary under Rule 8(4) of the Notaries Rules, 1956; pursuant to<\/p>\n
completion of all formalities in response to her application for<\/p>\n
appointment as Notary and remittance of the fees as prescribed.<\/p>\n
The petitioner also relies on Exhibits P3, P5 and P6 proceedings<\/p>\n
issued by the concerned authority under the Law Department<\/p>\n
asking the petitioner to appear for a hearing and to produce the<\/p>\n
relevant records for verification as per the Notaries Rules.<\/p>\n
     2.   The second respondent has filed a counter affidavit<\/p>\n
stating that the entry with regard to the name of the petitioner in<\/p>\n
the Notarial Register was only a mistake, as no appointment<\/p>\n
could have been given to the petitioner since it exceeded the<\/p>\n
sanctioned strength.      According to the second respondent,<\/p>\n
necessary inspection was conducted by the Law Department<\/p>\n

pursuant to the application made by the petitioner to ascertain<\/p>\n
the infrastructure and such other credentials of the petitioner,<\/p>\n
also calling for a report from the Bar Council. There is no case<\/p>\n
for the second respondent that the petitioner is not a fit person<\/p>\n
or not a suitable person to be appointed as a Notary. On the<\/p>\n
other hand, the only case projected in the counter affidavit is that<\/p>\n
there was “no vacancy” to accommodate the petitioner in respect<\/p>\n
of the concerned area\/Revenue District\/District (as applied for).<\/p>\n
It is also pointed out that the competent authority, after the local<\/p>\n
inspection and enquiry, had submitted a report\/recommendation<\/p>\n
to the Government stating that no vacancy was available to<\/p>\n
accommodate the petitioner (paragraph 2). The said statement<\/p>\n
rather appears to be a paradox, in so far as the absence of<\/p>\n
vacancy was very much known to the Law Department, and if it<\/p>\n
be so, what prompted the Department to inspect the office of the<\/p>\n
petitioner and to ascertain the availability         of necessary<\/p>\n
infrastructure, simultaneously calling for a report from the Bar<\/p>\n
Council, remains to be a matter of mystery.\n<\/p>\n
       3. It has been stated in paragraph 4 of the counter affidavit<\/p>\n

that, pursuant to the amendment of the relevant rules (Sub Rule<\/p>\n
(4A) inserted in Rule 8 of the Notaries Rules 1956), the<\/p>\n
maximum ceiling as to the permissible number of Notaries was<\/p>\n
specified in the schedule as ‘375’, as stated in paragraph 5 of the<\/p>\n
counter affidavit. Learned Government Pleader points out that<\/p>\n
the said number has now gone up to ‘563’ by virtue of the<\/p>\n
amendment         of  the  schedule (as  per   amendment     dated<\/p>\n
19.05.2006). Placing reliance on the above position, particularly<\/p>\n
as to the absence of vacancy, it is asserted by the learned<\/p>\n
Government Pleader that no interference is possible since the<\/p>\n
petitioner does not have any vested right to be appointed as a<\/p>\n
Notary.\n<\/p>\n
       4.    It is relevant to note that there is no case for the<\/p>\n
respondents that the petitioner is not a fit or suitable person to<\/p>\n
be appointed as a Notary or that she is disqualified in any<\/p>\n
manner.        As pointed out, the concerned authority also had<\/p>\n
submitted a report before the Government stating that no<\/p>\n
appointment could be effected due to ‘lack of vacancy’.       But,<\/p>\n
since the specific case of the Government is that the petitioner<\/p>\n

could not be accommodated for want of vacancy, it has<\/p>\n
necessarily to be inferred that nobody else has been appointed by<\/p>\n
the Government as Notary in the particular area in respect of<\/p>\n
which the petitioner had put forth a claim. Learned counsel for<\/p>\n
the petitioner brought to the notice of this Court that steps were<\/p>\n
being pursued by the respondents to effect appointment of<\/p>\n
Notaries       contrary to the rules and norms as highlighted in<\/p>\n
Exhibit P7 news paper report. The first respondent has filed a<\/p>\n
counter affidavit\/ additional affidavit dated 17.12.2007 in<\/p>\n
I.A.No.375\/2007,       where   it has   been    asserted  that   the<\/p>\n
Government has no proposal at all to appoint ‘240’ Notaries as<\/p>\n
alleged and that the averments\/allegations in the above news<\/p>\n
paper report did absolutely have no basis at all. In view of the<\/p>\n
categoric assertion in the above affidavits, the Court is made to<\/p>\n
believe that no appointment of Notary has been effected by the<\/p>\n
Government in respect of the area in question.<\/p>\n
       5.     In the above circumstances, it is hereby declared that<\/p>\n
the petitioner does not have any vested right to be issued the<\/p>\n
‘Certificate of Registration’ merely for having entered her name in<\/p>\n

the Notarial Register by way of mistake, when there was no<\/p>\n
vacancy as per the Rules. However, it is made clear that the<\/p>\n
petitioner will be entitled to be appointed as a Notary in the<\/p>\n
particular area, if the Government has appointed anybody else,<\/p>\n
whose application is subsequent to the application preferred by<\/p>\n
the petitioner, as a Notary in the said area. This aspect as to the<\/p>\n
eligibility shall be considered by the first respondent and<\/p>\n
necessary orders shall be passed in this regard within a period of<\/p>\n
three months from the date of receipt of a copy of this judgment,<\/p>\n
after giving an opportunity of hearing to the petitioner.      The<\/p>\n
petitioner shall produce a copy of this judgment before the first<\/p>\n
respondent.\n<\/p>\n
       This writ petition is disposed of accordingly.<\/p>\n
