Also  perused  the  record.\n<\/p>\n<p id=\"p_2\">It<br \/>\n\tappears that one offence being Kamrej Police Station III-Crime<br \/>\n\tRegister No.605 of 2009 under the prohibition Act has been<br \/>\n\tregistered against the detenue  alleging that foreign liquor of 2160<br \/>\n\tbottles worth Rs.1,81,320\/- were found from the possession of the<br \/>\n\tdetenu. On the basis of registration of the said case, the detaining<br \/>\n\tauthority held that since the activities of selling country made<br \/>\n\tliquor of the present detenu were harmful to the health of the<br \/>\n\tpublic, to restrain him from carrying further illegal activities, he<br \/>\n\thas been detained. It appears from the order that the activities of<br \/>\n\tthe detenu cannot be said to be disturbing the  public order .<br \/>\n\tIt also appears from the order passed by the detaining authority<br \/>\n\tthat  grounds which are mentioned in the order are in reference to<br \/>\n\tthe situation of  law and order  and not  public order .<br \/>\n\tTherefore, on this ground, the subjective satisfaction arrived at by<br \/>\n\tthe detaining authority is vitiated on account of non-application of<br \/>\n\tmind and the impugned order, therefore, deserves to be quashed and<br \/>\n\tset aside.\n<\/p>\n<p id=\"p_3\">Except<br \/>\n\tthe statements of some anonymous witnesses, there is no material on<br \/>\n\trecord which shows that the detenu is carrying on activities of<br \/>\n\tselling country made liquor which is harmful to the health of the<br \/>\n\tpublic. In the case of <a href=\"\/doc\/687998\/\" id=\"a_1\">Ashokbhai Jivraj @ Jivabhai Solanki v.<br \/>\n\tPolice Commissioner, Surat<\/a> [(2001) (1) GLH 393), having<br \/>\n\tconsidered the decision of the Hon&#8217;ble Apex Court in the case of <a href=\"\/doc\/1733535\/\" id=\"a_1\">Ram<br \/>\n\tManohar Lohia v. State of Bihar<\/a> (AIR 1966 SC 740), this Court<br \/>\n\theld that the case wherein the detention order passed on the basis<br \/>\n\tof the statements of the witnesses fall under the maintenance of<br \/>\n\t law and order  and not  public order .\n<\/p>\n<p id=\"p_4\">Applying<br \/>\n\tthe ratio of the above decisions, it is clear that before passing an<br \/>\n\torder of detention of a detenu, the detaining authority must come to<br \/>\n\ta definite finding that there is threat to the  public order<br \/>\n\tand it is very clear that the present case would not fall within the<br \/>\n\tcategory of threat to  public order . In that view of the<br \/>\n\tmatter, when the order of detention has been passed by the detaining<br \/>\n\tauthority without having adequate grounds for passing the said<br \/>\n\torder, it cannot be sustained and, therefore, it deserves to be<br \/>\n\tquashed and set aside.\n<\/p>\n<p id=\"p_5\">The<br \/>\n\tpetition is allowed. The impugned order of detention dated 29-8-2009<br \/>\n\tpassed by the District Magistrate, Surat, passed  against  the<br \/>\n\tdetenu is hereby quashed and set  aside.   The detenu is ordered to<br \/>\n\tbe set at liberty forthwith,  if not  required  in  any other case.<br \/>\n\t  Rule is made absolute accordingly.
