GOVERNMENT PLEADER for Respondent(s) : 1, \nNOTICE\nSERVED BY DS for Respondent(s) : 1 -\n3. \n============================================\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE JAYANT PATEL\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 15\/10\/2008 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p id=\"p_1\">1.\tThis<br \/>\npetition under Articles 226 and 227 of the Constitution of India is<br \/>\nfiled by the petitioners with following prayers:\n<\/p>\n<p id=\"p_1\"> 27(a)<br \/>\nthe Hon&#8217;ble Court may be pleased to issue a Writ of Mandamus or any<br \/>\nother appropriate writ, order or direction, directing respondent no.<br \/>\n2 to issue a formal order granting N.A. permission to the petitioners<br \/>\nin respect of the land bearing Block No. 117 (survey No. 151\/5),<br \/>\nadmeasuring 2630 sq.mts. Of village Ambli, Taluka Dascroi, District<br \/>\nAhmedabad;\n<\/p>\n<p id=\"p_2\">(b)<br \/>\nThe Hon&#8217;ble Court may be pleased to issue a writ of mandamus or any<br \/>\nother appropriate writ, order or direction, directing respondent no.3<br \/>\nto effect appropriate entry in village form no.6 showing that the<br \/>\naforesaid land is permitted to be converted into N.A. use by<br \/>\nrespondent no.2.\n<\/p>\n<p id=\"p_3\">(c)<br \/>\npending admission, hearing and final disposal of this petition, the<br \/>\nHon&#8217;ble Court may be pleased to direct respondent no. 2 to issue a<br \/>\nprovisional N.A. permission to petitioner no.1 in respect of the<br \/>\naforesaid land, so as to permit petitioner no.2 to apply for issuance<br \/>\nof development permission to the competent authority.\n<\/p>\n<p id=\"p_4\">2.\tIn<br \/>\nthe compilation of the petition certain correspondence entered into<br \/>\nbetween the petitioners and the respondents is annexed.\n<\/p>\n<p id=\"p_5\">2.1.\tIn<br \/>\nthe affidavit-in-reply filed in the above Special Civil Application,<br \/>\nthe deponent of the affidavit had clearly stated that by a letter<br \/>\ndated 31.1.2006, the petitioner was specifically directed to produce<br \/>\nan extract of revenue record of village Form No. 7\/12, Form No. 6,<br \/>\n8-KH for the year 1971-72 and 2004-2005 along with other documents<br \/>\nnamely Zoning Certificate in case if petitioners have submitted an<br \/>\napplication before AUDA for development receipt of such application,<br \/>\nF-Form and part plan of TPS.  In the rejoinder filed to the<br \/>\naffidavit, the petitioners herein dispute requirement of certain<br \/>\ndocuments and submitted that procedure adopted by the authority of<br \/>\ndelaying grant of permission, is illegal and the above communication<br \/>\nwas not received by the petitioners.\n<\/p>\n<p id=\"p_6\">3.\tOn<br \/>\n14.8.2008, this Court (Coram: Hon&#8217;ble Mr. Justice Akil Kureshi)<br \/>\npassed following order:\n<\/p>\n<p id=\"p_7\"> Petitioners<br \/>\nhave complained about the respondents not granting NA permission for<br \/>\nplot of land held by the petitioners.  Petitioners contend that an<br \/>\napplication for the said purpose was made on 27.1.2006, but the same<br \/>\nwas not replied to.  In the affidavit in reply, however, the<br \/>\nrespondents contend that the application of the petitioners was<br \/>\nresponded to and the petitioners did not fulfill the queries raised<br \/>\nin the communication dated 31.1.06.\n<\/p>\n<p id=\"p_8\">\tAt<br \/>\nthis stage, it is not necessary to go into the above disputes between<br \/>\nparties.  Learned advocate Shri Munshi for the petitioners submitted<br \/>\nthat the petitioners would promptly fulfill  all requirements raised<br \/>\nin the said communication and also pay whatever legal necessary<br \/>\ncharges.  However, the respondents be directed to take early decision<br \/>\nin the application of the petitioners since the petitioners are<br \/>\nsuffering due to indefinite delay.\n<\/p>\n<p id=\"p_9\">\tLearned<br \/>\nAGP Shri Shah submitted that  if the petitioners fulfill all legal<br \/>\nrequirements, the authorities will examine the same and pass<br \/>\nappropriate order expeditiously.  Under these circumstances, it is<br \/>\ndirected that the petitioners may fulfill the queries raised by the<br \/>\nrespondents in the communication dated 31.1.06 within a  week from<br \/>\ntoday.  If the respondents have any further requirements, the same<br \/>\nshall be   conveyed within three days of the petitioners supplying<br \/>\nthe details as mentioned above. The petitioners would have on week<br \/>\nthereafter to submit the necessary materials.  The authorities shall<br \/>\ntake a final decision on the request of the petitioner  despite<br \/>\npendency of the present petition latest by 15th October<br \/>\n2008 and place the same before the court on the next date of hearing.<br \/>\n S.O. 17th October 2008.\n<\/p>\n<p id=\"p_10\">\tDirect<br \/>\nservice.\n<\/p>\n<p id=\"p_11\">4.\tToday<br \/>\nan application for draft amendment is submitted bringing on record<br \/>\nthe decision taken by the competent authority on 17.9.2008 and<br \/>\nsubmitted that the aforesaid decision is not in accordance with the<br \/>\ndirections issued by this Court.  Not only that but though the<br \/>\npetitioners were to be given a further opportunity for compliance, no<br \/>\nsuch opportunity is given and as per Section 65 of the Code, the<br \/>\nearlier application of the petitioners were not decided and the<br \/>\napplication deemed to have been granted by the authority.\n<\/p>\n<p id=\"p_12\">5.\tIt<br \/>\nis an admitted fact that pursuant to the order passed on 14.8.2008,<br \/>\nthe decision dated 17.9.2008 is already taken by the District<br \/>\nCollector, Ahmedabad and following non-compliance is reported that<br \/>\nthe petitioners have not complied with the issues raised by the Dy.<br \/>\nDistrict Development Officer.  That, inspite of specific request on<br \/>\nearlier occasion as per the letter of 2006, the relevant record of<br \/>\nvillage Form No. 6 was not submitted.  Even certified copies as<br \/>\nrequired for considering the application of the petitioners for<br \/>\nzoning certificate was not submitted and in case if the petitioners<br \/>\nwanted to develop the land, any application forwarded before the<br \/>\nAhmedabad Urban Development Authority was also not produced and part<br \/>\nplan and the F-Form pertaining to T.P. Scheme were also not the part<br \/>\nof the record submitted by the petitioners.\t  However, in addition to<br \/>\nthe above, the concerned District Collector has taken into<br \/>\nconsideration the Government Resolution dated 1.7.2008 issued by the<br \/>\nRevenue Department of the Government in exercise of powers under<br \/>\nSection 65 of the Code, locus of the petitioner that only the<br \/>\noccupant or the lawful holder of the land can apply.  At the same<br \/>\ntime, the petitioners herein is given an opportunity to obtain a<br \/>\nspecific Form No. 18 and thereafter to submit application as per the<br \/>\nrequirement so that within specific time limit the request of the<br \/>\npetitioner for N.A. permission can be considered.\n<\/p>\n<p id=\"p_13\">6.\tThe<br \/>\nabove decision dated 17.9.2008 cannot be said to be in any manner<br \/>\narbitrary, unreasonable or discriminatory as violative of <a href=\"\/doc\/367586\/\" id=\"a_1\">Article 14<\/a><br \/>\nof the Constitution of India and the application of the petitioner<br \/>\nwas pending and not decided and, therefore, the provision of law of<br \/>\nthe land in force with regard to subject matter is applicable and<br \/>\naccording to this Court when against this order also remedy under the<br \/>\nstatute is available, no case is made out to exercise powers under<br \/>\n<a href=\"\/doc\/1712542\/\" id=\"a_1\">Article 226<\/a> of the Constitution of India.\n<\/p>\n<p id=\"p_14\">7.\tPetition<br \/>\nis rejected.
