No. I-44 of 2008  filed before Manavdar Police<br \/>\nStation,  Dist. Junagadh for offence punishable under <a href=\"\/doc\/834094\/\" id=\"a_1\">sections 407<\/a>,<br \/>\n<a href=\"\/doc\/1099980\/\" id=\"a_2\">420<\/a>, <a href=\"\/doc\/338903\/\" id=\"a_3\">465<\/a>, <a href=\"\/doc\/286506\/\" id=\"a_4\">467<\/a>, <a href=\"\/doc\/1599077\/\" id=\"a_5\">468<\/a>, <a href=\"\/doc\/1590825\/\" id=\"a_6\">471<\/a>, <a href=\"\/doc\/574291\/\" id=\"a_7\">472<\/a>, <a href=\"\/doc\/461785\/\" id=\"a_8\">474<\/a>, <a href=\"\/doc\/989759\/\" id=\"a_9\">114<\/a> and <a href=\"\/doc\/123141\/\" id=\"a_10\">120<\/a>.B<a href=\"\/doc\/1569253\/\" id=\"a_11\"> of the Indian Penal<br \/>\nCode<\/a>.\n<\/p>\n<p id=\"p_1\">\tA<br \/>\ncomplaint was given by Premji Nathabhai Manvar alleging therein that<br \/>\nhe is residing at Manavdar and running a factory in the name of<br \/>\nAshish Cotton Company and used to supply cotton bundles through<br \/>\nbrokers.  It is alleged in the complaint that goods were sold through<br \/>\nAnil, the present applicant, and one Satish and the goods were<br \/>\ntransported through National Roadways and Amin Roadways.  As per the<br \/>\ncomplaint, on instructions of the applicant, 7500 bundles of cotton<br \/>\nwere sent by the complainant but he has received payment of 5600<br \/>\nbundles only. It is further alleged in the complaint that the cheque<br \/>\nwhich was given to the present was also forged by the applicant. As<br \/>\nper the complaint, the goods were never delivered to the parties for<br \/>\nwhom it was dispatched and were sold off to some other parties and<br \/>\nthe amount in question was not paid to the complainant. The<br \/>\ncomplainant therefore lodged the present complaint.\n<\/p>\n<p id=\"p_2\">\tMr.\n<\/p>\n<p id=\"p_3\">Ashish Dagli, learned advocate for the applicant  submitted that the<br \/>\napplicant  has been falsely implicated in the commission of the<br \/>\nalleged offence and a false case is foisted on him. He further<br \/>\nsubmitted that charge sheet is already filed and the entire<br \/>\ninvestigation is over and since the present applicant is in jail<br \/>\nsince his arrest, he be released on bail.  Learned advocate submitted<br \/>\nthat the dispute which is involved between the parties is of a civil<br \/>\nnature but a criminal complaint is filed with a view to exert<br \/>\npressure on the applicant and other accused persons. Learned<br \/>\nadvocate, placing reliance on the complaint,  submitted that the<br \/>\npresent case is triable by JMFC Court and looking to the backlog of<br \/>\ncases pending before JMFC court, the trial will take a long time and<br \/>\nthe applicant would remain behind the bars for a long time from the<br \/>\ndate of his arrest. In view of the aforesaid facts and circumstances,<br \/>\nlearned advocate submitted that this is a fit case to enlarge the<br \/>\napplicant  on regular bail. Learned advocate also placed reliance on<br \/>\nthe documents which are produced along with the application in<br \/>\nsupport of the contention that it is a fit case to release the<br \/>\napplicant on regular bail. He further submitted that in the charge<br \/>\nsheet there is not an iota of evidence connecting the applicant with<br \/>\nthe commission of offence and even nothing is recovered from the<br \/>\napplicant, and, therefore, the prayer as set out in the application<br \/>\nto release him on regular bail be granted.  Learned advocate further<br \/>\nplaced reliance on the order dated 17.04.2009 passed by this Court<br \/>\n[Coram: Z.K. Zaiyed, J.] in Criminal Misc. Application No. 2006 of<br \/>\n2009 and submitted that even on the ground of parity, the application<br \/>\ndeserves to be granted.\n<\/p>\n<p id=\"p_4\">\tOn<br \/>\nthe other hand, learned APP, Ms. M.L. Shah submitted that the<br \/>\napplicant is involved in serious offences punishable under <a href=\"\/doc\/834094\/\" id=\"a_12\">sections<br \/>\n407<\/a>, <a href=\"\/doc\/1099980\/\" id=\"a_13\">420<\/a>, <a href=\"\/doc\/338903\/\" id=\"a_14\">465<\/a>, <a href=\"\/doc\/286506\/\" id=\"a_15\">467<\/a>, <a href=\"\/doc\/1599077\/\" id=\"a_16\">468<\/a>, <a href=\"\/doc\/1590825\/\" id=\"a_17\">471<\/a>, <a href=\"\/doc\/574291\/\" id=\"a_18\">472<\/a>, <a href=\"\/doc\/461785\/\" id=\"a_19\">474<\/a>, <a href=\"\/doc\/989759\/\" id=\"a_20\">114<\/a> and <a href=\"\/doc\/123141\/\" id=\"a_21\">120<\/a>.B<a href=\"\/doc\/1569253\/\" id=\"a_22\"> of the Indian<br \/>\nPenal Code<\/a>.  Taking into account the role attributed to the applicant<br \/>\n and the huge amount which is involved, the prayer for bail may not<br \/>\nbe granted to the applicant .  She further submitted that the<br \/>\napplication sold away the goods and pocketed huge amount of money and<br \/>\nhas not paid the money to the complainant.  Learned APP has placed<br \/>\nreliance on the various statement of witnesses and other documents as<br \/>\nwell as the order of further investigation which is passed by Chief<br \/>\nJudicial Magistrate, Junagadh on 02.01.2010 and submitted that on<br \/>\nfurther investigation, the inextricable involvement is prima facie<br \/>\nestablished.  She further submitted that the applicant is in the<br \/>\nhabit of committing such offences and various complaints have been<br \/>\nfiled against him, and even looking to the antecedents of the<br \/>\napplicant, he cannot be granted regular bail. She,  therefore,<br \/>\nsubmitted that the applicant may not be granted discretionary relief<br \/>\nas prayed for in the application, and the application deserves to be<br \/>\ndismissed.\n<\/p>\n<p id=\"p_5\">\tOn<br \/>\nbehalf of the original complaint, Mr. Zubin Bharda appeared and<br \/>\nopposed grant of regular bail, by filing a detailed affidavit.  It is<br \/>\ncontended in the affidavit that the applicant purchased large<br \/>\nquantity of cotton bales of a huge amount by misrepresenting that the<br \/>\nsaid goods were purchased for and on behalf of Gujarat Ambuja<br \/>\nExports, Nitin Spinners and Alalps Industries which are situated in<br \/>\nRajasthan but the applicant offloaded the goods at Ahmedabad and sold<br \/>\nit off in the local market and misappropriated the sale proceeds. It<br \/>\nis also averred in the affidavit that the applicant has forged letter<br \/>\nheads and rubber stamps in the name of spinning mills in Rajasthan<br \/>\nand by putting signatures on the false letterheads of the Companies<br \/>\nin Rajasthan, enticed the complainant to supply goods. It is further<br \/>\ncontended in the affidavit that during the investigation it has been<br \/>\nrevealed that the the applicant has destroyed the forged letter heads<br \/>\nas well as rubber stamps made and used for the purpose of placing<br \/>\norders. It is further contended in the affidavit that the applicant<br \/>\nis the mastermind behind the entire conspiracy hatched with other<br \/>\nco-accused and the total amount of misappropriation in all comes to<br \/>\nthe tune of more than Rs.4 Crores. It is also contended in the<br \/>\naffidavit that the applicant  is a habitual offender who has not<br \/>\nstopped despite on earlier occasions discretion was exercised by the<br \/>\nCourts having competent jurisdiction.  It is contended that the<br \/>\napplicant  is having criminal antecedents and has misused the liberty<br \/>\nexercised in his favour. Learned advocate therefore submitted that<br \/>\nthe applicant may not be granted discretionary relief as prayed for<br \/>\nin the application, and the application deserves to be dismissed.\n<\/p>\n<p id=\"p_6\">\tHeard<br \/>\nlearned advocate Mr. Dagli for the applicant  and Ms. M.L. Shah,<br \/>\nlearned APP at length and in great detail.  I have also heard Mr.<br \/>\nBharda, learned advocate appearing for the original complainant and<br \/>\nconsidered the detailed affidavit filed by the original complainant<br \/>\nin this matter.  Learned APP placed before me for my perusal the<br \/>\nentire investigation papers and I have also considered the same.\n<\/p>\n<p id=\"p_7\">\tThe<br \/>\ninvestigating papers primafacie reveal offence against the applicant<br \/>\nas alleged. In view of the complexity of investigation in the matter,<br \/>\na re-investigation was also ordered and there are various<br \/>\nincriminating evidence against the applicant. Letter heads and rubber<br \/>\nstamps were forged to dupe the complainant. Goods are sold off and<br \/>\nthe proceeds are misappropriated. Hence there is no merit in the<br \/>\ncontention that nothing is recovered from the applicant.  It appears<br \/>\nto me from the reading of the case papers that the applicant is the<br \/>\nmastermind behind the entire conspiracy.  For this reason alone, he<br \/>\ncannot claim parity with the co-accused released on regular bail by a<br \/>\nco-ordinate Bench of this Court.  Even otherwise, relief under<br \/>\n<a href=\"\/doc\/1667941\/\" id=\"a_23\">section 439<\/a> is a discretionary relief, where the ground of parity<br \/>\ncarries less weight because the role attributed to each applicant<br \/>\ndiffers. Forging of Bank accounts and issuing bogus cheques also<br \/>\nappear to have come to light in the present case. I have also<br \/>\nconsidered the antecedents of the applicant. Various complaints of<br \/>\nsimilar nature are filed against the applicant. Even before me today,<br \/>\nthere are four applications for regular bail [Misc. Criminal<br \/>\nApplications No. 9670\/09, 9667\/09. 9686\/09 and 9688\/09] filed by the<br \/>\npresent applicant which indicates the conduct of the applicant.<br \/>\nLooking to the mode and manner in which the offence is committed and<br \/>\nthe quantum of money involved, this Court is also not convinced by<br \/>\nthe argument that in the present and similar transactions only<br \/>\ndisputes of civil nature is involved and for that reason the<br \/>\napplicant is required to be released on regular bail.  On the<br \/>\ncontrary, I am of the considered view that releasing such persons on<br \/>\nregular bail will have deleterious effect on the Society as a whole<br \/>\nsince large amount is alleged to have been misappropriated by the<br \/>\napplicant along with co-accused and the record indicates that the<br \/>\napplicant is the mastermind behind it.\n<\/p>\n<p id=\"p_8\">\tFor<br \/>\nthe reasons aforesaid, and having heard the learned advocates and<br \/>\nhaving considered the role attributed to the applicant and reflected<br \/>\nin the FIR at Annexure &#8216;A&#8217;, antecedents of the applicant and the<br \/>\npolice papers produced by learned APP, statement of witnesses and<br \/>\nother documents, I am of the view that this is not a fit case where<br \/>\nthis Court, by exercising its discretionary jurisdiction, is required<br \/>\nto enlarge the applicant on regular bail.
