Justice ANTONY DOMINIC\n\n Dated :10\/12\/2010\n\n O R D E R\n                       ANTONY DOMINIC, J.\n\n             ```````````````````````````````````````````````````````\n                 W.P.(C) No. 36837 of 2010 D\n             ```````````````````````````````````````````````````````\n          Dated this the 10th day of December, 2010\n\n                            J U D G M E N T\n<\/pre>\n<p id=\"p_1\">            Petitioner&#8217;s team has participated in the Sub<\/p>\n<p>District School Kalolsavam 2010-2011 in the item &#8216;Oppana&#8217;.<\/p>\n<p>They were given the second prize. Aggrieved by the above,<\/p>\n<p>petitioner filed Ext.P5 appeal, which was rejected by Ext.P6.<\/p>\n<p>It is challenging Ext.P6, the writ petition is filed.<\/p>\n<p id=\"p_1\">       2.   Contention raised is that the grounds raised in<\/p>\n<p>Ext.P5 were not properly considered by the appellate<\/p>\n<p>committee.     First of all, it is pointed out by the learned<\/p>\n<p>Government Pleader that the first place winner had secured<\/p>\n<p>268 points and the petitioner had only 252. According to the<\/p>\n<p>learned Government Pleader, the appellate committee<\/p>\n<p>examined the contentions and found them to be devoid of<\/p>\n<p>merits and it was therefore rejected.<\/p>\n<p id=\"p_2\">       3.   A reading of Ext.P5 shows that the petitioner did<\/p>\n<p>complain that a participant got injured and that due to the<\/p>\n<p>W.P.(C) No.36837\/10<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                 : 2 :<\/span><\/p>\n<p>improper arrangement of the stage they could not perform<\/p>\n<p>well.     This grievance was considered by the appellate<\/p>\n<p>committee and they did not find any merit in it.               Even<\/p>\n<p>otherwise petitioner has not produced any material to<\/p>\n<p>substantiate the contention, in which event only, this Court<\/p>\n<p>can find Ext.P6 order erroneous.           In the absence of such<\/p>\n<p>materials, I do not think this Court will be justified in interfering<\/p>\n<p>with Ext.P6. Even otherwise by any order passed in the writ<\/p>\n<p>petition the existing first prize winner will be affected and the<\/p>\n<p>first prize winner is not a party to the writ petition.<\/p>\n<p id=\"p_3\">      4.
