Justice THOTTATHIL B.RADHAKRISHNAN\n\n Dated :11\/09\/2007\n\n O R D E R\n            THOTTATHIL B.RADHAKRISHNAN, J.\n                   -------------------------------------------\n                     O.P.No.6902 OF 2000 &amp;\n                      WPC.No.35601 OF 2003\n                  -------------------------------------------\n            Dated this the 11th day of September, 2007\n\n\n                              JUDGMENT\n<\/pre>\n<p id=\"p_1\">       Petitioners in these writ petitions claim that they are<\/p>\n<p>among those who were promoted in terms of Exts.P3, P4 and P11<\/p>\n<p>orders in W.P(C).35601\/03. They contend that notwithstanding<\/p>\n<p>their officiating in the promoted posts, they were not given<\/p>\n<p>monetary benefits of such promotions, after                    discharging of<\/p>\n<p>duties and responsibilities in the promoted posts.                      It is,<\/p>\n<p>therefore, contended that their retiral benefits have not also<\/p>\n<p>been fixed taking into consideration the emoluments they could<\/p>\n<p>have drawn in the higher posts.\n<\/p>\n<p id=\"p_1\">\n<p id=\"p_2\">2.    Learned Government Pleader                     pointed out that the<\/p>\n<p>aforesaid orders were on the basis of 7 tier promotion scheme,<\/p>\n<p>relating to which, there were litigations before this Court, which<\/p>\n<p>led ultimately to a Review Petition by the Government, before<\/p>\n<p>this Court.\n<\/p>\n<p id=\"p_3\">OP.6902\/00 &amp; WPC.35601\/03<\/p>\n<p>                             Page numbers<\/p>\n<p id=\"p_4\">3.    Whatever be the contention of the Government regarding<\/p>\n<p>the legality or otherwise of the earlier decision of this Court and<\/p>\n<p>the effect of the Review, if the petitioners had, as a matter of<\/p>\n<p>fact, been promoted and they had actually discharged their<\/p>\n<p>duties and responsibilities attached to the higher posts to which<\/p>\n<p>they were so promoted, it cannot be disputed that they are<\/p>\n<p>entitled to draw the emoluments attached to those posts and that<\/p>\n<p>their retiral benefits have also to be determined by taking into<\/p>\n<p>consideration the emoluments that they would have drawn in the<\/p>\n<p>higher posts.\n<\/p>\n<p id=\"p_5\">\n<p id=\"p_6\">      In the       aforesaid circumstances, this writ petition is<\/p>\n<p>disposed of directing that the Chief Engineer (Administration),<\/p>\n<p>P.W.D., Trivandrum (second respondent in these writ petitions)<\/p>\n<p>will take up the individual cases of each of the petitioners and<\/p>\n<p>consider the question whether, following the promotion orders,<\/p>\n<p>the petitioners had actually officiated and worked in the posts to<\/p>\n<p>which they were promoted and if so, the fact that they worked<\/p>\n<p>as such in the promoted posts and retired from such promoted<\/p>\n<p>OP.6902\/00 &amp; WPC.35601\/03<\/p>\n<p>                             Page numbers<\/p>\n<p>posts shall be taken into consideration and their emoluments in<\/p>\n<p>the higher posts shall be released to the petitioners and their<\/p>\n<p>respective retiral benefits shall also be re-fixed.
