HEMA, J\n                          ----------------------\n                    Crl.L.P.No. 1159 OF 2010\n                    -----------------------------------\n                Dated 9th day of December, 2010\n\n\n                              O R D E R\n<\/pre>\n<p id=\"p_1\">      Petition to grant leave to appeal.\n<\/p>\n<p id=\"p_1\">      2.   Appellant filed a complaint against first respondent<\/p>\n<p>alleging offence under <a href=\"\/doc\/1823824\/\" id=\"a_1\">section 138<\/a> of Negotiable Instruments Act<\/p>\n<p>on the allegation that the accused owed Rs.2,00,000\/- to the<\/p>\n<p>complainant and when the amount was demanded, he issued a<\/p>\n<p>cheque for the said amount, drawn on the account maintained in<\/p>\n<p>his bank. The cheque, on presentation, bounced for want of<\/p>\n<p>sufficient fund. A lawyer notice was issued demanding payment.<\/p>\n<p>Notice was accepted but amount was not paid.              Hence, a<\/p>\n<p>complainant was filed.\n<\/p>\n<p id=\"p_2\">      3.   Complainant examined himself as PW1 and marked<\/p>\n<p>Ext.P1 to P6. The accused examined DW1 to DW3 and marked<\/p>\n<p>Ext.D1 to D5 on his side. According to him a signed blank cheque<\/p>\n<p>was misused by complaint. The cheque was issued to a person<\/p>\n<p>called &#8220;Universal Appachan&#8221; and not to the complainant. Accused<\/p>\n<p>took up a specific contention relating to a property transaction<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">Crl.L.P. No.1159\/10               2<\/span><\/p>\n<p>with another person and also marked documents to establish that<\/p>\n<p>the cheque involved in this case is a blank one when he signed<\/p>\n<p>the same.\n<\/p>\n<p id=\"p_3\">       4. The trial court considered various aspects in detail in the<\/p>\n<p>judgment and found that the complainant could not identify the<\/p>\n<p>accused while a photograph of him was shown to PW1 while he<\/p>\n<p>was examined in court in the absence of accused. Accused was<\/p>\n<p>exempted from appearance and learned defence counsel showed<\/p>\n<p>a group photograph, from which complainant was asked to<\/p>\n<p>identify the accused. But he could not be identified by PW1. The<\/p>\n<p>trial court on analysis of of evidence adduced by accused and<\/p>\n<p>considering the probability of the same found that case set up by<\/p>\n<p>accused is probable and that the evidence adduced by<\/p>\n<p>complainant was unacceptable.        Various reasons are shown in<\/p>\n<p>the order under challenge which are sound and proper. I do not<\/p>\n<p>find any reason to interfere with the order.<\/p>\n<p id=\"p_4\">       5. Learned counsel for the appellant submitted that only for<\/p>\n<p>the reason appellant could not identify the accused from the<\/p>\n<p>photograph, evidence of PW1 may not be discarded and accused<\/p>\n<p>ought not to have been acquitted. On going through the order<\/p>\n<p>under challenge, I find that there are several reasons to persuade<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">Crl.L.P. No.1159\/10               3<\/span><\/p>\n<p>the trial court to come to a finding that complainant has not<\/p>\n<p>proved the case. The failure to identify the accused is also taken<\/p>\n<p>as a very strong reason. I do not find that this is a fit case to<\/p>\n<p>grant leave. Hence I am not inclined to grant leave.<\/p>\n<p id=\"p_5\">       This petition is dismissed.\n<\/p>\n<p id=\"p_6\">\n<p id=\"p_7\">                                           K.
