MUFASSIL, DISTRICT BEGUSARAI.\n                                             -----------\n<\/pre>\n<p id=\"p_1\">02\/   28.03.2011                 Heard learned counsel for the petitioner and<\/p>\n<p>                    the State.\n<\/p>\n<p id=\"p_1\">                                 2. Petitioner claims himself to be the raiyat<\/p>\n<p>                    of lands detailed in paragraph-4 of the writ petition<\/p>\n<p>                    bearing plot nos.56, 58, 59 appertaining to khata<\/p>\n<p>                    no.168, plot nos.64, 65 appertaining to khata no.210<\/p>\n<p>                    and plot no.67 appertaining to khata no.136 situate in<\/p>\n<p>                    village Mohan Aghu, police station Muffasil, district<\/p>\n<p>                    Begusarai. It is submitted on behalf of the petitioner<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                      2<\/span><\/p>\n<p>that 8 decimals of aforesaid plot no.67 was acquired by<\/p>\n<p>the State Government for sinking a tubewell and laying<\/p>\n<p>a drain vide Land Acquisition Case No.35 of 1967-68.<\/p>\n<p id=\"p_2\">             3. This writ petition has been filed asserting<\/p>\n<p>that Mukhiya and other functionaries of the Gram<\/p>\n<p>Panchayat Raj Mohan Aghu have laid road over<\/p>\n<p>portion of the aforesaid land, including the acquired<\/p>\n<p>land for the purpose of sinking the tubewell and laying<\/p>\n<p>the drain. This petition was filed more than 4 years ago<\/p>\n<p>but the State respondents have not disputed the<\/p>\n<p>aforesaid contention by filing counter affidavit that<\/p>\n<p>portion of raiyati land of the petitioner including the<\/p>\n<p>acquired land for the purpose of sinking the tubewell<\/p>\n<p>and laying the drain has been used for laying a road.<\/p>\n<p id=\"p_3\">             4. In these circumstances, I direct the<\/p>\n<p>petitioner    to   approach    the   District   Magistrate,<\/p>\n<p>Begusarai by filing representation, who should get the<\/p>\n<p>lands in question measured by the Anchal Amin and if<\/p>\n<p>any portion of the raiyati land of the petitioner or any<\/p>\n<p>portion of the land which has been acquired for the<\/p>\n<p>purpose of sinking the tubewell and laying the drain<\/p>\n<p>has been used for laying the road then the District<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                               3<\/span><\/p>\n<p>          Magistrate, Begusarai shall ensure that the road is<\/p>\n<p>          removed from the raiyati land of the petitioner as also<\/p>\n<p>          the acquired land for the purpose of sinking the<\/p>\n<p>          tubewell and laying the drain. In this connection, I may<\/p>\n<p>          refer to the letter of the Sub-Divisional Officer,<\/p>\n<p>          Tubewell       Sub-Division-II     Workshop,      Begusarai<\/p>\n<p>          bearing    no.18        dated    27.2.2006,    Annexure-5,<\/p>\n<p>          whereunder he has categorically stated that the road has<\/p>\n<p>          been laid over acquired land for the purpose of sinking<\/p>\n<p>          the tubewell and for laying the drain without the<\/p>\n<p>          consent of the authorities. The District Magistrate,<\/p>\n<p>          Begusarai shall pass appropriate orders in the matter, as<\/p>\n<p>          early as possible, in any case within two months from<\/p>\n<p>          the date of receipt of the representation of the petitioner<\/p>\n<p>          along with a copy of this order before him.<\/p>\n<p id=\"p_4\">                     5.
