The petitioner did not appear before<br \/>\nthe Labour Court as a result of which exparte award came to be<br \/>\npassed. The petitioner therefore filed applications for setting aside<br \/>\nthe ex parte awards. The concerned workmen filed recovery<br \/>\napplications. The  Labour Court, Jamnagar rejected the applications<br \/>\nof the petitioner and allowed the recovery applications. It is<br \/>\nagainst those orders that the present petitions have been filed.\n<\/p>\n<p id=\"p_2\">3.\tLearned<br \/>\nAdvocate for the petitioner submitted that the representative of the<br \/>\npetitioner had remained on all the dates of hearing earlier and had<br \/>\nalso sought time for filing reply. He submitted that on 6th<br \/>\nOctober 1986 Bar Association had declared holiday and the matter was<br \/>\nadjourned to 10th November 1986 and thereafter the matter<br \/>\nwas not listed. He submitted that on 1st January 1987<br \/>\nexparte order came to be passed which is illegal and arbitrary.\n<\/p>\n<p id=\"p_3\">4.\tHowever,<br \/>\nthe finding of the Labour Court is that  none appeared for the<br \/>\npetitioner nor have they taken any steps to defend the case.<br \/>\nTherefore it was not established that there was any retrenchment<br \/>\nwhatsoever. As per the say of the petitioner is that after 10th<br \/>\nNovember 1986 the matter was not listed. It is required to be noted<br \/>\nthat the reference is of the year 1983 and the same was renumbered in<br \/>\nthe year 1990. But the petitioner has not produced any documentary<br \/>\nevidence on record to show that the petitioner has filed reply<br \/>\nimmediately after the service. Even after 10th November<br \/>\n1986 enough time was there, but it appears that the petitioner has<br \/>\nnot cared to inquire about the matter till the award was published. I<br \/>\nam therefore of the view that the Labour Court has not committed any<br \/>\nerror in passing the judgement and order.\n<\/p>\n<p id=\"p_4\">5.\tIn<br \/>\nthe premises aforesaid, I do not find any merits in the petitions.<br \/>\nThe same are, therefore, dismissed.
