Justice S.SIRI JAGAN\n\n Dated :10\/09\/2009\n\n O R D E R\n                   S.SIRIJAGAN,J.\n                   --------------\n               WP(C)NO. 20164 OF 2004\n               ----------------------\n      DATED THIS THE 10TH DAY OF SEPTEMBER 2009\n\n\n\n                      JUDGMENT\n<\/pre>\n<p id=\"p_1\">                      &#8212;&#8212;&#8211;\n<\/p>\n<p id=\"p_1\">    Petitioner  is   the  Managing   Director  of   a<\/p>\n<p>Company which is a consumer of electricity. The<\/p>\n<p>bills for arrears of electricity charges amounting<\/p>\n<p>to Rs. 1,00,315\/-for the month of May 2004 has been<\/p>\n<p>served on the Petitioner vide Exts.P1 and P2. The<\/p>\n<p>Petitioner&#8217;s grievance in respect of the bills is<\/p>\n<p>that an amount of Rs. 33,035\/- has been charged<\/p>\n<p>towards   interest   which    is   exorbitant.    The<\/p>\n<p>Petitioner therefore seeks the following reliefs:-<\/p>\n<p id=\"p_2\">       i)  a declaration that the amount of<br \/>\n   Rs.33,035 charged towards interest for the<br \/>\n   month ofMay 2004 is illegal and unreasonable;<\/p>\n<p id=\"p_3\">       ii) a writ of mandamus or any other<br \/>\n   appropriate   writ,    direction    or    order<br \/>\n   commanding the respondents to reconnect the<br \/>\n   service to the petitioner&#8217;s unit, Ponmudi<br \/>\n   Paper Mills(P)Ltd. Forthwith.<\/p>\n<p id=\"p_4\">       iii)such   other    reliefs   which    this<\/p>\n<p>WP(C)NO. 20164 OF 2004<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                          2<\/span><\/p>\n<p>   Hon&#8217;ble Court may deem fit and proper in the<br \/>\n   facts and circumstances of the case.<\/p>\n<p>The learned Counsel appearing for the Electricity<\/p>\n<p>Board submits that under Regulation 32(e) of the<\/p>\n<p>Conditions of Supply of Electrical Energy, which<\/p>\n<p>was in force at the relevant time, mandates that if<\/p>\n<p>electricity dues are not paid on or before the due<\/p>\n<p>date, interest will be levied at 24% p.a. According<\/p>\n<p>to the Standing Counsel of K.S.E.B the interest has<\/p>\n<p>been charged only at that rate.\n<\/p>\n<p id=\"p_5\">2.  Learned Counsel for the Petitioner submits that<\/p>\n<p>the interest may be waived or at least reduced.I do<\/p>\n<p>not think that when the statute mandates that for<\/p>\n<p>non payment of electricity charges on due dates,<\/p>\n<p>interest at the rate of 24% is payable, this Court<\/p>\n<p>can, in exercise of its jurisdiction under <a href=\"\/doc\/1712542\/\" id=\"a_1\">Article<\/p>\n<p>226<\/a> of the Constitution of India waive or reduce<\/p>\n<p>the same. Therefore I do not find any merit on<\/p>\n<p>WP(C)NO. 20164 OF 2004<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                          3<\/span><\/p>\n<p>this Original Petition.
