The petitioner is<br \/>\n\tbranded as &#8220;bootlegger&#8221;.\n<\/p>\n<p id=\"p_1\">Heard<br \/>\n\tMs. Bharti Rana, Ld. Advocate for Mr. AS Dave, Ld. Advocate for  the<br \/>\n\tpetitioner and Mr. KL Pandya, learned AGP for the respondents.<br \/>\n\tAffidavit-in-reply filed by the respondent &#8211; Commissioner of<br \/>\n\tPolice, Surat City has been taken into consideration.\n<\/p>\n<p id=\"p_2\">The<br \/>\n\tdetenu came to be detained as &#8220;bootlegger&#8221; on his<br \/>\n\tinvolvement in one offence arising under the Bombay Prohibition Act.\n<\/p>\n<p id=\"p_3\">It<br \/>\n\thas been submitted by the learned Counsel for the detenu that it is<br \/>\n\ta settled legal position that on registration of one offence, no<br \/>\n\torder of detention could have been passed, as detenu cannot be<br \/>\n\tbranded as &#8220;bootlegger&#8221;. It has been further submitted<br \/>\n\tthat the activities of the petitioner cannot be said to be injurious<br \/>\n\tto the public health or public order. It has been further submitted<br \/>\n\tby the learned Counsel for the petitioner that there is gross delay<br \/>\n\tin passing the order of detention as well as there is gross delay in<br \/>\n\texecuting order of detention.\n<\/p>\n<p id=\"p_4\">Per<br \/>\n\tcontra, Mr. KL Pandya, learned AGP representing the respondents<br \/>\n\tsupported the detention order dated 01\/07\/2010 passed by respondent\n<\/p>\n<p id=\"p_5\">\t&#8211; Commissioner of Police, Surat City and submitted that before<br \/>\n\tpassing the detention order, the detention authorities took into<br \/>\n\tconsideration all the relevant papers and after subjective<br \/>\n\tsatisfaction, the detention order is passed and thus the detention<br \/>\n\torder is legal and proper and no interference in the said order is<br \/>\n\twarranted and consequently the petition deserves dismissal.\n<\/p>\n<p id=\"p_6\">I<br \/>\n\thave gone through the grounds of detention and considered the<br \/>\n\tsubmissions advanced on behalf of both the sides.\n<\/p>\n<p id=\"p_7\">The<br \/>\n\tCourt is of the opinion that there is much substance in the<br \/>\n\targuments advanced by learned Counsel for the petitioner. It is seen<br \/>\n\tfrom the grounds that a general statement has been made by the<br \/>\n\tdetaining authority that consuming liquor is injurious to health. In<br \/>\n\tfact, a perusal of the order passed by the detaining authority shows<br \/>\n\tthat the grounds which are mentioned in the order are in reference<br \/>\n\tto the situation of &#8220;law and order&#8221; and not &#8220;public<br \/>\n\torder&#8221;. Therefore, on this ground, the subjective satisfaction<br \/>\n\tof the detaining authority is vitiated on account of non-application<br \/>\n\tof mind and the impugned order, therefore, deserves to be quashed<br \/>\n\tand set aside.\n<\/p>\n<p id=\"p_8\">Except<br \/>\n\tthe general statement, there is no material on record which shows<br \/>\n\tthat the petitioner &#8211; detenu is carrying on illegal activities<br \/>\n\tof selling liquor or is engaged in such activity, which is harmful<br \/>\n\tto the health of the public. In the case of ASHOKBHAI JIVRAJ @<br \/>\n\tJIVABHAI SOLANKI v\/s. POLICE COMMISSIONER, Surat, reported in 2001<br \/>\n\t(1) GLH 393, having considered the decision of the Hon&#8217;ble Apex<br \/>\n\tCourt in the case of Ram manohar Lohia v\/s. State of Bihar,<br \/>\n\treported in AIR 1966 SC 740, this Court held that the cases<br \/>\n\twherein the detention order are passed on the basis of the<br \/>\n\tstatements of such witness fall under the maintenance of &#8220;law<br \/>\n\tand order&#8221; and not &#8220;public Order&#8221;.\n<\/p>\n<p id=\"p_9\">Applying<br \/>\n\tthe ratio of the above decisions, it is clear that before passing an<br \/>\n\torder of detention, the detaining authority must come to a definite<br \/>\n\tfindings that there is threat to the &#8216;public order&#8217; and it is very<br \/>\n\tclear that the present case would not fall within the category of<br \/>\n\tthreat to a public order. In that view of the matter, when the order<br \/>\n\tof detention has been passed by the detaining authority without<br \/>\n\thaving adequate grounds for passing the said order, cannot be<br \/>\n\tsustained and, therefore, it deserves to be quashed and set aside.\n<\/p>\n<p id=\"p_10\">\tFor the foregoing<br \/>\n\treasons, this petition is allowed. The impugned order of detention<br \/>\n\tdated 01\/07\/2010 passed by the respondent &#8211; Commissioner of<br \/>\n\tPolice, Surat City, is hereby quashed and set aside. The detenu &#8211;<br \/>\n\tBhupendra @ Kalu Prabhubhai Patel is ordered to be set at liberty<br \/>\n\tforthwith, if not required in any other case. Rule made absolute<br \/>\n\taccordingly.
